Шалгалтын зорилго, хугацаа: Мэргэжлийн хяналтын ерөнхий газрын 2012 оны хяналт шалгалтын төлөвлөгөөний дагуу газрын даргын баталсан 2012 оны 04 дүгээр сарын 04-ны өдрийн 01/ 37 тоот хяналт шалгалт хийх тухай удирдамжийн хүрээнд Барилгын тухай хууль болон холбогдох хууль тогтоомж, дүрэм журмын хэрэгжилтийг 2012 оны 04 дүгээр сарын 13-ноос ажлын 4 хоногт багтаан хяналт шалгалт хийж, мэргэжил арга зүйн зөвлөмж зааварчлага өгч, илэрсэн зөрчлийг арилгуулахаар холбогдох шийдвэрүүд гаргаж хийсэн шалгалтын зорилго хангагдлаа. 2.Шалгалтын бүрэлдэхүүн:
Шалгалтыг Барилгын техникийн хяналтын улсын ахлах байцаагч Ж.Нэргүй, Л.Оюун, Л.Ганбаатар хийж гүйцэтгэлээ. 3.Шалгалтанд хамрагдсан объект, аж ахуйн нэгж байгууллага: Шалгалтанд нийт Нүүрс баяжуулах үйлдвэрийн модуль 1,2-ийн /46/, модуль 3, Уурхайн нэгдсэн бараа материал хадгалах агуулахын барилга, Уурхайн геологийн оффис, лаборатори, симуляторын барилга, Трансговь ХХК-ийн засварын төвийн барилга, уурхайн гадаргын ус зайлуулах байгууламжийн /1 дүгээр ээлж/ Баруун наран уурхайн оффис , цайны газар, лабораторийн барилга байгууламжууд болон захиалагч “Энержи ресурс” ХХК, гүйцэтгэгч, “Си Си Би Ай Монгол ХХК, “ОГОСЦ” ХХК, “Сайн констракш” ХХК, “Түмэн сант трейд” ХХК, “Санжат” ХХК, зураг төсөл зохиогч Эдшил ХХК, -нэгж байгууллага хамрагдсан болно.
4.Шалгалтанд хамрагдсан асуудлууд, хийж гүйцэтгэсэн ажлууд:
- 2011 онд МХЕГ-аас хийгдсэн шалгалтын үр дүнд гүйцэтгэлийн хяналт хийж “Барилгын тухай” хууль, тогтоомж, норм дүрмийн хэрэгжилт, барилга угсралтын ажлын явцын ил далд ажлын баталгаажилт, захиалагч, зохиогч, гүйцэтгэгчийн ажлын уялдаа холбоо, тэдгээрийн хоорондын гэрээний гүйцэтгэл, хариуцлагын тогтолцоонд үнэлэлт дүгнэлт, арга зүйн зөвлөгөө өглөө.
- Захиалагч “Энержи ресурс” ХХК-ийн хүсэлтийн дагуу ”Нүүрс баяжуулах үйлдвэрийн модуль 3-ийн барилгын угсралтын явцад хяналт шалгалт хийж 2012 оны 04 дүгээр сарын 13-ны 01/29/2012 тоот Барилга угсралтын ажил эхлэх үргэлжлүүлэх зөвшөөрөл олгов .
- Улсын комиссын хуралдаанд оролцож, нийт 4 барилга байгууламжийн угсралтын чанар байдал, баримт бичгийн баталгаажуулалтад үнэлэлт дүгнэлт өгч ажиллалаа.
5.Шалгуулагчийн ололттой, дэвшилттэй тал: 1.Барилга угсралтын ажлын явцын ил далд ажлын баталгаажилт, захиалагч, зохиогч, гүйцэтгэгчийн ажлын уялдаа холбоо, тэдгээрийн хоорондын гэрээний гүйцэтгэл, хариуцлагын тогтолцоо нь харьцангуй сайжирсан байна.
2.Шалгуулагч аж ахуйн нэгж байгууллагуудаас Засгийн газрын 311-р тогтоолоор батлагдсан “Аж ахуйн нэгж байгууллагын үйл ажиллагаанд дотоод хяналт шалгалтыг зохион байгуулах нийтлэг журам”-ын дагуу дотоод хяналтын бүтэц тогтолцоогоо албан ёсоор байгуулж , хэрэгжүүлж эхэлсэн байна.
