Intro Into Business Week 3

...Intro to Business Week 3 The United States has several laws that are intended to further fair, balanced, and competitive business practices. Do you think that such laws are effective? If so, why? If not, why not?  So the question asks if the several laws that the United States has to further fair, balanced, and competitive business practices are effective. My opinion not so much. There are many big companies out there that have stepped out of line and because they have good lawyers they are able to break those laws without getting penalized. However there are those occasions that those laws actually help out. One example is the Antitrust Law.  Also referred to as "Competition Laws" - are statutes developed by the U.S. Government to protect consumers from predatory business practices by ensuring that fair competition exists in an open-market economy. One particular company that plays with these laws is Walmart. Walmart has many stores throughout the country and for many people it is the only store that has what they need. It is the one stop shop for many people in the Midwest. They have taken over towns and cities promising to not harm small shops and to give back to the people and it communities. Walmart is using the antitrust law in in Europe so that they can be in Europe and be that Monopoly. So with that being said Walmart is very familiar with such law. Another example of this company playing with this law is with Coka-Cola. Coka-Cola had a product they were going to...

With so many outside venders and human resource issues in today's business world, contractual claims are going to be one of the common claims that arise on a regular basis in many businesses. The next primer you will prepare for your department's training series will acclimate your colleagues to the world of contracts. Prepare a 2–3-page, double-spaced document explaining the essential elements of a contract and the applicable remedies in the event of a breach. What is required for a valid offer? How can one accept an offer? What is the concept of consideration and what form(s) can consideration take in creating a contract? What factors must be considered in assessing the legal sufficiency of an offer, acceptance, and consideration in determining whether a contract is enforceable? In the event that a contract is formed and subsequently broken, what remedies are available to the non-breaching party under your state's law? Business plans are met through voluntary agreements amongst others. These voluntary agreements are also known as contracts. A contract focuses on holding a promise that is directed towards the future. Business cannot be successful unless people fulfill their promises. There also needs to be a system of punishment to those who break their promises. Making all contracts more of an obligation to complete, which allows business to continue today. Week 3 Contemporary Business

...Assignment 1 Dr. Brian Grizzell Contemporary Business January 27, 2014 Examine Apple’s current position on the company’s ethical and social responsibilities and determine whether or not the company has met these requirements/responsibilities. Provide two examples to support your decision. Apple Corporation has been known to have many successes and challenges in many years as it relates to their ethical and social responsibilities. In recent news, Apple has been under a microscope due to the suppliers that they employed to manufacture their products. FoxConn is a leading supplier of Apple that runs factories throughout China. In recent news, Apple has taken the heat for violations with this supplier due to workers working more than 60 hours a week with no off days, suicide threats, and low wage compensation, and dangerous working conditions. Although FoxConn is employed by Apple Corporation, it too must follow the company business conduct that applies to all its operations, including those overseas. Apple Corporation shows a true commitment to ensuring the highest standards of social responsibility wherever our products are made. They insist that their suppliers provide safe working conditions, treat workers with dignity and respect and use environmentally responsible manufacturing processes (Klein, 2011). The Code of Conduct ensures that Apple takes preventive measures in cases that involve the company and its employees in ethical issues. Through implementation...

Business Law Week 3

...Business Law Professor, John Becker May 17 2012 There are two elements of a contract, which are (1) an agreement; (2) legal obligation. To constitute a contract there must be an agreement. An agreement is composed of two elements, offer and acceptance. The party making the offer is known as the offeror, the party to whom the offer is made is known as the offeree. Thus, there are essentially to be two parties to an agreement. They both must be thinking of the same thing in the same sense. In other words, there must be consensus-ad-idem. All agreements are contracts if they are made by free consent of parties, competent to contract, for a lawful consideration and with a lawful object and are not hereby expressly declared to be void. Furthermore a contract is a legally enforceable promise or undertaking that something will or will not occur. There should be an intention on the part of the parties to the Law of Contracts agreement to create a legal relationship which may have elements in writing, though contracts can be made orally. A breach of contract occurs when a party who has signed a contract fails to live up to his responsibilities as specified in the contract. There is a range of legal remedies for breach of contract. For example, a person may be entitled to monetary compensation in the event that the other party fails to live up to the terms of the contract. A contract may also be canceled because of a breach or changed to include the terms the parties’ desire. In some...

Business Communications Week 3

...Revising has to do with “looking over” what you have already drafted. It somewhat goes hand-in-hand with proofreading, but in this stage you are searching out parts you may not like as much or parts that wouldn’t fit in with the message you want to convey. Rather than quickly looking over it as you would a text message, revision in the business world involves time and much attention. Not doing so can possibly cause frustration, confusion, and even delays due to the perception of your audience. More importantly, what your message comes out to be could reflect your character, and your way of thinking. It is easier to revise as you write, making it easier to revise later in your writing. You would also want to understand the purpose of your writing and sum up your audience by determining their needs. You’d also want to determine if you would be taking a direct or indirect approach, but you do not want to sound passive. Producing is the more creative part of the writing process. Depending on the medium you choose, a number of things can be done in order to produce or enliven your message. Whether you are formatting or wanting to add visual effects, these tasks would be considered part of the producing step. This involves graphs/tables, captions, fonts, margins, proper spacing, etc. Similar to revising, the main purpose of proofreading is to check for errors such as grammar, spelling, punctuation, missing sources, missing visuals, etc. It’s also good to make sure you’re following...

Business Law 415 Discussion Question Week 3

...In relation to estate law joint tenancy is a form of ownership of the same property by two or more people. The owners of the property are called tenants, and share equal ownership, and have full equal rights to property. The individuals, who are called joint tenants, share equal ownership of the property and have the equal, undivided right to keep or do away with the property. Joint tenancy generates rights of survivorship, providing that if a joint tenant should die then the remaining property will be transferred to survivors. Joint tenancy should not be used if the owners do not want the property title pass on to the survivor. According to the Free Legal Dictionary, joint tenancy is “adopted from common-law tradition, joint tenancy is comparative to another form of concurrent property ownership: Tenancy in Common, a less restrictive form of ownership that sometimes results when joint tenancies do not exist” (Free Legal Dictionary 2010). Several key characteristics that distinguish joint ownership from tenancy in common include, joint tenants own an undivided interest of the entire property; each share is equal, and no one joint tenant can ever have a larger share. This differs from a tenant in common because tenant shares vary in proportions; one may have a larger share of property than the other tenants or only a fraction. Another distinction is that the estates of the joint tenants are fixed and unalterable by any condition for exactly the same period of time such as, the...
