The question here is not whether ticket scalping should be legal or not. It is clearly stated in the laws of each State if ticket scalping is legal or not. For a full list of laws for each state concerning ticket scalping go to (Kaufman, Myles). The question here is if ticket scalping is ethical. Ticket scalping is also referred to as the second market. Whereas the venue who sells the tickets is the primary market. Ticket brokers sell on the secondary market. Ticket scalpers (aka the sales man on the street) sell on the secondary market. The venue (aka the primary holder of the tickets or the producer of the tickets) sell their tickets on the primary market (RockItOutBlog). People who do not want their tickets any more sell them on the secondary …show more content…
So, there is a limited market for selling tickets, just four different sellers. When considering the market of tickets there are only two producers, the venue and the counterfeits. There are two legal reasons why some scalpers are bad, this is not including all scalpers just the ones with low ethics. Easy tax evasion is the first one. When buying tickets off the street there is no receipts or digital trails only paper trails. A paper trail sounds like a good thing; but it is not because the government has no way to track them, therefor no way to tax them. Some may argue that taxation is theft, this is not the place for that argument. The second reason is counterfeit tickets (Stim, Attorney Rich). The scalper may be an honest man with no intentions of selling counterfeit tickets, but a scalper might get sold counterfeit tickets. Selling counterfeit goods is illegal. Selling counterfeit tickets not only cheats the consumer but also the venue who sells the tickets in the primary market. In some states where ticket scalping is legal, to cut back on the selling of counterfeit tickets; the scalpers are required to be certified which makes them more creditable. This

We compared the perception of tax evasion to twenty other offences, including violent crimes such as rape and murder and relatively minor offences such as jaywalking. Due to the recent focus by lawmakers and the media on white-collar scandals and the lack of comparisons in prior literature, we also included six white-collar crimes. Overall, the results indicate that tax evasion was viewed as only somewhat serious. When comparing tax evasion to other white-collar offences, we found that tax evasion was perceived as equal in severity to minimum wage law violations and rated less serious than the other four white-collar crimes investigated.
