I have been working there on and off for the last 15 years of my life in various roles. My father is an allergist there and has been helping patients in Southern Colorado with asthma, chronic cough, wheezing, food allergies, drug reactions, reaction to insects, hives, and rashes. My father trained at National Jewish Hospital in Allergy Asthma Immunology and finished his fellowship and set out to have a little piece of his American dream, a private solo practice. My father started the clinic in Pueblo in the 1980’s and slowly opened satellite clinics in Colorado Springs, Canon City, La Junta and Alamosa. Currently has one other physician, and a physician assistant working with him, with a support staff of roughly 30 employees. The support staff includes two receptionists, two insurance clerks, one transcriptionist, one marketing paid intern and approximately 20 nurses. The market segment that this clinic caters to is lower-middle class, and middle class patients from the blue-collar town of Pueblo, CO. Most of these patients have Medicaid insurance. ...Rights, Responsibilities and Regulation of International Business Sol Picciotto* This essay discusses the paradox of the emergence of corporate codes of conduct in the 1990s, following pressures from consumer and labor activism, in a period of more general liberalization of international investment leading to deregulation. It suggests that the advantages of flexibility and adaptability to specific circumstances offered by such codes are counterbalanced by their self-selected content and inadequate enforcement. Rejecting the assumption that there is a sharp distinction between voluntary standards and binding law, the essay analyzes various ways of grounding codes in legal obligations. It proposes that a safer and more dependable environment for international investment could be provided by a framework agreement, which would link binding standards for corporate social responsibility in key areas, such as combating bribery and cooperation in tax enforcement, with traditional investor rights based on investor protection and liberalization rules. Introduction This paper explores certain legal acts and omissions that facilitated the over-leveraging and near collapse of the global financial system. These ―Legal Enablers‖ fostered the boom that enriched a class of financial intermediaries who followed a storied tradition of gambling away ―other people‘s money.‖2 These mechanisms also made the pain of the bust disproportionately felt by the middle class and poor while shielding the middlemen who created the problems. These legal Enablers permitted the growth of a shadow banking system, without investment limits, transparency or government oversight. In the shadows grew a variety of highly leveraged private investment pools, undercapitalized conduits of securitized loans and speculation in complex credit derivatives. The rationale for allowing this unregulated, parallel system was that it helped to create innovation and provide liquidity. The conventional wisdom was that any risks associated with a hands-off approach could be managed by the ―invisible hand‖3 of the market. In other words, instead of public police, it relied upon private gatekeepers. A legal framework including legislation, rules and court decisions supported this system.
