CAA refuses to back PIA deal

[pic][pic]KARACHI, Jan 13: The Civil Aviation Authority has refused to “endorse” the provisions of an arrangement reached between the Pakistan International Airlines and the Turkish Airlines and has planned to suggest certain amendments to the deal to the ministry of defence shortly, it emerged on Thursday.
The sources said that the CAA in a communication to the ministry of defence while responding to the latter`s queries on the issue through a letter (No: AT-3(3)/83 dated Jan 1, 2011) stated that both the airlines could not enter into an agreement without first getting permission to this effect from their respective governments.
They quoted the aviation authorities as saying that this was not the first occasion that the PIA had violated the rules of business while negotiating such agreements though this certainly was the most serious violation.
The sources said that the part of the “interline record of discussion” between the PIA and the Turkish Airlines proposed to amend the existing operating parameters available as per bilateral Air Services Agreement (ASA), such as: increasing the weekly frequencies, amendment to the route schedule and fifth freedom traffic rights.
The CAA stated that the amendment or expansion in the existing bilateral arrangements was a prerogative of the respective two aeronautical authorities, the governments of Pakistan and Turkey, and not the designated airlines, the PIA and the Turkish Airlines, the sources added.
According to them, the CAA says that the PIA is bound to follow the rules of business which clearly state that the PIA, in consultation with the CAA director-general, will submit a brief to the aviation division seeking approval of the federal government on a specific point of policy; and inter-airlines talks can be held only after getting the approval, keeping in view the limitation and conditions imposed by the government.
The CAA says: “The PIA has not consulted the DG CAA and presumably it did not seek a prior approval of the federal government (defence ministry). Earlier, on three occasions the PIA had violated the rules of business when it negotiated similar agreements with Saudi Airlines, Singapore Airlines and Royal Jordanian Airlines.”
The sources said that the CAA had taken serious notice of these violations and had issued warnings to the PIA to desist from the practice. The ministry of defence had been upholding CAA`s position on such issues, but the aviation authority`s and the ministry`s warnings seemed to have no effect on the PIA as it had continued to violate the rules of business, they added.
The sources quoted the CAA as saying that the ASA between Pakistan and Turkey “is one of the most restrictive of all the ASAs that Pakistan had negotiated so far, it is not in line with national aviation policy in vogue and leaves no room for private airlines to operate to and through Turkey.”
They said the CAA mentioned that the bilateral framework needed many amendments such as: i) the ASA needed to be replaced with new text; ii) incorporation of multiple airlines designation; iii) removal of mandatory code-share provision in the operating parameters of the existing MoU; expansion of capacity/ frequency to accommodate private airlines and amendment in route schedule.
The sources said that a comprehensive draft of the MoU to amend existing bilateral arrangements between Pakistan and Turkey shall be forwarded to the ministry of defence shortly.
They said that keeping in view the above reservation / concerns the CAA Pakistan did not endorse the provisions of the interline record of discussion pertaining to amendment in the ASA.
While the CAA and the defence ministry had concerns over the violations of the rules of business by the PIA, an international consultant had been called in and negotiation with him were under way to prepare a feasibility report regarding the proposed arrangement at an astronomical cost of Rs500 million, the sources said.
Interestingly, PIA Flight Operations Director Shuja Naqvi has issued a circular to all flight crew regarding the proposed arrangement with the Turkish Airlines and how it would benefit the airlines and passengers despite the concerns expressed by the CAA over the arrangement.

PIA staff representatives, meanwhile, urged the ministry of defence to intervene and stop PIA management from entering into an agreement with the Turkish Airlines owing to which the national flag carrier, according to them, would face severe financial hardships.
Speaking at a press conference, they said that if the ministry did not stop the management, the staffers would move the superior courts in an attempt to protect the national asset.
They announced that PIA employees would wear black armbands in duty hours to lodge their protest against the management for taking such disastrous decisions.
They said that the PIA had direct flights to Europe owing to which despite its inefficient marketing it got passengers but the passengers might not travel through it if they would have to change planes at Istanbul.
Pakistan Airline Pilots Association chief Sohail Baluch, Society of Aeronautical Engineers Pakistan president Shaukat Jamshed, Flight Engineers National Association chief Najeeb-ur-Rehman, Aircraft Technologists Association chief Aziz Suharwardy, PIA Senior Staff Association chief Abid Saleem and Kamran Chaudhry of the People`s Unity were present at the press conference.

PIA issues order for pilots' demands implementation

KARACHI - The PIA management has released its admin order on 7th of May regarding the agreement signed by the PIA and PALPA, said PIA MD Ijaz Haroon while talking to The Nation.
It is pertinent to mention here that there has been a dispute between PIA management and PALPA as pilots blamed that the management is not taking any interest in implementing the agreement. The agreement is the basis on which PALPA has postponed protest and provided extra cooperation to PIA.
A source from PALPA has said that it was decided in the meeting that PIA would release the admin order on 30 April, regarding implementation of the agreement. The Ministry of Defense who was mediator and guarantor between the two parties and promised that PIA will implement the agreement guaranteed it.
Haroon added that pilot association is asking for the increase in their salaries at the time when the financial condition of PIA not allowing airliner to bear this additional burden.
“The airline is suffering Rs 40 million per day; under these circumstances it is very unjust to demand increment in the salaries,” said Haroon.
Haroon mentioned that the doors are always open for the negotiations with them. PIA and PALPA have met and during that meeting, it was clearly mentioned that just demands of PALPA would be considered. The raise in salary will only occur if the airline gets pace in its profitability, so PALPA should show some consideration.
Haroon mentioned that the pilots are demanding Rs 2 lakh increment per month in their salaries. On the other hand, during last few days PALPA has shown agitation as one week has passed and nothing has been done so far. MD camp office is using delaying tactics as far as the fulfilment of the agreement between PIA and PALPA is concerned. PALPA is planning to stop the extra cooperation and extra flights. PIA management has never mentioned that it is against the implementation of the agreement. PALPA source said that they had informed the guarantor of the agreement, Ministry of Defense about the present situation.
