...proceeding in which a case is brought before a higher court for review of a lower court’s judgment for the purpose of convincing the higher court that the lower court’s judgment was incorrect. An appeal is done when a defendant’s attorney tries to get him/her a lighter sentence in exchange for something in return, for instance a guilty plea. This is the defendant’s way of trying to get a lighter sentence for the crime he/she has committed. Appeals are important because they are one of the principal avenues in which legal issues, such as law are shaped. Often an appellate decision in one jurisdiction is a source of guidance to courts in other jurisdictions. The first step to appeal is to file a notice of appeal within a specific amount of time after the conviction. Next the appellate files the trial court record and all documents supporting the appeal to the appellate court. Then the appellant and appellee each file briefs, basic facts of the case and the argument made by that particular party. After the briefs are filed the judge may want to hear a short oral argument from each party in the case and finally the court will issue a decision which will be given with a written opinion describing the reasoning for the decision. The appeals factor into the overall criminal procedures and processes because it is the defendants legal right to an appeal. Prosecutors as well as defendants can appeal a court’s decision. Judges typically do not like to have their cases appealed because...

In the next few paragraphs you will get a well rounded view of the case from start to finish. It is not chalked full of immense detail, but it is a good summary, to give an idea of the case for anyone who may not know or remember much of the case. Scott Peterson was arrested in La Jolla, CA on April 18, 2003 by the California Department of Justice/Sexual Assault Felony Enforcement Task Force. He was arrested in the parking lot of Torrey Pines Golf Course, where he said he was meeting up with his father to play golf. He was in possession of several items not meant for golf. Peterson bleached his goatee and hair, but claimed it was from chlorine from his friends pool; later is his fried testified that Peterson had never swam or made use of his hot tub. Before Peterson's arraignment, he had been represented by Kirk McAllister, a veteran criminal defense attorney from Modesto, CA. He told Judge Nancy Ashley at the arraignment that he could not afford a private attorney. So, Chief Deputy Public Defender Kent Faulkner was assigned to the case, and then later, Peterson changed his mind stating, “He could afford a private attorney.” That attorney’s name was, Mark Geragos, who was experienced in high profile defense cases. The People of the state of California v. Scott Peterson began in June 2004. Peterson's defense...

...Scott Peterson's attorney, Mark Geragos, now has to contend with more than a guilty verdict for his client - and the penalty phase of the trial, now delayed for a week by the judge. Geragos is also facing a bar complaint related to the case. In the complaint, Florida attorney John B. Thompson - who has no reported connection to the case - argues that Geragos violated a key ethic rules forbidding communication with jurors. According to Thompson, Geragos did so by putting a replica of Scott Peterson's boat two blocks from the courthouse. Geragos, who remains under a under a gag order preventing him from discussing the case with the media, has not been able to respond to the allegations. Thompson says that Geragos's alleged boat display not only broke the California ethics rule barring juror communication, but also broke the California ethics rule against extrajudicial communications about a case. (As a recent column by Jonna Spilbor for this site noted, the penalty phase of this case - in which a death sentence could be imposed - has yet to occur.) Reportedly, the boat contained homemade concrete anchors - such as those the prosecution alleged Scott used to weigh down Laci Peterson's body - and a dummy representing the body. The defense's theory was that Scott could not have thrown Laci's heavily pregnant body over the side of the tiny, anchor-filled boat without swamping the boat with water and tipping it over. The display was apparently intended to illustrate just how tippable...

...blood, fingernails, semen, fingerprints, and the list goes on and on. Now motive is the exact reason for doing something especially one that is hidden or not specifically obvious. Motive can give light as to why an act of crime was committed instead of just providing how, when, and where something happened. Explaining a certain act of violence on a specific motive can help seal a case especially if the motive was given by the suspect his or herself. Without motive the prosecution will have a harder time proving suspect to be guilty and would have to rely more on evidence. Summary of Laci Peterson Case...

...CRIMES AND RESPONSES ARGOSY UNIVERSITY INTRODUCTION TO CORRECTIONS Andrew MacDuffie On December 24, 2002, Laci Peterson was accounted for missing from the Modesto, California home she imparted to Scott. She was eight months pregnant with a due date of February 10, 2003, and they had wanted to name the child kid Conner. The definite date and reason for her demise were never decided. Peterson at first reported her missing on Christmas Eve, and the story immediately pulled in across the country media interest. Modesto police did not quickly recognize Scott Peterson as a suspect, to a great extent in light of the fact that Laci's family and companions kept up their confidence in his honesty amid the month tailing her disappearance. Eventually, police became more suspicious because of irregularities in his story. On January 17, it got to be realized that he had various extramarital affairs, most as of late with a back rub advisor named Amber Frey. She drew nearer police about Peterson, whom she had recently started to date, subsequent to finding he was really hitched to a missing lady. Right now, Laci's family reported that they had withdrawn their backing of him. They later said that they were rankled not by the issue, but rather that he had told Frey that he'd "lost" Laci and that he would be spending his first...

