SUMMARY OF PROPOSED CHANGES

The existing lot 501 Hartsell Avenue owned by the Lakeland Housing Authority, which holds the West Lake Apartments, is requesting a variance to the Zoning Board of Adjustments and Appeals that will allow the redevelopment of the West Lake Apartments. The project is schedule to be completed in phases, in which phase I is design to hold a new three story independent living facility in the south portion of the lot, corner of S. Webster Ave and Herschel Street.

The lot zone is MF-22 Multi-Family Residential. Per Table 3.4-1 of the City of Lakeland Development Code the maximum setback to a local street is 20’ and the minimum frontage build out is 60%. In order to build the independent living facility on this lot, this variance request is to:

b) That the special conditions and circumstances do not result from the actions of the applicant and are not purely economic in nature.

c) That granting the requested variance will not confer on the applicant any special privilege that is otherwise denied by the provisions of the Ordinance, and that not granting the request will constitute unnecessary and undue hardship on the applicant.
The requested variance will not provide any special privilege to the Lakeland Housing Authority and denying the variance will result into

d) That the variance granted is the minimum variance that will make possible reasonable use of the land, building, or structure.

e) That granting the variance will be in accordance with the general intent and purpose of the ordinance, and the variances will not be injurious to the area involved or otherwise detrimental to the public
