Employment Law Compliance Plan

...Memorandum To: Marylee Luther CC: Traci Goldeman From: Tania Stevens Date: [ 9/15/2014 ] Re: Employment Law Compliance Plan Per your request, Atwood and Allen Consulting has developed an employment law compliance plan to assist you with the expansion of Clapton Commercial Construction. There are employment laws that you should be made aware of in order to get a human resource (HR) department ready for expansion to the state of Arizona. This memo will identify federal and state labor laws that address the minimum wage, required job postings, occupational safety and health, immigration reform and legal workers as well as possible consequences of noncompliance and recommendations on how to be compliant as they pertain to Clapton Commercial Construction. State of Arizona Minimum Wage Act Effective January 1, 2014, Arizona’s minimum wage became $7.90 per hour and every employer covered under the Act is now required to pay each employee’s wages no less than this amount (Arizona's Official Web Site, 1987). According to the U.S. Department of Labor, the federal minimum wage is currently $7.25 (n.d.). Regardless of the $.65 difference in the hourly rate, you must ensure that every employee is paid $7.90 for each hour of work. As the State of Arizona's Official Web Site (1987) states, "an employer who fails to pay the minimum wage is required to pay the employee the wages owed with interest and an additional amount equal to twice the underpaid wages. An employer who retaliates...

During the American period, the first English translation, An Eagle Flight, based on the first French translation in 1899, was published in 1900. The second English translation, entitled Friars and Filipinos, appeared in 1902, and it was made by Frank Ernest Gannett, then secretary to Jacob Schurman, chair of the First Philippine Commission. Politics intruded in the translations; the omissions and additions recreated a novel suited to the American reader who wanted to gain information about the new colony. only after the institution of the public school system were Filipinos expected to read the novel in its English translation. Language and Identity

...ENGLISH ONLY COURT CASES INVOLVING THE U.S. WORKPLACE: THE MYTHS OF LANGUAGE USE AND THE HOMOGENIZATION OF BILINGUAL WORKERS’ IDENTITIES KARI GIBSON University of Hawai‘i Title VII of the 1964 Civil Rights Act protects against discrimination in employment on the basis of race, color, sex, religion and national origin. However when the judicial system has examined English only workplace policies in light of Title VII, it has generally determined that such policies are not discriminatory if an employee is able to speak English. Although plaintiffs have argued that language is inextricably linked to national origin and cultural identity, the courts have stated that the use of a language other than English is detrimental to the morale of monolingual English speakers and a single language is necessary to ensure workplace harmony and proper management. This paper examines the court cases where English Only workplace policies have been challenged, and identifies the prevalent myths and ideologies held by businesses and the courts about language use, identity, and bilingual speakers. Through the process of homogeneism, linguistic diversity is rejected as monolingual English speakers are able to create and enforce rules that favor themselves as they construct the identity of “American” in their own image. Language is a central feature of human identity. When we hear someone speak, we immediately make guesses about gender, education level, age, profession, and place of origin....

Starbucks

...9-808-019 JUNE 6, 2008 NANCY F. KOEHN MARYA BESHAROV KATHERINE MILLER Starbucks Coffee Company in the 21st Century On the morning of March 19, 2008, 6,000 Starbucks shareholders gathered at McCaw Hall in Seattle for the coffee company’s annual meeting. The first in line appeared outside the building’s glass-fronted façade while it was still dark, and before long, the performance hall was packed.1 As the crowd streamed inside, one team of Starbucks employees handed out cups of hot coffee, while another wrote down shareholders’ comments about the company on stacks of white cards.2 From the early morning Seattle skyline to the crew of green-aproned workers, the annual ritual was steeped in Starbucks tradition. But for the iconic coffee company, this had been no ordinary year. Starbucks got its start as a Seattle-based coffee roaster in 1971. At this time, the larger coffee market was dominated by supermarket brands such as Folgers and Maxwell House, and per-capita coffee consumption in the U.S. was on the decline.3 During the next two decades, however, sellers of specialty, high-quality coffee beans began to attract a niche following.4 In 1987, entrepreneur Howard Schultz bought Starbucks with an eye toward introducing European-style coffee culture to the American market. Under Schultz’s aegis, Starbucks spread the gospel of high-quality, customized coffee drinks to urban areas around the country. The enthusiasm of Starbucks customers helped the company grow its revenues...

It really is getting harder to outpace the other guys. Since the mid1990s, competition in the U.S. economy has accelerated to unprecedented levels. The engine behind this hypercompetition: IT. Thanks to powerful tools like ERP and CRM, backed by cheap networks, companies are swiftly replicating business-process innovations throughout their organizations. The firm with the best processes (order fulfillment, field installation, job closing) wins, but not for long. Rivals are striking back with their own IT-based process innovations. To gain—and keep—a competitive edge in this environment, McAfee and Brynjolfsson recommend a three-step strategy: • Deploy a consistent technology platform, rather than stitching together a jumble of legacy systems. • Innovate better ways of working...