...Running Head: COMPANY VALUATION Company Valuation [Name of writer] [Name of institute] Company Valuation Introduction This is the case of a partnership business, Midwest Lightning Inc. (MLI) partnered between two entrepreneurs Jack Peterson and David Scott. Over the years these two partners have developed differences, which have escalated to the point of separation. Hence, in this assignment we are going to provide solution that would be required as the partnership culminates. Overview of the case The partners of the company Midwest Lightning have over the years developed differences and they are now at complete 180 degrees when it comes to their views about the business. The solution that has been suggested is that the partnership should end as the differences have become irreconcilable. In the course of separation, various issues have now arisen, regarding the valuation of the company and how much worth each partner should be accrued in the event of separation. 1) Evaluation of the company-Buy and Sell bids Allen Burke, the accountant of Jack Peterson and David Scott suggested a bid agreement. The agreement finalised was that both owners had agreed on the signing of a mutual buyout agreement. The agreement mentioned that the owners were to submit a secret bid in relation to what the other owner’s half of the business should be. The partner that would offer the maximum price would then buy out the share of other partner. A minimum...

...On Christmas Eve in 2002, Laci Peterson was reported missing in Modesto, California. Mrs. Peterson was seven and a half months pregnant at the time of her disappearance. The investigation went on for two years and the capital murder case lasted 6 months. Ultimately, her husband Scott Peterson was sentenced to death for the murder of Laci and their unborn son Connor. Evidence and motive are two important factors in an investigation. Motive is the reason the criminal commits the crime. Evidence supports whether or not the alleged is found guilty or innocent. Scott Peterson was having an affair with the 27-year-old, Amber Frey. The affair was never thought of to be the motive of the murder, but was used to show Peterson’s bad character. Many...

...called to serve, and actually serving is two different matters. A jury is ultimately selected by the judge, prosecutor and defending attorney. How they are they picked? How are they released? Maybe this paper will answer a few of these questions. The selection of a jury is the process that occurs right before the actual trial, and after the trial initiation and the arraignment and plea. Only about 10 percent of actual arraignments see an actual trial, because 90 percent of cases that are preparing for trial end up accepting a plea bargain (Schmalleher, 2009). Any one who is accused of a crime and will stand trial is allowed by the Sixth Amendment the right to an impartial jury. For a jury to be impartial, it is not always true that they have no prior knowledge of the case at all. In the case of a highly publicized trial, it can be almost impossible to find 12 people who know nothing about the case at hand or the accused. Some jurors will be excused based on how suitable they are judged to be for the case, and some may be excused because of reasons beyond their control (Schmalleger, 2009). I have been called to serve jury duty one time in my life. At the time I had 2 small children at home, one of them just being diagnosed with the Swine Flu 2 days prior. When I told the judge this, he told me not to touch anyone on the way out of courtroom, and wished my child well. It was not that I didn’t want to serve; I felt my place was with my child, and was glad the judge agreed. ...

...Midwest Lighting Case Midwest Lighting, (MLI) Inc was a company dealing with the manufacture of customized designed fluorescent light fixtures for commercial, and other institutional applications. This company was formed by Daniel Peterson and Julian Scott in 1956 in Flint, Michigan. Daniel was in charge of the engineering and finance sectors while Walters headed the Sales and design unit of the company. As the company grew, personal differences between the two emerged and Daniel bought out Walters from the company and brought in Richard Scott as his new business partner. Daniel became the treasurer of the company and Scott the company president (Adams & Spinelli, 2012, p. 385). The company grew tremendously to steady sales of about $1.2 million and a net profit of more than $18,000. Daniel’s son Jack Peterson and Scott’s son David Scott joined the company in 1983 and 1984 respectively and went on to take charge of the company as the sales and manufacturing managers. The management of the company was stained with a lot of differences and conflicts in the ways of running the business, with both Jack and David preferring different approaches for the well good of the company. As of 2005, the net sales of the company stood at approximately $5.5 million with an after tax profit of around $144,000 and an over 82,000 lighting fixtures shipped. The company had a total of 130 permanent employees with an additional 88 other employees working on an hourly basis. The differences...

...Capital Punishment – For Or Against Scott Cameron Phase 4 Individual Project ENGL125-1203B-08 Dana LaMantia I’m sure you all have your thoughts on Capital Punishment, and whether you’re for or against it. I’d like to share a story with you about Donna Payant, a New York State Corrections Officer, and her killer. Lemuel Smith was an inmate where Donna worked; in 1976, he was sentenced to death for murdering a store owner and his employee, then kidnapping and murdering another woman before he was caught. However, his sentence was later converted to life in prison, sealing Donna’s fate five years later (Irvine, Kincaid,2003). My aim today is to share a few ideas that enforce capital punishment as an effective means of deterring heinous and horrific crimes, providing comfort for victims and their families, and saving the legal system money. Let’s start by taking a look at deterrence. Capital punishment can be looked at from the aspect of deterrence, which is discouraging individuals who may have the intention to participate in homicide. It is also a reference to the criminal, denoting that he may not commit a crime or participate in homicide. Deterrence is summed up by the deterrence theory (Siegel, 2012); this theory requires that individuals weigh the costs and rewards associated with different actions. It’s based on the premise that individuals will choose those actions that translate to greatest reward at lesser costs. The theory also proposes that crime...

...cash balance for that year was $116,308 and it projected to $2,042 for the following year. This was considered another financial weakness. For the start of the merge to be successful Anne needs to have a plan. She can start out by fixing the musicians salaries. She needs to look at the last negotiation and come up with a new contract. She can show the musicians the income statements and explain to them that if they want a raise it could determine the life of the organization. This organization is very dependent on cutting costs and increasing revenue. One way to cut costs is to lower wages. She can show them that the company will not be able to succeed at a surplus if expenses continue to increase. This is a temporary fix or worst-case scenario that wages could be decreased. The musicians will learn that the success of the symphony and keeping their jobs are dependent on each other. As to the increasing expenses offsetting the revenue Anne can look into the fundraising...
