...Alumina and BP Introduction Running a business does not come without the existence of liability risk and legal issues. The question posed is what are the liability risks that could lead to legal issues and how will such issues be handled. When legal issues are present in the business sector due to liability issues, more likely than not, others are affected both directly and indirectly by the situation. How the situations are resolved depends upon those involved and the complaint. BP and Alumina have faced such issues and, as discussed below, have had to resolve the issues present within their companies through legal processes. Legal Issues and Principles Present BP The impact of the BP oil spill of 2011 will be felt by residents of Louisiana, Mississippi, Alabama, Florida, and Texas for years to come. The effects of this devastating incident in the Gulf of Mexico disrupted the way of life for many individuals in that region. The Deepwater Horizon drilling rig exploded dumping an estimated total of five million barrels of oil into the Gulf this was the worst oil spill in history (Goguen, 2012). The legal issues that arise from this tragedy consist of economic loss, environmental damages, property damage, emotional distress, and exposure to harmful substances. According to Goguen (2012), “Thousands of businesses and workers in the Gulf region have filed lawsuits against BP, seeking repayment for profits and income that were lost because of the oil spill. These plaintiffs...

...Open Economy Macroeconomics: The IS-LM-BP Model When we open the economy to international transactions we have to take into account the effects of trade in goods and services (i.e. items in the current account) as well as trade in assets (i.e. items in the capital account). Opening the economy to international trade in goods and services means that we have to take into account the increased demand for our goods by foreigners (our exports), as well as the decreased demand for our goods that occurs because we purchase foreign goods (i.e. our imports). Total expenditures in an open economy are C + I + G + NX, where NX -- net exports -- is equal to the level of exports (X) less the level of imports (V). Thus, our exports (X) represent spending by foreigners on domestic goods so they increase the level of domestic output. Imports (V), on the other hand, represent spending by domestic residents on foreign goods, so they decrease the level of (domestic) production. To analyze the effect of exports and imports on the equilibrium level of output, it is important to understand the various factors which determine the levels of exports and imports. Exports represent foreign demand for our goods and services. Foreign purchases of goods and services depend, among other things, on foreign income levels (just as our purchases of goods and services depend on our income levels). We assume that foreign income levels are constant, thus, foreigners demand a constant amount of our goods. Whether foreigners...

...BP was forced to defend its environmental policy yesterday after it admitted its own production of greenhouse gases increased last year. The world's second biggest quoted oil producer, and Britain's biggest company, produced more than 85m tonnes of greenhouse gases in 2004 up from 83.4m tonnes in the previous year, according to the company's green report published yesterday. Its output was roughly twice that of Argentina. The report also showed a dramatic increase in the number of staff sacked for unethical behaviour and a 50% jump in the amount of oil BP spilled, to 5.7m litres. BP said taking into account a number of disposals its greenhouse gas emissions decreased slightly to 81.7m tonnes, but the figure has been largely unchanged for the past four years. Lord Browne, the chief executive, denied that the company's attempts to cut greenhouse gases had stalled. "We are not struggling, we are absolutely on track," he said. BP's emissions are lower than those of industry bête noire ExxonMobil, the American oil company that opposes the Kyoto treaty on climate change and last year caused uproar by revealing a 2% increase in emissions to 135.6m tonnes. Although BP is more willing than most of its rivals to talk about climate change, its seeming inability to reduce its own levels of greenhouse gases has worried environmental campaigners. "I would question whether the extent to which BP has reduced its emissions represents their actual ability to do it,"...

...million gallons of crude oil to spill into the waters of the Gulf of Mexico” ("NRDC.org", 2011, p. 4), killing 11 people, and creating what could be the largest ecological disaster of the 21st century. This disaster is considered by many to be the largest oil spill ever to occur. Clean up efforts are still ongoing after almost two years. British Petroleum (BP) has spent billions of dollars in cleanup cost, restitution and community development; however the greater effects on the environment will not be determined for many years to come. The direct cause of this disaster has been identified as mechanical failure of a blowout preventer located at the base of the well directly above the site entry on the bottom of the sea floor. When this mechanical valve failed, it cause as large plum of highly flammable gas to erupt from the oil well and ignite. After an explosion on the surface, fire raged out of control for over 36 hours. After three days, the floating oil rig sank to the bottom of the ocean floor some 5000 ft below the surface. Oil continued to flow from the well site until it was contained on July 15th, 2010(British Petroleum [BP], n.d., para. 3). This accident remains under investigation...

