...The economics profession’s jargon serves a variety of purposes. For example, their common terminology serves to make for more precise communication. It allows ideas to be communicated clearly and exactly. This exactness and clarity of terminology serves society by allowing economists to discuss economics with each other and with society with clarity so that other economists have a better understanding of what an economist is saying. A common terminology also serves to divide insiders from outsiders. For outsiders, for example economic students, who do not have a clue what these terms mean, economists’ terminology is exclusionary. It makes economists the gatekeepers of economic ideas. Economists’ terminology serves as a barrier to entry, restricting the supply of economists, and increasing the value of the services provided by existing economists. Which of these two reasons is the strongest? To answer that question let us consider two examples given by Amanda Bennett, the author of The Wall Street Journal article, “Economists + Meeting = A Zillion Causes and Effects” [The Wall Street Journal, January 10, 1995]. Business owners usually write in a technical way that can, unfortunately, bore, confuse and/or scare your potential consumer. (Sorry about that). To illustrate my point, have you ever read an article written by a doctor, or a lawyer? Ugh! You need to remember that when you are writing marketing pieces, you are not writing for your peers who understand the business jargon of your industry, you are writing for your mostly non-technical potential customers. And they need to ‘get’ what you’re saying.Long-winded technical jargon and terminology has no place in your marketing pieces. You run the very real risk of alienating your potential customer by making them feel stupid. Or you can confuse them unnecessarily by being too technical in your descriptions. Of course you would never do this intentionally, but in my experience this can, and does happen – often. That’s why it makes sense to run any marketing piece you write by your marketing partner. Introduction This paper explores certain legal acts and omissions that facilitated the over-leveraging and near collapse of the global financial system. These ―Legal Enablers‖ fostered the boom that enriched a class of financial intermediaries who followed a storied tradition of gambling away ―other people‘s money.‖2 These mechanisms also made the pain of the bust disproportionately felt by the middle class and poor while shielding the middlemen who created the problems. These legal Enablers permitted the growth of a shadow banking system, without investment limits, transparency or government oversight. In the shadows grew a variety of highly leveraged private investment pools, undercapitalized conduits of securitized loans and speculation in complex credit derivatives. The rationale for allowing this unregulated, parallel system was that it helped to create innovation and provide liquidity. The conventional wisdom was that any risks associated with a hands-off approach could be managed by the ―invisible hand‖3 of the market. In other words, instead of public police, it relied upon private gatekeepers. A legal framework including legislation, rules and court decisions supported this system.
