...The Non-Obvious Problem: How the Indeterminate Nonobviousness Standard Produces Excessive Patent Grants Gregory Mandel∗ The dominant current perception in patent law is that the core requirement of nonobviousness is applied too leniently, resulting in a proliferation of patents on trivial inventions that actually retard technological innovation in the long run. This Article reveals that the common wisdom is only half correct. The nonobviousness standard is not too low, but both too high and too low. It is indeterminate. Three principal factors produce nonobviousness indeterminacy: a failure to identify the quantum of innovation necessary to satisfy the standard, a failure to define the baseline level of ordinary skill against which to measure an innovation, and the epistemic infeasibility of requiring a technologically lay decision maker to judge from the perspective of a more highly trained and educated person of ordinary skill in the art. This Article introduces a mathematical model of innovation and patenting to analyze the effects of nonobviousness indeterminacy. Based on the model, indeterminacy in nonobviousness decisions has several unexpected consequences. First, indeterminacy results in an excessive total number of patent grants, and in many patent grants on obvious inventions. Second, indeterminacy leads to too many patent applications on obvious inventions and too few applications on non-obvious inventions. ∗ Professor of Law, Temple University — Beasley School of...

...Girl Power: Patriarchy in Sheep’s Clothing Welcome to Harvard Law School Graduation: a pert, slender blonde wearing bright pink lipstick and a mortarboard is giving the graduation address; her classmates leap up to applaud her as the camera focuses on her darkly handsome boyfriend. Beautiful! Fabulous! What, you wonder, is this girl’s story? Her story lies in the plot of the 2001 movie Legally Blonde, a pink and fluffy spectacular starring Reese Witherspoon. Reese plays Elle Woods, who decides to follow her ex-boyfriend to Harvard Law after their breakup. A fashion design major, Elle hits the books pretty hard to get decent scores on her LSATS, even missing parties – and then hires a professional to film her in a soft-core porn admissions video, focusing on Elle floating in a cool blue pool wearing a tiny pink bikini. Lo and behold, it wows the white, middle-aged male admissions board, and Elle goes on to take campus by storm. And there’s good reason Elle makes such a splash: she turns out to be he only beautiful girl at Harvard. All the rest of the girls there spend their time studying and doing nothing else; they are dull, boring, and above all, unpretty. These smart women do anything but have fun. Most of them blur into one bespectacled, intellectual image, but there’s one young woman among them who is even worse than dull – our token Feminist. She has dreadlocks and a defensive attitude, talks about nothing but political rallies and is, of course, a...

...A. The Erie Canal helped New York City establish its trade position and develop into the world's dominant commercial center. Some caution attributing New York's success and development to the construction of the canal, while others argue that it "played a most important role in the commercial development of the State of New York and probably more than any other influence contributed to the establishment of New York City as the chief port of entry of the United States. B. Western New York grew exponentially due to the canal, which "spurred economic diversification" and attracted new business and industry. Proximity to the canal reduced costs and manufacturing in the western part of the state increased by 262% between 1820 and 1840. As towns emerged along the Erie Canal, they brought business, agriculture and industry to the previously unsettled western New York region. Rochester, which had built its first frame house only five years before canal construction began, established itself as the Flour City and developed an industrial center. Buffalo, previously a small trading post, became a western boomtown, attracting a branch of the United States National Bank and becoming the final stop for individuals immigrating to the Old Northwest as a part of the Big Push. C. The Old Northwest had been cleared for settlement by the War of 1812 when American victory on the Great Lakes gave the nation control of an unparalleled system of waterways, commercial access to the west and...

