TPF #2 Healthcare: Liberty on the Line

This chapter of Uncertain Justice was much drier than the first, but I assume it would be difficult to have an entertaining prolonged discussion on the legal battle surrounding The Affordable Care Act and individual mandate penalty. It was very informative, though, and helped me better understand the ACA and the legal arguments both for and against it. To me, the chapter’s greatest strength was the non-partisan lense through which it was presented because I have never saw so much information on the topic that was free of political bias. I didn’t realize that the legal argument against the ACA and individual mandate was that of federalism. I knew it involved somewhat of an infringement of the rights of

13th Amendment Research Paper

...In a document written two hundred and fifty years ago, the Founders could not have foreseen what the United States has become: an economic powerhouse, a leader on the world stage, and a country attempting to extend liberty and equality to all. The document standing in the way of this equality is the Constitution, an outdated document with outdated values and ideals that cannot possibly be entirely relevant to today’s culture. While it would be impossible to radically change the current Constitution, or even draft a new one, the United States cannot rely on every word that the Constitution puts forth. It keeps the United States from becoming that utopia of equality, and ensures bipartisan arguing, a facet of American history that we have never been able to escape. To stop this from happening, one must look at the Constitution as a living document, one that undergoes societal change with the...

The organization conducts business with the use of a balance between a double bottom-line model. ...Couples Wishing to Undergo IVF Treatment Should Be Awarded the Legal Right to Choose the Sex of Their Child: Abstract: Sex selection, also known as gender selection, has attracted great interest and controversy over the years. Gender selection has been associated with a number of ethical, moral, social and legal issues. Sex selection may be performed for medical reasons to avoid sex-linked diseases or for parental preference. The topics I will be covering include eugenics, beneficence, utilitarianism and pre-genetic screening in regards to sex linked diseases. Eugenics can be defined as the study or belief in the possibility of improving the qualities of the human species. In the context of IVF, treatment positive eugenics encourages reproduction by implantation of healthy embryos with inheritable desirable traits and negative eugenics seeks to identify and dispose of embryos found to carry undesirable inheritable traits. Introduction: Utilitarianism in the context of IVF sex selection and genetic screening is defined by the principle of utility, which seeks to judge moral rules, actions and behaviors based on their consequences. Where an action produces the best possible outcome, that being the greatest good for the greatest number it is seen as ethical and moral. Therefore, the testing, screening and disposal of genetically impaired embryos and implantation of only healthy and preferred embryos is justifiable because the outcome...

Google Privacy

...Internet privacy has become a major issue in today’s society, with technology advancing leaps and bounds faster than laws created by our government. Many companies are now creating policies that are seen as crossing the line. Google’s policies are becoming even more argued and discussed than any other. Many believe that Google is infringing on the rights of both individuals and countries as a whole. The interpretation of these policies, in the legal realm, is very misunderstood and seen as muddy water. Google says that collecting information from its customers, is necessary to better serve, both, it users and advertisers. A wide range of industries have the possibility of being affected with the privacy policy changes of Google, including healthcare, research, education and many more. Information collected by Google comes from nearly all of their services, including, Google Health, which is a service that allows health records to be shared amongst medical professionals and the patient. Google Health, takes the patients personal health record (PHR) and uploads it to a data base, which is easily accessed. This service can expedite health services, but is also seen as a privacy risk. According to Colin P. McCarthy of the William and Merry Law Review, “There is concern that PHR venders, such as Google and Microsoft, are not governed by the strict privacy and security rules of the Health Insurance Portability and Accountability Act of 1996 (HIPPA) and are held to no other...

Affordable Care Act (Health Care Reform)

...Legal Methods and Process The Affordable Care Act ensures your right to appeal health insurance plan decisions which is when you ask that your plan to reconsider its decision to deny payment for a service or treatment. New rules that apply to health plans created after March 23, 2010 spell out how your plan must handle your appeal (usually called an “internal appeal”). If your plan still denies payment after considering your appeal, the law permits you to have an independent review organization decide whether to uphold or overturn the plan’s decision. This final check is often referred to as an “external review.” Many states offer help to consumers with health insurance problems. The Affordable Care Act improves these services with grants that help states start or strengthen Consumer Assistance Programs (CAPs). The states and territories that applied for these grants have received funds provide residents direct help with problems or questions about health coverage. Whether or not your state has a Consumer Assistance Program, you have rights under the health care law, including the right to appeal decisions made by your health insurance provider. If your state does not have a Consumer Assistance Program, some state and federal government offices may still be able to help you determine your rights and solve problems. Florida does not operate a Consumer Assistance Program under the Affordable Care Act. The new consumer protections and benefits of the law still...

Understanding Your Ethical Responsibilities

...Excerpted from The Tracks We Leave: Ethical and Management Dilemmas in Healthcare, Second Edition, by Frankie Perry, RN, LFACHE (Health Administration Press, 2013) CHAPTER 1 Understanding Your Ethical Responsibilities Hea lt h c a re l eader s and those aspiring to be leaders must recognize first and foremost that character and integrity constitute the very cornerstone of leadership. Organizations have failed and promising careers have been derailed when ethics have been relegated to secondary importance or, worse yet, ignored in the pursuit of more bottom-line considerations. Healthcare managers must understand their role and responsibility in creating an ethical healthcare environment that is honest, just, and always in the best interests of those being served. Whether you are the CEO, an assistant administrator, a department head, a program manager, or a clinician, if you are “in charge,” you have the ultimate responsibility for establishing the culture and setting the standards of conduct in your sphere of influence. This task is not always an easy one. Nor is it easy for well-intentioned managers to always make ethical decisions themselves. BARRIERS TO ETH ICAL D ECIS I O N M A K I NG In our book Healthcare Leadership Excellence: Creating a Career of Impact, James Rice and I identify some of the common barriers to ethical decision making and seven pitfalls for managers to avoid (Rice and Perry 2013, 29–37). Medical advancements coupled with research & development efforts have expanded the product base in terms of a variety of new treatments across numerous therapeutic classes. As depicted in the illustration below, the total global pharmaceutical sales reached $1,057,000,000 in 2014; based on the past 10 years we can expect the forecast to show a similar increase over the next few years. IMS Health Market Prognosis, May 2015 Of all the changes visible within the pharmaceutical market, there are a few that are truly revolutionizing the market: US healthcare reform, emergence of specialty product markets, price strategy & mergers & acquisitions. The healthcare market has changed under Obama, opening healthcare coverage to more patients & bringing forth treatment & medication to a larger population. The emergence of specialty products pose an entirely new challenge to the market in terms of the doctor’s prescribing habits, healthcare plan coverage & out-of-pocket cost to the patient. This along with other economic pressures brings an entirely new perspective to pharmaceutical manufacturers in terms of pricing strategy & overall price elasticity of demand. Additionally...
