In an era where many unfortunate events; such as climate change, loss of biodiversity, economic recession, massive immigration across regions, and civil war in many countries, are occurring, it is crucial that we find a way to stop or prevent further damages. It is inarguable that many of those unfortunate events are the results of our own actions. Therefore, it may be said that it is our duty (and probably karma) to find a way to co-exist not just with the world, but also among ourselves as individuals, communities, and states. And sustainable development might be just an answer for that.
The term ‘sustainable development’ for many people may be understood as related to environmental matters only. However, in the eyes of scholars and practitioners, …show more content…
The Nielsen Company has conducted a Global Survey on Corporate Social Responsibility between 18th February and 8th March 2013. The survey found that 50 percent of global consumers surveyed are willing to pay more for goods and services from companies that have implemented programs to give back to society. In that number, more than two-thirds of respondents in the Philippines, Thailand and Indonesia say they would pay more for goods and services from socially responsible companies. Pro Bono

...An understanding of the importance of pro bono and access to justice is a crucial part of any law student’s education. How could this be improved? Twenty one years ago in 1992, “Daniel” who was 29 years old, was arrested in relation to a crime which left the victim, a county investigator, with a broken nose in Arizona. Two years later, evidence emerged that during the incident “Daniel’s” accomplice said “We got to do him” to which “Daniel” did not reply. On the basis of this weak evidence “Daniel” was convicted of the more serious crime of conspiracy to commit first degree murder and sentenced to life imprisonment. For the majority of my lifetime, “Daniel” has been trying to correct this egregious conviction and his struggle is far from over. Last summer, I work pro bono on “Daniel’s” case as a second year law student in Oracle, Arizona, and came to realise the true benefit of pro bono work. I ended up in Oracle after studying American Legal Practice at Birmingham City University as part of my second year LL.B studies. The American Legal Practice module is the largest UK to USA legal internship programme in the United Kingdom with over 100 host partners. The module provides students with an opportunity to work pro bono in an American law office, project or organisation for academic credit. Before embarking on the internship students must undertake training, in order to prepare them for some possible issues they may encounter. The training covered areas including legal...

Case 2 - Microsoft’s Partnership with Unhcr – Pro Bono Publico

...Abstract: The case portrays the evolution of the partnership between software giant Microsoft Corporation and United Nations High Commissioner for Refugees (UNHCR). The corporate social responsibility (CSR) initiative was created in 1999, as a bottom-up idea, when Microsoft employees initiated to help the victims of the Kosovo crisis. The outcome was a software registration system that today helps UNHCR administer their refugee camps in a more efficient and constructive way. The case illustrates an ideal example of a CSR programme and the importance of contributions made by business to society. In particular, it illustrates how a multinational company can take a responsible role in today's modern society without diverting from its core business strategy. The case invites readers to reflect upon and discuss some important questions regarding CSR, ethics and the business role in society. A teaching note accompanies this case with analysis of the theoretical elements. This case was written with the support of a Philip Law Scholarship awarded by ecch. http://www.ecch.com/educators/products/view?id=81242 Abstract This case-study takes us through the actual outcome of one of Microsoft’s corporate citizenship (CC) activities, namely its partnership with UNHCR. The intentions of the case are to show the potential benefits of such a partnership, the key beneficiaries as well as to trigger a debate concerning the intentions and outcomes of CC. Microsoft and UNHCR have based their...

Wto Dispute Settlement

...Revised version forthcoming in the Journal of International Economic Law WTO Dispute Settlement and the Missing Developing Country Cases: Engaging the Private Sector Chad P. Bown† Brandeis University & The Brookings Institution May 2005 Abstract The poorest WTO member countries almost universally fail to engage as either complainants or interested third parties in formal dispute settlement activity related to their market access interests. This paper focuses on costs of the WTO’s extended litigation process as an explanation for the potential but “missing” developing country engagement. We provide a positive examination of the current system, and we catalogue and analyze a set of proposals encouraging the private sector to provide DSU-specific legal assistance to poor countries. We investigate the role of legal service centres, non-governmental organizations, development organizations, international trade litigators, economists, consumer organizations, and even law schools to provide poor countries with the missing services needed at critical stages of the WTO’s extended litigation process. In the absence of systemic rules reform, the publicprivate partnership model imposes a substantial cooperation burden on such groups as they organize export interests, estimate the size of improved market access payoffs, prioritize across potential cases, engage domestic governments, prepare legal briefs, assist in evidentiary discovery, and pursue the public relations effort required to...