...Grynbaum, Michael M. "Fighting Soda Rule, Industry Focuses on Personal Choice." The New York Times. The New York Times, 02 July 2012. Web. 21 Mar. 2013. 1. In the article, No Food Stamps for Sodas, it talks about the use of food stamps to buy unhealthy beverages. There have been proven studies showing that buying and consuming these sugary beverages causes diabetes. “Every year, tens of millions of federal dollars are spent on sweetened beverages in New York City through the food stamp program — far more than is spent on obesity prevention. This amounts to an enormous subsidy to the sweetened beverage industry.” (No Food Stamps for Sodas) Not only are the food stamps being spent on beverages but millions of dollars are being spent, not on healthy food, but on beverages that are causing health problems. “We are confident that this plan to reduce the consumption of sweetened beverages, if approved by the Department of Agriculture, would strengthen our efforts to combat a serious and worsening health crisis in New York City and could eventually help fight obesity in other communities across the state and nation.” (No Food Stamps for Sodas) By limiting the products that food stamps can buy allows the consumer to pick a healthier choice. Instead of picking soda, the consumer might just pick up a V-8. 2. Cocoa Cola is trying to prevent New York from banding the opportunity to use stamps to buy products such as soda. The article goes on to say how Lobbyist from Cocoa Cola...

... AND METAMORPHIC ROCKS Rocks are in order to make it easier on people to confirm them in the future. This can be done in a numerous ways. Each rock type has their own specific ways, but there are two different aspect that apply to all. The particular and composition. These two, before with some others help to classify igneous, sedimentary, and metamorphic rocks. The First Group is Igneous rocks are historical first by construction. This is broken down mainly into grain size. First there are intrusive, or plutonic igneous rocks. These types of rocks cool within the crust and form large, visible crystals. The opposite would be extrusive, or volcanic rocks. “These rocks are characterized as either extrusive or intrusive”. Types of Extrusive Rocks Basalt is normally a dense, dark, massive rocks, high in calcium and iron magnesium- bearing minerals and low in quartz content. Andesite is an extrusive rock intermediate in composition between rhyolite and basalt. Andesite lava is of moderate viscosity and forms thick lava flows and domes. Rhyolite is a felsic extrusive rock. Due to the high silica content, rhyolite lava is very viscous. It flows slowly, like tooth paste squeezed out of a tube, and tends to pile up and form lava domes. Intrusive igneous rocks are made from silica and plagioclase. They tend to be grays and browns in color. And then, felsic rocks are light in color and contains with some amphibole and biotitew. Granite is an igneous rock composed mostly of...

The abstract is typically a short summary of the contents of the document. Type the abstract of the document here. The abstract is typically a short summary of the contents of the document.] | I’ve lived in Connecticut my whole life and until now I was unaware of its geological history. Admiring the landscape of the state has always been one of my great pleasures. When I traveled around the country I would compare the natural wonders of each state to my own. Besides the rocky mountains in Colorado and the white mountains of New Hampshire few places match Connecticut’s regal terrain. Growing up in Bristol I would hike up to Pinnacle Mountain in Plainville, my friends and I would stand in awe of the magnificent rock structures. In the summer I would go on vacation to Old Lyme, it was there I fell in love with the earth’s most beautiful contrasts, the ocean meeting the rock and vice a versa. But until now I never educated myself on how all this magnificence came about. In this paper I will chronologically describe the eras and events that formed Connecticut’s geologic history. The oldest rocks provide a window through time telling a story of continental collisions so powerful that they raised mountains thousands of feet high. Others reveal evidence of a slow but constant attack from the elements that wore down those same majestic...

...History of Rocks As explained in Visualizing Geology, rocks are the words that tell the story of Earth’s long history and minerals are the letters that form the words. While this report will not be discussing minerals, it will introduce the history of rocks and how they are affected by plate tectonics. The focus of this report is on two of the three types of rocks, igneous and metamorphic rocks. Plate tectonics plays a key role in the life of these types of rocks. So let’s get started by first explaining igneous rocks. Next metamorphic rocks will be explained. Lastly, plate tectonics and the affect this theory has on both types of rock. Igneous rocks are rocks that form from magma that has been cooled and solidified. Igneous rocks have a structure that is made up of crystals. Igneous rocks are placed into to categories. As stated before, rocks are created by minerals. The process of a liquid forming into a solid is known as crystallization. The first category is extrusive or volcanic. These rocks are cooled on the top of the Earth’s surface. Extrusive rocks have microscopic crystals because it cools relatively quickly and the crystals do not have a chance to become as large as they could be. Extrusive rocks are formed by lava cooling. The second category is intrusive or plutonic. These rocks are cooled below the Earth’s surface. Intrusive rock is formed by the cooling of magma. Intrusive rocks have crystals that can be seen with the naked eye because the cooling process is relatively...