2.“Энержи ресурс” ХХК-ийн захиалгаар баригдаж байгаа барилга байгууламжуудаас эрсдэл тодорхойлох “Хяналтын хуудас”-ыг ашиглан 3 барилга байгууламжийг хамруулж шалгахад “бага эрсдэлтэй” гэж тогтоогдсон болно.
6. Шалгалтаар илэрсэн зөрчил дутагдал, түүний шалтгаан нөхцөл
6.1. Барилгын техникийн хяналтын чиглэлээр:
“Энержи ресурс” ХХК-ийн захиалгаар баригдаж байгаа дээрхи барилга байгууламжийн техникийн баримт бичгийн иж бүрдэл, зураг төслийн боловсруулалт, барилгын угсралтын явц, чанар байдлыг хянан шалгахад: 1. Барилга угсралтын ажлын ил далд ажлын актыг захиалагч, гүйцэтгэгч, зохиогч нар холбогдох хяналтыг иж бүрэн хийж, гарын үсэг зурж баталгаажуулаагүй нь Барилгын тухай хуулийн 15.1.2 заалт “барилгын ажлын явц, чанарт хяналт тавих, фото зургаар баримтжуулсан ил далд ажлын акт, барилгын ажлын гүйцэтгэлийг баталгаажуулах”- ыг зөрчсөн. 2. ”Уурхайн нэгдсэн бараа материал хадгалах агуулах”, “Уурхайн геологийн оффис, лаборатори, симуляторын барилга” байгууламжийг улсын комиссоор хүлээлгэн өгөх үйл ажиллагааны явцад илэрсэн зарим зөрчлүүд нь Барилгын тухай хуулийн 14.1.Барилга байгууламжийн зураг төсөл, барилгын ажил, ... үйлчилгээг тусгай зөвшөөрлийн үндсэн дээр эрхэлнэ”- гэснийг зөрчсөн байна. Дээрх зөрчлүүд нь барилга байгууламжуудын захиалагч, зохиогч, гүйцэтгэгч нарын Барилгын хууль тогтоомж болон холбогдох норм дүрмийн хэрэгжилтийг хангуулах талаар хариуцлагаа төдийлэн дээшлүүлж чадаагүй байгаатай холбоотой байна.
7.Авсан арга хэмжээ, мэргэжлийн болон хууль зүйн зөвлөгөө: 1. Шалгалтаар илэрсэн зөрчил дутагдлыг арилгуулах, барилга байгууламжуудын угсралтын чанар, ашиглалтын үеийн төлөв байдалд хэрхэн үзлэг шалгалт хийх, Барилгын тухай хууль, тогтоомж, дүрэм журмын хэрэгжилтийг хангуулах талаар шалгалтанд хамрагдсан аж ахуйн нэгж байгууллагуудын удирдлага, инженер техникийн ажилтнуудад мэргэжил арга зүйн зөвлөгөө, зааварчлага өгч ажиллалаа.
8.Дүгнэлт:
“Энержи ресурс” ХХК-ийн захиалгаар баригдаж буй барилга байгууламжуудын угсралтын чанар байдал нь холбогдох барилгын норм дүрэм, стандартын шаардлагад нийцэж байх боловч захиалагч, зохиогч, гүйцэтгэгч нарын барилга угсралтын чанар байдлыг тодорхойлох баримт бичгийн баталгаажуулалт шаардлагын түвшинд хүрэхгүй байгаа нь Барилгын тухай болон холбогдох бусад хууль тогтоомж, норм дүрэм, стандарт, бусад эрх зүйн баримт бичгийг бүрэн хэрэгжүүлээгүй, чанд мөрдөж ажиллаагүйтэй холбоотой байна.
9.Цаашид авах арга хэмжээний санал:
1. Засгийн газрын 311-р тогтоолоор батлагдсан “Аж ахуйн нэгж байгууллагын үйл ажиллагаанд дотоод хяналт шалгалтыг зохион байгуулах нийтлэг журам”-ын дагуу аж ахуйн нэгж байгууллага бүр дотоод хяналтын нэгж, бүтэц тогтолцоогоо албан ёсоор байгуулж, хэрэгжүүлэх
2. Захиалагч, зохиогч, гүйцэтгэгч нар нь Барилгын тухай болон бусад холбогдох хууль тогтоомж, норм дүрэм, стандарт, бусад эрх зүйн баримт бичгийг бүрэн хэрэгжүүлж, хоорондоо байгуулсан гэрээний хэрэгжилтийг хангуулах, эрх үүргийн хариуцлагыг сайжруулах шаардлагатай .
