PUTRAJAYA 21 Julai - Mahkamah Rayuan hari ini membenarkan rayuan bekas atlet pecut, Nor Azleen Mohammad Mustafa yang menyaman seorang pakar ortopedik dan Pusat Perubatan Universiti Malaya (PPUM) yang didakwa cuai ketika melakukan pembedahan membetulkan tulang belakangnya pada tahun 2005.
Panel tiga hakim diketuai oleh Datuk Mohd. Hishamudin Mohd. Yunus yang bersidang bersama Datuk Balia Yusof Wahi dan Datuk Mohd. Zawawi Salleh turut memerintahkan kedua-dua responden membayar kos RM30,000.
Kuorum berkenaan memerintahkan taksiran ganti rugi dilakukan di hadapan Pendaftar Mahkamah Tinggi Pulau Pinang. Tarikhnya telah ditetapkan pada 11 Ogos depan.
Panel tersebut sebulat suara mengetepikan keputusan Mahkamah Tinggi pada 9 November 2012 yang menolak tuntutan saman RM3 juta terhadap Pakar Perubatan Jabatan Ortopedik, Fakulti Perubatan Universiti Malaya, Dr. Omar Md. Isa dan PPUM.
Nor Azleen, 23, merupakan bekas atlet pecut Pulau Pinang dan pernah menyertai acara 100m, 200m dan 4x100m dalam Kejohanan Sukan Malaysia (Sukma) 2004 dan 2006 serta merupakan atlet pelapis remaja kebangsaan yang menyertai banyak kejohanan olahraga terbuka sebelum menjalani pembedahan.
Hakim Mohd. Hishamudin dalam keputusan itu berpuas hati bahawa pakar tersebut selaku defendan pertama telah dibuktikan melakukan kecuaian ketika menjalankan pembedahan tersebut.
Panel itu turut berpendapat, PPUM selaku defendan kedua bertanggungjawab memikul liabiliti yang diwakilkan kepadanya (vicarious liability).
Noor Azleen ditemani keluarganya hadir ke mahkamah bagi mendengar rayuan tersebut. Dia diwakili oleh peguam N. Ahilan manakala PPUM diwakili oleh G.K. Ganesan dan N. Sharmini.
Bekas atlet itu menghadapi komplikasi saraf tunjang akibat luka terkena alat yang digunakan ketika pembedahan menyebabkannya lumpuh dari pinggang ke bawah dan terpaksa menjalani fisioterapi dalam tempoh yang lama.

Berikutan insiden itu, Nor Azleen terpaksa memakai alat sokongan sehingga tulang belakangnya menjadi keras selain tidak boleh terlibat dengan sebarang acara sukan.
Sementara itu, Ahilan memberitahu pemberita, Nor Azleen sehingga kini masih belum dapat berjalan dengan baik kerana kedua-dua kakinya tidak kuat selain sukar mengawal sistem pembuangan air kecil dan besar akibat luka pada saraf tunjang.
Nor Azleen dalam tuntutan samannya memohon defendan membayar ganti rugi am sebanyak RM3 juta, faedah, kos dan relif-relif selanjutnya yang dianggap sesuai oleh mahkamah.
Gadis tersebut lahir dalam keluarga yang berbakat dalam sukan kerana bapanya, Mohammad Mustafa Nagoor Gani, 55, merupakan bekas jurulatih bola sepak Pulau Pinang manakala dua adik beradiknya merupakan bekas pemain hoki dan bola sepak negeri.

PUTRAJAYA 22 Julai – Mahkamah Rayuan hari ini membenarkan rayuan bekas atlet pecut, Nor Azleen Mohammad Mustafa yang menyaman seorang pakar ortopedik dan Pusat Perubatan Universiti Malaya (PPUM) yang didakwa cuai ketika melakukan pembedahan membetulkan tulang belakangnya pada tahun 2005.

Panel tiga hakim diketuai oleh Datuk Mohd. Hishamudin Mohd. Yunus yang bersidang bersama Datuk Balia Yusof Wahi dan Datuk Mohd. Zawawi Salleh turut memerintahkan kedua-dua responden membayar kos RM30,000.
Kuorum berkenaan memerintahkan taksiran ganti rugi dilakukan di hadapan Pendaftar Mahkamah Tinggi Pulau Pinang. Tarikhnya telah ditetapkan pada 11 Ogos depan.

GEORGE TOWN - Bekas atlet pecut, Nor Azleen Mohammad Mustafa gagal dalam permohonan saman terhadap Pakar Perubatan Jabatan Ortopedik, Fakulti Perubatan Universiti Malaya, Dr. Omar Md. Isa dan Pusat Perubatan Universiti Malaya (PPUM) yang didakwa cuai ketika melakukan pembedahan membetulkan tulang belakangnya pada 3 September 2005.

Hakim Mahkamah Tinggi Nurmala Salim menolak tuntutan saman berjumlah RM3 juta itu dengan kos RM5,000.Dalam penghakimannya, Nurmala berkata, plaintif gagal membuktikan Omar sebagai defendan pertama telah melakukan kecuaian ketika menjalankan pembedahan itu.

"Walaupun dalam surat keizinan yang ditandatangani oleh waris plaintif tidak dinyatakan risiko akibat pembedahan, tetapi secara munasabah perbincangan telah dilakukan sebelum waris menandatangani surat keizinan," kata beliau.

Nor Azleen, 21, yang diwakili peguam bela N. Ahilan menghadapi komplikasi saraf tunjang akibat luka terkena alat yang digunakan untuk pembedahan itu, menyebabkan atlet itu lumpuh dari pinggang ke bawah dan terpaksa menjalani fisioterapi dalam tempoh yang lama.

Nor Azleen sehingga kini masih belum dapat berjalan dengan baik kerana kedua-dua kakinya tidak kuat.Dia juga menghadapi masalah untuk mengawal sistem pembuangan air kecil dan besar akibat daripada luka yang dialami pada saraf tunjangnya.

Berikutan insiden itu, Nor Azleen juga terpaksa memakai alat menyokong sehingga tulang belakangnya menjadi keras dan tidak boleh terlibat dengan sebarang acara sukan.

Nor Azleen dalam tuntutan samannya memohon defendan membayar ganti rugi am sebanyak RM3 juta, faedah, kos dan relif-relif selanjutnya yang dianggap sesuai oleh mahkamah.

Sementara itu, di luar mahkamah, Ahilan memberitahu bahawa pihaknya akan memfail rayuan kes itu di Mahkamah Rayuan dalam tempoh terdekat.Omar dan PPUM sebagai defendan kedua diwakili oleh peguam bela Sharmini Navaratnam daripada tetuan Siva Dharma & Associates.

Nor Azleen merupakan bekas atlet pecut Pulau Pinang dan pernah menyertai acara 100m, 200m dan 4x100m dalam Kejohanan Sukan Malaysia (Sukma) 2004 dan 2006.
Dia juga merupakan atlet pelapis remaja kebangsaan dan menyertai banyak kejohanan olahraga terbuka sebelum menjalani pembedahan.

Bapanya, Mohammad Mustafa Nagoor Gani, 53, merupakan bekas jurulatih bola sepak Pulau Pinang.Dua lagi anak lelakinya juga aktif dalam sukan dan merupakan bekas pemain hoki dan bola sepak Pulau Pinang.
