...A Writ of Habeas Corpus as outlined in our book is that of a legal act that calls for an individual under seizure to be brought in front of a court of law for an inquiry to essentially decide if they are guilty or not of the suspected crime (Levin-Waldman, 2012). The Writ of Habeas Corpus explicitly brings up the right to contest one's arrest and imprisonment. It is also a way for the government to force an individual to come before the courts. By permitting an independent judge to analysis the legitimacy of the individual’s confinement and instruct that the detainee be freed if the circumstances are unlawful, habeas corpus functions as a safeguard against unlawful seizure, arrest, and torture. While habeas corpus has been upheld as a fundamental right of the imprisoned, this safeguard has been obstructed throughout our history, making the habeas corpus right, at times, a subject of our desire for refuge during times of emergency. The beginnings of habeas corpus can be traced to the year 1215 in the 39th article of the Magna Carta signed by King John, which says that: "No man may be restrained or confined except by the lawful declaration of his peers or by the decree of the land" (Rohde, S 2010). Siegel, Barbara Zepp Larson Harvard Business School, Harvard University, Boston, Massachusetts 02163 {jsiegel@hbs.edu, blarson@hbs.edu} A lthough one of the central questions in the global strategy field is how multinational firms successfully navigate multiple and often conflicting institutional environments, we know relatively little about the effect of conflicting labor market institutions on multinational firms’ strategic choice and operating performance. With its decision to invest in manufacturing operations in nearly every one of the world’s largest welding markets, Lincoln Electric offers us a quasi-experiment. We leverage a unique data set covering 1996–2006 that combines data on each host country’s labor market institutions with data on each subsidiary’s strategic choices and historical operating performance. We find that Lincoln Electric performed significantly better in countries with labor laws and regulations supporting manufacturers’ interests and in countries that allowed the free use of both piecework and a discretionary bonus. Furthermore, we find that in countries with labor market institutions unfriendly to manufacturers, Lincoln Electric was still able to overcome most (although not all) of the institutional distance by what we term flexible intermediate adaptation. MacKay, and Janice Ristock University of Manitoba The purpose of this study was to explore the experiences of stress among both female and male managers, using a series of single-sex and mixed focus groups. In addition to substantial similarities between female and male participants’ descriptions about their experiences of stress (e.g., negative and positive aspects of stress, different levels of stress, lack of sleep, pressure, financial stressors, being a manager), a number of important gender differences emerged from their descriptions. These differences can be explained by the way in which gender continues to be socially constructed in society; specifically, there are differing gender role expectations and responsibilities for women and men. Female managers experienced “emotional stress,” primarily because of the pressure to meet expectations of being responsible and caring for people both inside and outside of their home. In contrast, male managers tended to focus on themselves and regard other things as beyond their control or responsibility. KERBO, and ELKE WITT'ENHAGEN* From a series of qualitative interviews with Japanese managers and German managers and workers in thirty-one Japanese-owned companies in the Dusseldorf region of western Germany, this article discusses differences in cultural patterns and organizational styles between the German and Japanese employees and the problems these pose for communication, cooperation, and morale. First, we deal with cultural contrasts: language issues, interpersonal styles (personability and politeness), and norms regarding the taking of responsibility. Second, we examine the impact on cross-nationality relations of established organizational practice: for example, German specialism vs. Japanese generalism; direct and vertical vs. indirect and incremental decision making. We also discuss efforts by these firms to find compromise systems that would meet the needs and interests of both sides. The third focus is the reactions of Japanese companies in North Rhine-Westphalia to German unions, works councils, and codetermination regulations. ...Polarizing Effect of Obama’s Presidency Abstract Previous research has shown that individuals who are highly conservative are more likely to hold negative perceptions of African-Americans and other minorities. Furthermore, racial antipathy affects the way individuals perceive Barack Obama. In light of recent trends, this study tested whether individuals who identify themselves as Republicans are substantially more likely to maintain negative racial attitudes. The study also investigated whether white Americans are more likely than other racial groups to harbor racial prejudices and disapprove of Barack Obama. Results from this study indicated that racial resentment plays a significant role in contemporary politics. Data from between-subjects ANOVA and correlational analysis suggested that the Democratic Party and Republican Party are polarized in regards to racial issues. Moreover, conservative whites are the most likely racial group to hold racial prejudices against African-Americans. Finally, disapproval of President Obama is highly associated with high levels of negative racial stereotypes.
