...The following essay deals with a hypothetical case in contract law, more specifically an offer and its acceptance. Its main purpose is to discuss and apply the principles in law, relevant to the topic, as well as advice the parties on their position and legal obligations. In the following case, the offer is being made by an advertisement in a local newspaper. The law states that advertisements in general are merely an invitation to treat and not an offer, the precedent being the Partridge v Crittenden case. An invitation to treat is an action, inviting the other parties to make an offer in order for a contract to be made. It treat cannot be accepted and therefore cannot directly be converted into a contract. The reasons for the decision advertisements to be considered to be invitations to treat are various – from allowing sellers to refuse to sell a wrongly labeled item, to protecting them from legal obligation resulting from a breach of contract when they fail to accommodate all needs due to a shortage in stock or failure in the supply chain. In certain situations, though, an advert can be elevated into an offer. In order for that to happen, the wording must be unambiguous and explicit, leaving no room for negotiation. This concept was first illustrated in the Lefkowitz v Great Minneapolis Surplus Store case. Even though it wasn’t an English case, it can still serve as an example in cases with similar circumstances due to the similarities in the legal systems of the UK and...

...Hume on Custom and Habit In Hume’s Enquiry Concerning Human Understanding, he claims that it is not reason, but experience which guides and is the basis for most of our beliefs, or matters of fact. What the cause is for this, is the question he ultimately tackles in order to gain an understanding of the human nature of the connection of experience and existence. When discussing how our mind forms connections between various thought, he states that “method and regularity” act to enforce a regular chain of ideas that also serve to relate to memory and imagination (p.14). When this regular chain is broken in upon by some irregular thought, it is quickly noticed. From this, he gathers that because of the regularity that occurs in the thought process, a universal principle exists to bring together ideas in such a comprehensible fashion. These principles of association, as he calls them, are Resemblance, Contiguity, and Cause and Effect. To prove that these three principles hold to connect all possible forms of ideas, he suggests that if all situations are rendered to as general a form as possible, principles of association will apply alone or in some combination in all cases. For our purposes, cause and effect is the most relevant principle which may cast light on Hume’s statement that “Custom, then, is the great guide of human life. It is that principle alone, which renders our experience useful to us,” (p.29). Before entertaining the suggestion that customs are in fact an important...

...Foreign Market Entry Modes Expansion into foreign markets can be achieved via the following mechanisms: Exporting is the process of selling of goods and services produced in one country to other countries. There are two types of exporting: direct and indirect. Direct exports Direct exports represent the most basic mode of exporting made by a (holding) company, capitalizing on economies of scale in production concentrated in the home country and affording better control over distribution. Direct export works the best if the volumes are small. Large volumes of export may trigger protectionism. Types Sales representatives Sales representatives represent foreign suppliers/manufacturers in their local markets for an established commission on sales. ...CUREE summary of Jerome Bruner’s work in relation to the curriculum for the 21st Century Curriculum: Building the Evidence Base project. How can ideas from the past about the curriculum help us make effective changes today? How can ideas from the past about the curriculum help us make effective changes today? Sometimes, when we encounter a change in teaching, such as a change of policy or a new strategy from CPD, we may be tempted to think we are simply returning full circle to ways we used to do things. But the experiences gained in the intervening years are a valuable part of the process of change. Working from a new starting point helps us to move earlier thinking further along. This is not just a case of recycling. Revisiting the ideas Jerome Bruner put forward about the curriculum nearly half a century ago demonstrates this well. They take on a new meaning when we consider them alongside recent developments such as assessment for learning and thinking skills. What did Bruner propose? Bruner argued that curriculum planning should work in a spiral Bruner believed that the curriculum should continually revisit basic ideas, building upon them incrementally and making links and connections between them until the pupil has grasped full understanding – a spiral curriculum that links ideas and thinking skills incrementally over time. Where should we start? Bruner proposed that the starting point of learning should be what learners know, believe and can...
