Cassie is a senior at Jefferson High School right before the turning of the new millennium. The story takes place not far from a very poor inner city. Cassie has found that after many years of wanting to become a mathematics teacher, she is now questioning her dream. The reason Cassie has become uncertain of her goal is from an encounter she had with her mathematics teacher, Mr. Tempe. Cassie was unable to understand how to solve a calculus problem which Mr. Tempe tried twice to explain to her. After the second attempt, he informed her that she might want to reconsider becoming a math teacher: “There are not many minorities in this field and you are also female and African American” (Taylor and Whittaker, 210). There are several issues arising from this case, primarily the perception that the people in the case impose upon the female, African American minority. This perception is that black women are not equal in capability and intelligence and therefore unlikely to be successful in the fields of mathematics and science. He could have given a time frame of 30 minutes so that Mr. McCall would not have time to consult Dr. Williams before making an ethical decision. There would be no difference if the medication that was being requested were for control of high blood pressure that the patient critically needs on a daily basis. Any type of medication request would need to be authorized by the doctor first. This essay will first discuss the facts of the case, followed by the technical requirements and perceived difficulties related to expert evidence identified by the court in this case. Facts Mr Hawchar, the respondent claimed damages from his employer, Dasreef Pty Ltd, the appellant as he was diagnosed with silicosis allegedly caused by the unsafe working environment. An expert, Dr Basden was retained to provide a report centering on the foreseeability of the alleged injury claimed by Mr Hawchar and procedures that Dasreef could take in reducing the risk of injury. The case originated in the Dust Diseases Tribunal where the judge relied on the estimate of the expert evidence in calculating the levels of silica Mr Hawchar was exposed to. This led to a finding that the level of exposure exceeded the applicable standard and was appealed by Dasreef before the Court of Appeal as to the admissibility of the expert’s report. The Court of Appeal dismissed the appeal on the basis that the estimate provided in the report was drawn from the expert’s experience, and thus admissible.
