When designing the Electoral College, the Framers had originally designed it to “elect a President and Vice President from the same pool of candidates” The winner was determined by who had the most votes, and the runner-up would be the vice president. Nevertheless, the 1800 election, between John Adams and Aaron Burr, revealed a major flaw in the Electoral College. Because there was no way for “electors to earmark their votes separately for the president and vice president, that presidency resulted in a tie”. The House of Representatives, controlled by the Federalists, had to break the tie, resulting in Jefferson’s win after the Federalists were persuaded not to let Burr win. However, the ratification of the Twelfth Amendment, in 1804, was
