Critique of Ada and Affirmative Action Paper

...ADA and Affirmative Action Paper Discrimination in the workplace has been an issue for as long as I can remember. Although the Civil Rights Act of 1964 forbids employers from discriminating against individuals because of their race, sex, age, and/or disability, many employers still exhibited this type of behavior during the hiring process. President Lyndon B. Johnson enacted an executive order that required government employers to not use hiring practices that exhibited discrimination in 1965. The American Disabilities Act (ADA) was put into place years later to protect those with disabilities. All of these were efforts to promote equality in the workplace, among other places; although the laws may protect certain individuals from discrimination, others may be discriminated against as a result. The paper’s intent is to provide insight regarding my feelings towards the American Disabilities Act (ADA) and Affirmative Action. What is sometimes meant for good can also result in something bad. American Disabilities Act (ADA) President George H.W. Bush signed the American Disabilities Act (also referred to as ADA) in 1990. The ADA intended purpose was to protect those with disabilities from discrimination in transportation, employment, communication, and different cultural opportunities. Under this law, employers are forbid to discriminate in many different areas such as hiring, lay-offs, and job assignments because of one’s disability. Disability is defined by the ADA as “a physical...

Gender Issues in the Workplace

...Gender Issues in the Workplace Introduction Believe it or not women have had rights in the work force for over two hundred years. Women should be treated as equals with men in the work place, but that is not always the case. Companies need to be careful with gender issues; they could lead to law suits and cost millions of dollars. People whether it is men or women should be hired, promoted, or given raises based on their experience not their gender. Dealing with gender issues in the work place can create many problems that can be solved by treating all employees equally. Women have been denied rights in the work place for many years. There are many laws in place to protect women in the workplace. Not all employers follow these laws; women still on an average make less than men. This is why women should prepare themselves with knowing the current laws that deal with gender issues in the work place. Purpose and Scope To prove that women are just as valuable in the workplace as men are. Women can do the same job as men without complications. A woman working the same job as a man usually makes less money than the man. Women are sexually harassed in the work place. They are not treated as equals. Women should be treated as equals in the workplace. They should get the same pay and benefits as a man does and not be harassed because of their gender, yet this is not always the case. In explaining a little history about women’s rights, these sub-problems will also be answered:...

Discrimination Worksheet

...Material Discrimination Worksheet Write a 100- to 200-word response to each of the following questions. Provide citations for all the sources you use. • What is discrimination? How is discrimination different from prejudice and stereotyping? Discrimination is when a person is harassed or treated differently, because of race, religion, sexual orientation, and gender among many other reasons. In employment circumstances discrimination is something that an employer does that hurts an employee; for example an employee being fired for reasons not related to on the job behavior, or not selecting him/her for a promotion. Discrimination is different from Prejudice and Stereotypes, because it’s not being negative towards a whole entire group. Discrimination denies someone an opportunity to improve their life. • What are the causes of discrimination? Since our readings focused more on discrimination in the workplace, I decided to describe some of the common causes of disconcertion in the work environment. One of the causes is a hostile work environment, if an employee is the subject to constant harassment, or not being included in activities based on factors such as race, or religion. Also salary employers are barred from paying employees differently for the same type of work based on any prohibited factors. Refusal to promote is another common cause if the employee who would otherwise be given a promotion is refused because of factors such as race, or disability...

Discrimination at Work

...Discrimination at Work In a model world it would be assumed that everyone would be treated fairly when applying for a job and advancing within the field. The issue of discrimination due to diversity is still a major issue in today's time. Discrimination still plays a dominant role in the hiring, firing, and promoting of individuals. Diversity does not just include dissimilar races, but age, gender, and religion as well. Most people do not sit and analyze the larger picture. Discrimination affects people all over the world. People of all ethnicities and from all different walks of life are influenced in some way by workplace discrimination. "Discrimination" means unequal treatment. One of the most common elements discriminated against is a persons ethnicity, or their race. This is called Racial Discrimination. Could you imagine being limited by something that has nothing to do with your skill or ability? If you look at the leadership positions of many of the world’s top companies, you will find few women occupying them. This contrast can also be related to the role of African American people in companies. It is very apparent when you think about the number of Black CEOs versus White leaders, something is preventing them from reaching the top. Although many people believe racial discrimination is mostly a thing of the past, it is still prominent as an invisible barrier in one of the most prominent areas of life, the workplace. Racial discrimination happens all the time...

Title Vi

...Title VII is a very important part of legislation that was designed to prevent discrimination in the workplace; numerous amendments have been made to make the definitions easier to understand by clearly outlining inappropriate behaviors and actions. The following paragraphs will discuss the history of Title VII , the amendments, defining covered employees, disparate treatment, and sexual harassment. Policies that should be in effect in the workplace will also be discussed with the intent of further educating the readers. The History and Evolution of Title VII and its amendments (PDA, ADA, ADEA) Title VII was born out of the Civil Rights Acts of 1866 and 1964 and has grown to become the laws that almost all businesses must comply with. Title VII states that "it shall be an unlawful employment practice for an employer to fail or refuse to hire or to discharge any individual, or otherwise to discriminate against any individual with respect to his compensation, terms, conditions or privileges of employment, because of such individual's race, color, religion, sex or national origin.” This title also makes it unlawful to "limit, segregate, or classify his employees or applicants for employment in any way which would deprive or tend to deprive any individual of employment opportunities or otherwise adversely affect his status as an employee, because of such individual's race, color, religion, sex, or national origin" (Bennett-Alexander and Hartman, 2007). Discrimination in the Workplace

...Discrimination in the Workplace Joshua Najar Alejandro Komiyama Liria Nilzandra *out of country* Texas Tech University Sociology 1301, Section 004 November 7, 2015 The United States likes to believe that everyone living in it is equal to one another. Unfortunately, even in today’s world discrimination is still prevalent in our society. James Henslin, author of the book “Essentials of Sociology” defines discrimination as “an act of unfair treatment directed against an individual or a group” (G-2). One specific place in our society that still has discrimination is the workplace. A workplace can be described as “a place where people work, such as an office or factory” (Dictionary.com 2015). A company’s workplace can discriminate against a person’s race, ethnicity, gender, age, and religion. These discriminations will affect the person’s salary, work conditions, and determine if they get hired or not. Throughout time the United States has made several laws to protect certain groups against discrimination in the workplace. These laws have tremendously helped those groups however, they are still illegally discriminated against. There are numerous ways to analyze why there is discrimination in the workplace but we will be using the three sociologic perspectives. The three sociologic perspectives that we will use to analyze this topic will be the Structural Functionalism, Conflict Theory, and Symbolic Interaction. The Structural Functionalist Analysis will focus on how discrimination...
