1. Is it a action legal ?

In view of the information we are given in the case study Raytheon, several points seem illegals.

Although the plaintiff and the members of the class were a non-union, Raytheon violated the rights of its employees including:

( Failed to have in place an immutable timekeeping system which allowed the class members to accurately record all the hours they worked.
( Failed to pay the wages for the hours workedin excess of 8 hours per day and 40 hours in a workweek.
( Failed to provide the itemized wages statement
( Failed to tender full payment and/or restitution of wages owed to the employees without valid justification or utility

Moreover, Raytheon continued to act intentionnaly, oppressly and maliciously toward plaintiff and class members. At the end, the plaintiff and class members are suffered and will continue to suffer irreparable harms.
Due to this points, Raytheon’s action are unfair and lawful business praticess because they deprived them of unvalable rights and benefits guaranteed by law and contract. Also this pratices were deceptives, immorale, unethical, oppresive, unscrupulous, and farudulent and they acted in an illegal attempt to avoid payment of earned wages, overtime compensation and other benefits.

2. Is it right ?

Raytheon acted illegaly and gain from their action. It allows them to make profit and gain in comparaison with other companies.

( Because the companie worked against the people employed as a non-union.Moreover, Raytheon cheated them because instructed the class member not torecord hours worked in excess, in order to avoid paying premium wages
( Also the company behavied in an unfair competition way.
( From an ethical point of view, breaking the law, the company didn’t assume its owns reponsabilities toward the society and the class members.

3. Who will be affected ?

Because during the class period, Raytheon systematically failed to correctly pay the plaintiff and the class members for all the hours they worked.

Because this action has as consequence to become known as a company with a bad reputation.

4. Does it fit company values ?

From the company website, the Raytheon’s values are :

The company behaviour doesn’t fit its own values regarding :
( « Treat people with respect and dignity », because it takes advantages on the most weak employees, the ones that are not union members.
( « Recognize and reward accomplishment », because the failed to correctly pay their employees for all the hours they worked.
( « Be honest, forthright and trustworthy », because they didn’t respect the California Labor law and moreover they instructed class members to cheat on the recording hours in order to avoid the premium wages.
( « Respect ethics, laws and regulations » They didn’t accomplished at all this point.

5. How will it « feels » afterwards ?

Raytheon can be worry about the image they are reflecting to the other workers of the company but also about their dealers, and be less admirated by the customers who will have a bad image of the company.
They should work hardly if they don’t want to be considarated as an unfair and not serious company. They will have to show a better image of themselves.
Company doesn’t fit with its own values, and be can perceived as unfair and unlawful.

6. How will it look in the newspaper ?

Untrustable and unfair company which doesn’t assume its responsabilities and only follows the profit without respect for rules, and without any ethics.

7. Will it reflect poorly on the company ?

The fact that Raytheon does not even respect their own code of conduct reflect poorly on the company. It seems that this company are not trustable because they didn’t pay their employees for all the hours they worked, and without accurate itemized wage statement.

The contract was agreed upon by both parties however a case was brought before Federal Court to determine if a breach of the contract had occurred in light of new costs incurred. The Federal Court found in favor if Raytheon due to a statute of limitations clause in the Contract Disputes Act (Horan and Stanton, 2013). The Contract Disputes Act (CDA) was enacted to handle claims pertaining to contracts with the United States Federal Government. Notably for this paper the CDA includes a statute of limitations that allows for a claim to be brought against a party involved within six years of the finding of the discrepancy (Horan and Stanton, 2013). In the case of Raytheon, the Federal Government argued that the extra costs that Raytheon passed on to the Government were in breach of the original contract. Raytheon used a subcontractor to aid in the completion of the missile remanufacture, which was allowed under the contract, resulting in overhead costs that passed on to the Government. The primary issue resulting in the finding in favor of Raytheon was that the Federal Government filed its claim after the six year window under the CDA’s statute of limitations.