...Effects of the BP Oil Spill The rest of the world has long forgotten the disaster that tore through the states along the Gulf of Mexico. Its lingering effects can still be felt three years later. The Deepwater Horizon oil spill in 2010, otherwise known as the BP oil spill, has left the states of Florida, Alabama, Mississippi, and Louisiana in recovery mode. The oil spill not only affected the ecology of these states, but also the economy. This tragic disaster claimed the lives of eleven men. It also disrupted the way of life for the numerous people employed by the seafood industry, and its consumers. The shrimping industry located in these states in the year 2006 accounted for “83% of the total US shrimp landings”, according to John Tunnell (2011). Based on the results of the survey I conducted in Biloxi, MS, along with research I have done, I have found that locally both consumers and businesses are more willing to support the local shrimp industry than they are to purchase imported shrimp. However, on a global scale consumers are still wary of eating shrimp caught anywhere on or near the Gulf Coast. The people residing on the Gulf Coast of the United States of America are a resilient group. They have endured three consecutive extraordinary catastrophes: Hurricane Katrina, the BP Oil Spill, and the Mississippi River Floods, and still somehow have continued to strive and continue their way of life. However, the shrimp industry took a huge hit after the BP Oil spill. According...

However, studies investigating the health effects of parabens are conflicting. There are no restrictions on the use of parabens in cosmetics in Canada, whereas International regulations are stronger. The European Union restricts the concentration of parabens in cosmetics. Parabens are typically used at levels between 0.01% and 0.3% and have been deemed safe in cosmetics at levels as high as 25%, the FDA official stance is that currently there’s no reason for consumers to be worried about using cosmetics that contain parabens. However, the FDA continues to evaluate the chemicals. The National Institute of Environmental Health Sciences has recommended butyl paraben (BP) for...

...About Anaphylaxis Anaphylaxis can be defined as a life threatening and sometimes fatal allergic reaction. It is an allergic reaction that involves several organ systems simultaneously. When you are experiencing this severe reaction, symptoms will manifest in the lungs, skin, throat, nose, or gastrointestinal tract. This type of allergic episode is sometimes called anaphylactic shock, although you may experience this severe allergic event without going into shock, and this would entail a precipitous drop in blood pressure. Anaphylaxis usually occurs after an individual has been initially exposed to an allergen. After that first exposure, the person becomes highly sensitized to that particular allergen. When they are exposed once again, a dangerous allergic reaction will occur and this usually happens within minutes. There are numerous allergens that may cause a person to experience anaphylaxis. These can include: insect bites, drugs such as vaccinations, foods like peanuts or shellfish, or chemicals like latex. Note that peanuts and tree nuts alone are responsible for about 80 percent of all fatal reactions. In some cases, physical exertion has shown to be a contributing factor in this condition. Symptoms There are many different symptoms that one can exhibit during an experiencing anaphylactic episode. Some of these would include: difficulty breathing, dizziness, coughing, hives, stomach pain, cramping, anxiety, confusion, diarrhea, nausea, vomiting, wheezing, a blocked...

...for: Principal Reilly Meen Prepared by: Ms. Definisha Lee Noset Student(s) Involved: Thomas Brooker December 2, 2012 7:29 PM Incident Summary When Tom arrived at my class this morning, already 20 minutes late, he found another student sitting in his usual desk. He stood next to the desk as I lectured. Looking at the student he said, “Ayoo, get up on out of my seat before I smack you.” Terrified and genuinely scared for his life, the student gathered his belongings and relocated to the back of the classroom. Tom took his newly vacated seat. I asked him why he did that. “It’s my seat, and I ain’t gon’ let no snitches snatch my seat, namean?” In the best interest of the rest of my students, I decided to avoid conflict and continue with the rest of my planned class activities. After I finished my lecture, I asked all my students to pass forward their completed homework assigned last night. Everyone had their homework, except Tom. Tom was trying to explain to his surrounding pupils about his new “bong,” which I can only assume is some instrument used for the burning and inhaling of marijuana, something Tom seems to frequent. He was also telling them about the “BP” game he played last night with his “homies.” I guess this explains why he didn’t have his homework. I walked up to him. “Tom, you’re the only student who didn’t turn in his homework, you came in late, and threatened a fellow student. What’s the deal?” I asked. “Ms. Noset, why you always gotta single me out...

