Sex discrimination act 1975: this applies to men and women to promote anti discriminatory practice by making sure that both genders should be treated equally in employment, education and not the same. Without this act men and women may be deprived of certain jobs and choices.

Mental capacity act 2005: this act helps to protect people who are unable to makes decision, example of this is people with dementia, learning difficulties and mental problem. This act ensures that that people with mental capacity get treated fairly and in their best interest. It promotes anti discriminatory practice making sure that someone with the disability to learn can get the same choices as any other person would.

Disability discrimination act 2005 this act helps to stop discrimination which is aimed at the disabled example of this is when a disabled person is unable to go to a certain place or school because there isn't access for a disabled person example there's not lift or ramp in the building. This act makes it illegal to do things like that without a justified reason. Disability is not only physical, there other type of disability such as mental disability which is under the disability act but only if the mental illness affect the person's everyday life. This helps to promote anti discriminatory practice by making sure that all public sectors review their plans, procedure and practice so it can also be in favour of the disabled.

Nursing and residential care home regulation 1984: this applies individual in residential and nursing homes. they need to apply to their local council for a licence in order for them to operate which regulate their practice. This act promote anti discriminatory practice by making sure the service user is being treated with respect and the nursing home need to provide adequate care for the service user in other to ensure they are in the best care and are safe as possible, therefore if the nursing home does meet the required regulation they can be prosecuted example of this is they can be closed down.

Care standard act 2000: this act cover the care of individual provided by all care setting including foster care, family care, domiciliary care, nursing care and residential care. this act promote anti discriminatory practice as each service user has to be treated equally by the the staff and service provider and also they are being cared for in a way that it does not violate their human right.

CODE OF PRACTICE AND CHARTERS

Code of conduct established by a professional bodies this code gives guideline to the HSC professional on their roles, responsibilities and also their right. This is also something which you sign to say you will follow the abide by the rules and regulation.
This promotes anti discriminatory practice by sticking to the rule and regulation you are ensuring safety in the health and social care setting. Example of this is in a care home you sign and promise not to use phone while working, this helps to protect individual and gives them the respect they need and are allowed. Charters
Most health and social care professional and services user have charter, charter states individual rights.

How it promotes anti-discriminatory practice?
An example in a nursing home a service user is allowed to have a visitors whenever they want. this allows the service user to see their family because being in a nursing home means they are away from home which might lead to them be lonely and could often lead to depression therefore it is important that they have the right to see family. Another example is having a high standard of nursing care, being told of medical treatment this allows the service user to be kept up to date with their medication and treatment which they are receiving so are they know about their illness and this can also help them to fully understand their medical condition they are suffering from so they are able to make decision and get help and guidance. it is promoted by having signs in waiting room and leaflet which display important information to help service users understand.

Skills for care
Using pictures and explanation to explain what professional need to do within a health and social care setting this promote anti discriminatory practice by giving help and guidance on how to treat service users so that the staff are aware of what is expected from them. it used along with the law and informs between what is right and wrong so they can apply this within their setting for example in a nursing home they expect all staff working in the home should act in a professional and competent manner . the service user confidentiality must be protected, this means the individual is protected from anyone who tries to act against their information.

Organisational policies and procedure

Positive promotion of staff development and training

All staff is that work within the health and social care sector is trained to work professionally with individual that needs their services. By development and continuous training, staffs are constantly up to date with new legislation and policies. this promote anti discriminatory practice by ensuring all staff are up to date with new policies and legislation by doing this it promote anti discriminatory practice as it ensures that all individual receiving care receive care to the same great standard are treated with the same respect as everyone else is.

Positive promotion to individual right

The human right act is where everyone is entitled to basic rights, freedom, equality, fairness and dignity. This act will protect everyone in the society and in health and social setting no matter who the person is. If a person is not entitled to their human rights it's discrimination, this may be because of their race, religion, culture and sexual orientation. This act protects everyone to have their individual rights so that they can maintain independence. This promotes anti discriminatory practice as it allows everyone to have their own privacy, decision, freedom and non-discrimination should be taking place with this law in place. In a health and social care setting like a care home they are all entitled to their individual rights for example patients are allowed to have their privacy when getting changed, going toilet, or having their own space.

M1/D1
The dementia policy is where in England they are trying to provide a bigger increase in diagnosing dementia as it is one of the lowest in the uk. By having this policy in place people who have dementia will be diagnosed quickly and will be able to start treatment straight away, this will then present dementia matters getting worse here it's too late to do something about it.
This promotes anti- discrimination practice because it makes sure doctors give 65-75 year olds information about memory services and refers them for assessment if they need it so people's needs will be met and people will get right treatment. This promotes anti-discrimination as everyone in who is a older will get assessed and everyone will be treated equally and fairly is they even if they are different to other people due to their race, culture and sexual orientation. This policy also promotes this as well by launching a toolkit, which helps GP provide better services. This is important as people who have dementia will get better care and treatment due to the service being better therefore people's individual needs will be met and no discrimination would be taken place if everyone is treated with respect, dignity and has equality. i would rate the dementia policy a 4 as it’s not very clear on how it promotes anti-discriminatory practice for everyone that uses the service, however i rated it a 4 because it has action plans in place to improve the service for example, linking 54 million in funding for hospital dementia risk assessments to the quality of dementia. It is very informative and has facts about dementia and how they are going to make service better.

Strength of the policy
One strength of the dementia policy in promoting anti discriminatory is by having a latest integrated care, which has been put in place. This is when services work together in different care setting. Without appropriate co-ordination or holistic services won't be well co-ordinated therefore it could lead to confusion repetition, delay and people getting lost in the system. This promotes anti discriminatory practice as with this in place it promotes equal opportunities, interest, of the patients ensuring that health and care services are coordinated and meet people's needs
Strength of this policy was that they provided dementia training resources, which will help the carer have a better knowledge on what is expected of them and know what has been updated on the policy and know action plans. This will give information about dementia for people who don't understand what it is or are not familiar with the condition. People will gain knowledge so people know how to help them or know what to look out for. This promotes anti discriminatory practice as everyone will then know what dementia is and there won't presume it's only old people that get dementia.
Weakness
One weakness of this policy is that the policy does not state that everyone is allowed the information except 65-74 and might not be refereed to have assessment if they need it to check for dementia. Another weakness is that on the policy there is no symptoms which might be a cause by dementia so no one will know if they have it only people who know about the dementia itself. This policy also doesn't have any opinions and reviews of service users so they don't know what to expect or what the facilities are like so they can be improved. This will have huge effect on the practice has it ensure that all staff treat people with dementia equally. This policy is very important and useful however the policy should have had a wider age range because not only 65- 74 have dementia even a 10 years can have a dementia and also other people should been given information about dementia in other for people To improve their knowledge about it. All service user opinion should be taken and they should also know about the new policy so they are able to adjust and know what is been expected from the health and social care professionals.