The Rise of Child Maltreatment

...The Rise of Child Maltreatment Jesus said, "Let the little children come to me, and do not hinder them, for the kingdom of heaven belongs to such as these (NIV, Matthew 19:14). The Old and New Testament demonstrate abundantly that children are a heritage from God and a crown of the aged (Psalms 127:3; Proverbs 17:6). Despite this there are many in this world who view children as chattel, even a hindrance and a curse; thus, too many children are subjected to cruelty and atrocities. There has been historic awareness created in regards to child abuse since the 1970’s; nonetheless, there has been an increase in neglect, murder, rape, and the trafficking of children. Child maltreatment is not exclusive to any one socioeconomic level; however, “African American, Native American, and multi-racial children have higher incidents of reported abuse than that of other children” (Child Trends, 2014, para 8.). 45% of children age 5 and under are the most vulnerable to maltreatment with fatalities being the highest among these age groups (Safe Horizon, 2014, para.2.). According to statistics from the Department of Health and Human Services, “Nationally four fifths (78.3%) of victims were neglected, 18.3% were physically abused, 9.3% were sexually abused, and 8.5% were psychologically maltreated. For 2012, a nationally estimated 1,640 children died of abuse and neglect at a rate of 2.20 children per 100,000 children in the national population” (DHHS, 2012, p.4., para. 4,5.). Human...

Leading Innovation and Change

...M5.05 Leading innovation and change 1. Explain the importance of innovation for own organisation 1. Explain the importance of innovation for own organization I work in an authority responsible to implement the EU legislation in our country. One of the aims of the organization is to draft policies and to attend meetings concerning the EU policies. EU regulations are directly applicable to each Member State, while directives need to be transposed by the responsible officials. Before any decisions are taken consultations are carried out with the industry, the general public and any interested stakeholders. When a legal tool is in place there is always a transition in which the regulation is implemented hence the industry and the public will have ample time to the new regulations. During this time awareness and publicity is necessary so that we reach as many concerned people as possible. Innovation is important within my organization since there is the need to find new ways to increase publicity of the organization and at the same time we need to educate the public. We are not very reactive to the outside environment hence we need to become more innovative and inherently more adaptable to the external environment. This will allow us to be proactive and more effectively to capture opportunities. Innovation within my organization is needed, mainly in the following aspects: • Service innovation – where new and better service offerings to customers should...

Legal Aid for Refugees and Asylum Seekers. the Role of the Judiciary

...ACCESS TO JUSTICE AND LEGAL AID FOR REFUGEES AND ASYLUM SEEKERS; WHAT CAN THE JUDICIARY DO? Introduction Asylum seekers, regardless of their immigration status, are human beings, with fundamental and basic rights, needs and aspirations. Refugees and asylum seekers are a diverse group with one thing in common; they are subject to forced migration, and are fleeing from persecution in their countries of origin. A refugee is defined as any person who, owing to a well-founded fear of being persecuted for reasons of race, religion, nationality or political opinion, is outside the country of his or her nationality and is unable or owing to such fear for reasons other than personal convenience is unwilling to avail himself or herself of the protection of that country. Refugee status is therefore adopted for those who, having applied for asylum, have been recognized and given refugee status. It also usually encompasses those who have received ‘exceptional leave to remain’ or ‘indefinite leave to remain’. Recognition of refugee status is also a pre-requisite for other basic rights guaranteed to refugees by international law, such as the right to seek employment, to move freely and to obtain education and healthcare on the same terms as citizens. The status of an Asylum Seeker is reserved for those who have applied for asylum and are awaiting a decision on their applications and those whose applications have been refused. Refugees therefore need legal assistance as soon as they arrive in...

Problems with Ppaca

...Higher Costs PPACA has touted new benefits without measures to cut cost.1 One should know that in America there are already federal laws and programs to cover the elderly (Medicare), the poor (Medicaid), and uninsured children (CHIPs), In addition there is basically free or low cost care to anyone who needs it and it is available if one looks for it. Examples include: Shriner’s hospitals, free clinics, and providers who do pro bono work. In case that wasn’t enough, there are also laws in place that ban practices of charging more to people with pre-existing conditions in employer-based health insurance. The 60% of Americans who get their healthcare insurance from their employer may actually be hurt by PPACA. All one needs to do is make the connection that minimum standards for health insurance and broader access to subsidized healthcare will drive taxes up.4 But for those who have a hard time making the connection, the literature supports costs 3 times higher than initially stated by President Obama, and an additional $118 billion through 2023.3 In order to drive home the point of higher costs, look at an example used by Supreme Court Justice Samuel Alito. Justice Alito spoke on the hypothetical typical healthy 27 year old worker who on average consumes less than $900 annually on healthcare services. Under the PPACA that same healthy 27 year old worker will be required to spend more than 5 times that amount for a healthcare policy that gives a low deductable and pediatric...

Guda I. Introduction Population control or population management has been one of the rallying cries of Filipino economists since Pres. Ferdinand Marcos signed the United Nations Declaration on Population in 1967. With an estimated population of 92,337,852 in 2010 according to the National Statistics Office (National Statistics Office [Philippines]), and a land area of 300,000 sq. m., lawmakers and civic groups have been clamoring for a solution to address the constant growth rate vis a vis the dwindling natural resources in the country. While the population growth rate continues to hold steady(estimated to be at 2.36% per annum in 2008) (National Statistics Office [Philippines] and ICF Macro), the country’s resources, has suffered the same fate as that of the rest of the Asia Pacific region, which, the Asian Development Bank, in collaboration with the WWF, says is, “consuming more resources than its ecosystems can sustain, threatening the future of the region’s beleaguered forests, rivers, and oceans as well as the livelihoods of those who depend on them.” In an effort to help address this issue, stakeholders have sought to offer various methods...
