At 4:30 AM on Friday September 4th, 1999 Michelle Davis of Fleming NY set fire to her house while her 13 year old Autistic son, Daniel was sleeping upstairs. The fire took place at 6012 West Lake Road and while Daniel Leubner was asleep in his second floor bedroom, the mother and one of the daughters were sitting on the front porch. According to police the smoke detector went off on the second floor but not on the first. Firefighters from many different departments responded to the fire and it took them about 30 minutes to bring the flames under control, but when the firefighters arrived to the house it was already a big fire and the house was destroyed. Unfortunately Daniel was pronounced dead on the scene. The next morning The State Office of Fire Prevention and Control was called to investigate the scene, and they concluded that most of the damage that was done by the fire was to the front of the house. Daniels room was located in the back of the house and was barely touched by the fire, even though the fire didn’t do damage to his room there was still a lot of smoke and heat and it was ruled that Daniels death was caused by smoke inhalation. According to friends, family and faculty from East Middle School Daniel was a good student and worked very well with the other kids in school and got along with everyone. The fire started just days before he was going to start his final year at the school. The police department has been to the Davis house several times in the past responding to help behavioral problems linked to Daniels autism. There wasn’t only one victim from this there was three, Daniel was the real victim in the case but his two younger sisters are also victims. They suffer because of their mothers actions. The sheriff department believes that she intentionally set her house on fire knowing her son was in his room. She told police that she
