I am Shawna, who is managing a large IT project in the healthcare industry, ZAP. “My project is to refurbish an existing office building, install the IT infrastructure, and outfit the area for use as a new telephone answering hub for my company. I took over this project a week ago from John, the previous project manager ( DeVry).” 1. Is Bear or is ZAP responsible for the inspections? What is a reasonable course of action given that the project may have to be delayed a week or more?
As Project Manager, I believe ZAP responsible, as Bears have managed to handle the refurbishment of the project. ZAP is responsible as no contract was signed regarding any issues. As Bears being a construction company, they are handling all the painting, interior work of the project. They signed a memo with John, the past Project Manager, whose project I have taken over. As the project discusses an issue of doing a quick review of seeing Bear being responsible, I simply believe that does not make sense or prove anything of having them held responsible for the inspections. Bear can’t make efforts to work on the issue as they have already signed the form of contract with John. Bear have told their responsibilities of work in the contract which we should look upon.
ZAP shall be held responsible as they are a healthcare industry and doing an inspection is what they should be aware of as they are dealing with medicines which is fragile to human’s health. According to the World Class Contracting Book, the diagram below discusses the process of fulfilling a good project. It is always important to know what the beginning and end will bring to the process of the work asked for. The project always as an end date to the reason why it is called a project and not another term in this case. I find the term of communication important as it inputs

...You Decide Estrella Fernandez ececa_1@hotmail.com PROJ-598-16361 Professor: David Garrett Introduction I am currently the project manager for ZAP Pharmaceutical Company. Currently, I am managing a large IT project in the healthcare industry for ZAP. My project objectives are to refurbish an existing office building, install the IT infrastructure, and outfit the area for use as a new telephone answering hub for the company. All contracts associated with this project are fixed price contracts and we have three main issues that need resolution. Issues 1. Bear’s Construction Company is making a claim that it is not responsible for inspections required by the local township. Bear has produced a memo signed by John during negotiations that states that ZAP is responsible for all permits and inspections. The contract shows that Bear is responsible for all inspections. 2. The contract states that carpeting must meet a specific wear rating. It also prohibits the use of any non generic materials within the work of the contract. This would include carpets with special wear rating, because these would be non generic materials. Anne has already purchased and begun the installation of the generic carpet that does not meet the wear rating. 3. Sheba’s Office Equipment has informed you of a minor typographic error in the contract with you to provide office equipment for this project. In the contract, it states Sheba shall be paid as follows $350,000 (Three hundred and fifty...

Contractual conflict generally occurs because of differing interpretations of service or business-related requirements. The project issues and risk can develop due to unclear description of services. (Garrett) In this case study ZAP Pharmaceutical Company accumulated project issues because of the lack of communication between the buyer and seller, unclear information and mistakes presented in the contract. The project manager Shawna, replaced the existing project manager John for a large IT project in the healthcare industry at ZAP Pharmaceutical Company. Shawna entered the project during the executing phase. During project execution, changes can occur: to expected activities durations, changes in resource productivity and availability, and unanticipated risk. The results can trigger change requests that it if approved, may modify project management plans or other project documents and possible require establishing a new completion schedule. ("Buzzle,") As a project manager entering a project during the executing phase, Shawna failed to perform certain duties to insure the organization, structure, and planning of project. She needed to read over the contract and contact each vendor to ensure they...
