1. The Food and Nutrition Service proposed this regulation. This agency helps to define eating standards for children throughout the U.S. school system. I’m concerned that a lot of children are obese and not eating properly. This produces health problems when they get older and help to increase health care costs. This will affect me by helping my premiums increase for health care costs. 2. The proposed change will help to improve the health of children in school by providing nutritious foods for them to consume throughout the course of a school day. 3. My comment is there has been a big increase in childhood obesity over the past decade. I see this proposed regulation as a positive step towards promoting healthier eating habits for children. Parents should follow in the footsteps of the school system in promoting a healthy diet for their children. This is only part of the solution towards decreasing childhood obesity. This will be an epidemic problem unless we all join forces to come to a solution. 4. The deadline for the public comment was April 9, 2013. 5. A. You will have three choices to choose from after the public comment period. You can adopt the rules. Second, modify the proposed rules and do the public comment again. Third, you can withdraw the rule.
B. The first theory is arbitrary and capricious. This theory is applied to informal rulemaking and simply requires the agency to support the proposed rule. The second theory is the regulation is unsupported by substantial evidence. This test is applied in the review of formal and hybrid rulemaking. This requires there is more convincing evidence than not in the case. The third theory involves the rule that a regulation can be set aside if the agency did not comply with the APA requirements of notice, publication, and public comment or input.
