The other question is to determine if O&D Campground could be held accountable and liable for the incidents presented and sustained by one of their patrons.

FACTS

During her summer vacation, Shayla Smith, a 10 year old girl went camping with Mr. and Mrs. Tuttle to the O & D Campground. The premises are owned by Owen and Dolly Jones. According to Mary Smith, the mother of Shayla, her daughter went out swimming with the Tuttle’s daughter with neither one’s permission on the day on the incident. The two children arrived to pool area 30 minutes before the posted sign time which is 10:00 AM. While the two children were in the pool there was an absolutely lack of supervision as there was not any witnesses on the scene. Following this, Shayla dove in the shallow pool and broke her arm. Benham sustained injuries at the Dental Office of Mr. King were caused by sitting in one his chairs. After he sat, the chair collapsed causing him back, head and neck injuries. The issue was to determine if Mr. King warned him about the condition of the chair. In addition to this, was the incident preventable by any means? According to Iowa Code § 343 (West 2013). Owners of land have a duty to exercise reasonable care to determine the actual condition of the premises in order to prevent incidents like this one.
