After further analysis of the penalties and citations that were handed down to our company, I found the employees that were performing the welding activities which was said to be above the legal limit for substance in the U.S. or the (PEL) could possibly be referred to by the United States Department of Justice. Since the exposure limit was approximately double it makes this citation a very serious one.
I am also completely aware that my company has a 15-day grace period to ensure that the hazard is properly mitigated, and will not be re-occurring. It was their jobs to take the proper precautions in ensuring that the site was free of any recognizable hazards and also to ensure that periodic checks were being do that they were in compliance on all the rule and that safety was the number one priority in this. Proper systems should have been in place prior to any work being done at the facility as part of the pre-job planning.
If and when a serious violation has occurred the company would face a hefty fine of no more than $7000 if there is a possibility of serious harm being done or even death.
If charges were to be brought upon the company as a result, I would then go on to sample the findings that came from the work areas of the exposed workers to see the exact exposure limits from the fumes that they were exposed to. I would also check the ventilation systems to make sure that overexposures were not due to the fumes and the gases and also that it got the contaminants out of the welders breathing zone.
After the completion of the systems checks I would seek the Occupational Safety and Health Review’s commission in an attempt for an appellate review or administrative trial for the proceeding citations and penalty’s that were handed down upon the company. Their job would be to Conduct the hearings, render the decisions by its (ALJs) and to provide a
