...online mediation, the capability of online mediation to meet these needs, some common misconceptions accepted in the *29 legal-mediation community, the technological infrastructure on which online mediation takes place, and identifies some of the associated real world legal issues raised by technology. Part II discusses differences between physical presence face-to-face mediation and online virtual mediation, examines a sample of the many scientific studies of computer- mediated communication, and postulates how these studies should inform views on whether and when online mediation is feasible. Part III describes some existing online mediation programs as models of what might be and describes various software programs to facilitate the mediation process. Since no article on mediation would be complete without a simulation, part IV applies this Article's lessons to a paradigmatic hypothetical. Finally, the Article concludes by taking the position that although online mediation is still in its infant stages, it has the potential to provide new and creative methods to facilitate the resolution of the entire gamut of disputes from the easily resolved to those that are intractable. If online mediation is to be efficacious at resolving disputes, future efforts at online mediation must be informed by both the experiences of the mediator and the existing research in computer-mediated communications. I. PRIMER ON ONLINE MEDIATION At a minimum, online mediation is feasible...

...to court to resolve a dispute in China: negotiation, mediation and arbitration, they are ADR. ADR means “Alternative Dispute Resolution” and it refers to various processes, commonly used in civil law tradition, which have in common the aim of a better communication between the parties during a dispute and the saving in managerial and legal time, expense and worry (Bevan, 1992). We can clearly distinguish the advantages of the ADR, comparing to the formal dispute settlement at court. ADR processes are quicker, as they can be arranged within days or weeks rather than months or years (example of one case in litigation). They are also less expensive, as earlier settlements save managerial time and they are confidential. They are voluntary, which means that the parties are free to walk out every time without interfering the legal procedures and their rights (Bevan, 1992). Mediation, one of the most used ADR, involves a neutral third party, called a mediator, to help the disputing parties to reach an agreement. Mediation in China has been existed in China for more than 2,000 years. It was used in the Western Zhou Dynasty (1146 BC-771 BC) and then used during the Qin Dynasty (221 BC-207 BC). There was always a preference for mediation throughout all the history of Imperial China. The mediation system and the legal system were developed together after the establishment of the People's Republic of China in 1949. People's Mediation Committees appeared during this period, helping local...

...Running head: NONEMPLOYMENT CONFLICT MANAGEMENT Nonemployment Conflict Management University of Phoenix Nonemployment Conflict Management Policy decisions whether made in public or private setting require a careful analysis of including the possible outcome from implementation to stakeholders. No better example to the impact of policy decisions and the stakes it holds that in the United States political forum. Legislative decisions that impact the public are known to split the two aisles of the political spectrum; democrats and republicans. It has been argued that although the public may appear to be the major stakeholder behind the scenes the actual stakeholders are the big corporations. These corporations are known to lobby through vigorous negotiations on major policies by using their relationships, experiences and valuable insights of how “things” work in Washington. In the case of the Wamayo River Basin, the decision to preserve the salmon population conflicts with the economic development interests for hydropower, timber industry and agricultural development proponents. Indeed, the decision formulated is like walking a tight rope as it will create conflict given its impact on multiple stakeholders. Wamayo Dam, the company contracted to build additional dams along the basin has to identify the non-organizational conflicts that may exist given the multitude of stakeholders. For Wamayo, developing an astute conflict management will ensure...

...psychologists should mandate peer mediation programs for all students. According to Kathleen Winkler, bullying is defined as “Any kind of ongoing physical or verbal mistreatment, done with the intent to harm, where there is an imbalance of power between bully and victim. It usually, but not always, means a bigger, older child picking on a smaller or weaker one, or a more popular child on a less popular one,” (Winkler 15). The word ongoing is crucial to its definition because the victim is often bullied nonstop. In the book, Invitation to the Life Span, the author Kathleen Strassen Berger explains, “Almost everyone experiences an isolated attack or what is called a derogatory name at some point in middle childhood. Victims of bullying, however, endure shameful experiences again and again- being forced almost daily to hand over lunch money, laugh at insults, drink milk mixed with detergent, and so on- with no one defending them,” (Berger 306). There are several different types of bullying, physical bullying, verbal bullying, and cyberbullying; these are most common in schools. Bullies who take the physical approach often times cause bodily harm to their victims, where the bully has a bigger advantage against his/her victim. Those who are verbally bullying others use demeaning words to belittle their victim’s, leading to mental bullying. Verbal bullying is common amongst students in elementary school. Cyberbullying often occurs through technology, where victims deal with electronic...

...scheme was introduced. This scheme describes, as a kind of generic construct, how two actors come to an agreement about what is to be done. There is someone who asks for the work and someone to perform the work. There are several approaches to business modeling following the cfa scheme. The two most famous approaches seem to be Action Workflow [9] and DEMO [1]; see the article by Dietz in this section for more on the DEMO methodology. The general idea is to get a business model of how people, through conversation, coordinate their work. Such a business model, focusing on coordination, should be seen as foundational for the development of supporting software. The LAP spirit is to consider software as a tool for coordination. Associations, although autonomous and independent are all affiliated to the National Councils of YMCAs and do share a common mission and similar culture. By using the generic movement each of the students can draw on extensive and varied experience from their own settings. SECTION 1 The importance of working as a team and a discussion on how conflict can be resolved within teams The term ‘team’ is commonly used to describe many different groups both in a work setting and within wider society. Harvey Robbins and Michael Finley define a team simply ‘as people doing something together’ and Rob Yeung says a team is a ‘group of people with shared goal’. An element of inter dependency is also required before a group becomes a team and a more organisationally orientated statement from Rover Cars defines teams as 'a number of people with complementary skills who are committed...