...holding Class AD subclass 127 permanent visa, which was to expire on 17 April 2013. On March 27 2013, he applied for Class BB subclass 155 resident return visa which was granted and visa continues. Ms. To, his spouse, became an Australian citizen on 13 June 2013 and Mr. Han applied for Visa on 11 September 2013. For the past 4 years before lodging his visa application, he was in Australian for 458 days and one year before application, he was in the country for only 58 days. His application was however, refused by delegate of the Minister on 20 November 2013 and he applied to AAT for review of this decision. The delegate ruled that he satisfied resident requirement as outlined in s 21(2)(c) of the Act. The Minister was not happy with the AAT decision and an appeal was lodged which was consequentially dismissed. Reasons The main legal issues in this case was to determine whether, under the provisions of s29, one could apply for citizenship when the spouse was a citizen of Australian during the time of application or during the entire 4 years as outlined in s22(1)(a) and 12 months prior to the application date as required in s22(a)(c). The minister argued that the correct interpretation of the legal text is that Mr. Han could only qualify for citizenship if his spouse, Ms. To, was a citizen for the entire period of 4 years and 12 months before application as required by the act. However, Mr. Han disagreed with this interpretation arguing that the correct interpretation...

...BP (British Petroleum) is 1 of the biggest energy companies in the world, there are almost 100000 employees in this company. BP offers to its consumers petrochemical products for daily use items, energy for light and heat, fuel for transports with retail services. From 1966 Lord Browne was the CEO of the company for many years. He focused on two areas : one is green energy and second is knowledge management. In my research I focused on BP when Lord Bowne was CEO. BP was first adopter of Knowledge Management, a scheme that collects all data gathered across an organization. Using this structure engineers and managers at every level have admission to, and may learn from, experiences of each other. Knowledge Management (KM) is the method in which a corporate like BP can take the knowledge of its experts and employees across the world and carry it all together to form a competitive advantage and best practice. BP began using of KM principles in the mid-1990s when Lord Browne was CEO (under his leadership) and has sustained until now with the implementation and development of KM Guidelines for Production and Exploration. "The simple minimum for Knowledge Management is to make KM strategy a actuality: to confirm that people are out there relating the best knowledge which BP has, in a constant manner all over the world," says Houston- BP consultant Wendy C Valot. "Knowledge Management holds all disciplines connected to E&P, from engineering to drilling to task management...

...Ethics Case Analysis BP BP Struggles to Resolve Sustainability Disaster Case Summary: The BP oil spill in the Gulf of Mexico in April 2010 is the worst oil spill in US history. Initial claims on the scope of the spill, as released by BP, was that 5,000 barrels per day were being released into the water, although they stated they had no way of precisely measuring the spill. Outside analysts have stated that between 54,000 and 84,000 barrels per day were leaking into the area. This estimate has been largely supported and accepted. The spill lasted for 87 days before workers finally sealed the leak, but by that time, more than 4 million barrels of oil had been released into the gulf. The BP oilrig, owned by Transocean, Deepwater Horizon had been in operation in the Gulf of Mexico since February 2001. The rig was valued at more than $560 million dollars and worked on many different wells in the gulf. The last well it operated on was the Macondo well. It was this well that the oil spill came from and was brought about by several preventable errors on the part of BP and Transocean management and employees. The Deepwater Horizon vessel was an exploratory rig assigned the duty of finding oil, reporting it, and capping the well for another extracting type rig to come in and harvest the oil. While drilling the well, the rig encountered pockets of natural gas buildups where it was drilling. A week prior to the fatal explosion, Horizon encountered one of these pockets and the natural...
