The law dictionary online defines “settlement” as a resolution of a lawsuit or a legal dispute without a final court decision. “Settlement payment,” in this essay, also refers to payments to governments because of fines or penalty. Usually, settlement achieves through negotiations among different parties through attorneys. When agreements are reached, “settlement payments” occur. Hence, people consider settlement payments as prices that one party pay to the others for their wrongful behaviors or violation of laws. For tax purposes, are settlement payments deductible? According to Internal Revenue Code (IRC) Section 162(a), any ordinary and necessary business or trading expenses are deductible during the current taxable year. That is to say if any settlement payments meet criterions of deduction under 162(a), but not in the exception of Section 162, should be deductible. In real court cases, IRS uses the exceptions of Section 162 to disallow settlement payments. Nowadays, more court cases and arguments appear to show that even though some settlement payments are in the exceptions of 162 (a), they can also be deducted. ...offers us an insight into his own writing, and the philosophies that inform it. “They aren’t like most other comedians’ jokes these days,” Vonnegut writes, aren’t rooted in show business and the world of celebrities and news of the day. They feature Americans who are almost always fourth-rate or below, engaged in enterprises which, if not contemptible, are at least insane. And while other comedians show us persons tormented by bad luck and enemies and so on, Bob and Ray’s characters threaten to wreck themselves and their surroundings with their own stupidity. There is a refreshing and beautiful innocence in Bob’s and Ray’s humor. Man is not evil, they seem to say. He is simply too hilariously stupid to survive. And this I believe. Jerome Klinkowitz, in the introduction to his essay collection entitled Vonnegut in America, has used this quote—as he certainly should—to support his claim that Vonnegut’s humor has its roots in the comedic response to the Great Depression. But of course there is much more to it than that. The reader is left with a nagging question: Were humanity’s case really as Vonnegut describes it, and were this truly his belief, wouldn’t it seem that the only appropriate response would be for Vonnegut to sit and laugh quietly at the antics of the doomed race? He is completing a dissertation entitled “Revision, Reunion, and the American Civil War Text.” N THE FIRST SENTENCE OF HER ART OF SHAKESPEARE’S SONNETS, Helen Vendler tells a little white lie: “I have reprinted both the 1609 quarto Sonnets and a modernized version of my own” (xiii). e crux of this declaration is “reprinted.” Vendler does indeed print a version of the 1609 quarto—or “Q,” as it is referred to bibliographically; one could even say that she “reprints” the type of the quarto. Vendler does not, however, “reprint” the 1609 quarto Sonnets. Like nearly every modern editor before her, Vendler presents the poems as discrete units on a page, eliding and ignoring the page breaks that so o en—and, I will argue, so meaningfully—interrupt the poems. ...RECALL AND PERSUASION Does Creative Advertising Matter? Brian D. Till and Daniel W. Baack ABSTRACT: Creativity is an important component of advertising. This research examines the potential effectiveness of creative advertising in enhancing recall, brand attitude, and purchase intent. Our basic methodology compares a set of randomly selected award-winning commercials (Communication Arts) with a random sample of control commercials. The commercials were embedded in television programs and subjects for a naturalistic viewing experience. Studies 1 and 2 had aided and unaided brand and execution recall as dependent variables. For Study 3, brand attitude and purchase intent were the dependent variables of interest. Results indicated that creative commercials facilitate unaided recall, but that creativity did not enhance aided recall, purchase intent, or brand and advertisement attitude. The basic advantage of creative advertising in enhancing unaided recall was found to persist over a one-week delay. Creativity is arguably a very important component of advertising. Advertising agencies pride themselves on industry awards, which are often focused more on the creativity of the advertising than brand performance. Past research on the topic has ranged from focusing on formulaic scales of creativity (e.g., Barron 1988; Kneller 1965; White and Smith 2001) to discussing creative strategy in holistic terms (e.g..
