I believe Oiler’s employee rights were violated, because the organization never consider Oiler’s twenty-years with the company as a loader and a driver of a fifty-foot truck with a trailer, delivering groceries to the company’s stores, impeccable and unblemished work record, his productivity, punctuality, and trustworthiness. Winn-Dixie never gave him the opportunity to correct such behavior, by offer him assistance and develop an action plan to correct his behavior. Most importantly find the reason as to why he chose to cross-dress and changed his persona during off-duty.

Winn-Dixie action raise the question of did they violated the Civil Rights Act of 1964 Title VII, which prohibits the discrimination based on sex? According to the American Civil Liberties Union of Florida, on October 23, 2000 the United States District court Eastern District Of Louisiana ruled that Winn-Dixie unlawfully discriminated against Oiler on the basis of sex in violation of the Title VII of the Civil Rights Act of 1964.

According to the employment non-discrimination Act employment discrimination against lesbian, gay, bisexual and transgender workers is pervasive and harmful. It violates core American values of fairness and equality by discriminating against qualified individuals based on characteristics unrelated to the job.

Over the years, Congress has responded when it found that people were not being hired or promoted for unfair or arbitrary reasons, such as race, gender, national origin, or disability. When Congress has found such discrimination, it passed laws to restore civil rights by ensuring arbitrary considerations do not determine access to employment. We believe such legislation continues to be an essential part of equal protection under the law.
