The Japanese government developed JET in an effort to better the English language education in Japan through the use of international teachers. It was also hoped that the program would promote an understanding at the local level of the importance and value of the differences between various cultures. Any differences that presented themselves between the ALT’s and their employers would be heard by the Conference of Local Authorities for International Relations (CLAIR). An issue however, was that, by agreement, CLAIR would only become involved if the employer would not or would not resolve the problem itself. Issue In this case study, Kelly and the other ALT’s had taken two days off for being sick. The ALT’s were directed by their boss Mr. Higashi to get a doctors note before returning to work and were told they could not use sick leave, instead they would have to use accumulated vacation time for their absence. ...CASE STUDY Stankiewicz V. City of Manchester 156 NH 587 FACTS: Mr. Stankiewicz brought a suit against the city on Manchester for the restoration of his sick leave credit. This is because when he was sick the city had denied his request to get workers’ compensation but had instead permitted him to use his accumulated sick leave credit for the time he was absent. Mr. Stankiewicz sought a hearing with the New Hampshire Department of Labor and after the hearing he was awarded worker’s compensation benefits. The city paid the award but asked him to repay the sick leave money he received because he had now received workers’ compensation benefits for that period. The city informed him that once he repaid the sick leave money, his sick leave credit would be restored. Mr. Stankiewicz refused to the repay the money, and his sick leave was not restored. And in September 2005 the plaintiff filed a declaratory judgment action seeking restoration of his sick leave credit. ISSUE: One of the issues was a Motion to Dismiss on the basis that the jurisdiction over this matter lies with an arbitrator and not the court. DECISION: The decision of the trial court was affirmed in part. REASON: The reason was that the plaintiff’s claim was based upon the Manchester Code of Ordinances (MCO) over which the trial court may exercise jurisdiction, and not the Collective Bargaining Agreement (CBA). I like the automatic enrollment of life insurance and the option to purchase additional insurance for spouse and children. Also, the payments to the City’s pension plan from both employees and employers and the option to have a portion of their pre-taxed earnings to be deposited in a flexible spending account or health care of day care. I like that they get paid 8-15 hours per month for vacation and the paid holidays they receive each year. Another thing is the nearby childcare center that offers discounts to employees who may need it. The one thing I find unreasonable would be the 10 hours of sick leave they can receive each month when they work. Don’t get me wrong I do like that it’s 10 hours per month but the recommendation of change I would have would be to accrue 8 hours of sick leave whether the employee is there each month or not. The only benefit changes I would recommend would be the hours of sick leave received each month.
