An important consideration when speaking of whether or not something should be a human right is that it may have correlative duties imposed onto others. For something to be considered a human right, these duties should not be unreasonable to cost more than the human right might give. To begin, this paper will address one of the most important moral correlative duties that making PAS/D a human right would impose– that is, to have PAS/D as a human right there must be physicians available who believe in PAS/D and are willing to either remove the patients from their life prolonging treatments, or prescribe and/or administer the lethally dosed controlled substance to the patient that is suffering and wishes to end their life. It is important however, for these doctors to consider the times in which they are out of options to save a life, and prolonging it will only cause pain and suffering. When considering PAS/D as a human right and the correlative duties imposed onto others to have it as a human right, it is essential to ensure people would be willing to take part in these duties and that these duties would not be imposing unreasonable costs on the person. In one study, seventy-three percent of the physicians interviewed said that if PAS/D were legal they would be willing to refer the patient to someone who offers that service, or possible offer the lethal dose themselves. Out of the one-thousand-fifty-seven doctors interviewed, forty-sex percent of them indicated that in some cases, they themselves would be completely willing to prescribe the lethal dose of medication should the practice of PAS/D be made completely legal. At present, an Annual Confidential Report (ACR) that was introduced in the Pakistan period and retained with minor modification is used to measure performance. The prevailing gross inefficiency of the Bangladesh Civil Service gives the impression that this appraisal system is poorly functioning. This paper articulates the difficulties in designing a good appraisal system in the public sector and provides a theoretical framework arguing that the ‘goodness’ of a PA system should be seen in its capacity to meet its predetermined objectives instead of counting on the so called infallible psychometric properties. A certain degree of validity, reliability and perceived fairness are essential for an appraisal system to be efficacious. The paper then analyzes historical development of the current ACR of Bangladesh Civil Service and its components to measure its validity, reliability and perceived fairness. The paper found that though the current ACR holds some degree of fairness, it significantly lacks in validity as well as reliability, and therefore is deficient in meeting its stated objectives.
