...Areas for Consideration – Personnel Case Study 3 Is there a practice policy for sickness absence? If not written down, what is accepted practice? How well has this been communicated to all staff? How is this reinforced? How are the facts re sickness absence recorded? Is the procedure reasonable, fair and consistently adhered to throughout the practice? Are there systems in place for monitoring all absences? Were the assumptions and suspicions about alcohol investigated – any evidence? Assuming investigations and observations re alcohol were confirmed (ie evidence/observation confirmed by staff member turning up drunk, under the influence of alcohol, smelling strongly of alcohol), should this have constituted instant dismissal there and then? Consider what support/counselling/advice you would give any member of staff with personal problems which led to poor performance. Does the receptionist know that the situation now is clearly about discipline and what that involves? Has she acknowledged (1) understanding of why she has been disciplined and (2) receipt of formal final warning? Was a timescale for improvement implicit in previous warnings? Did the practice consider that there may be a genuine social problem underlying the “alcoholism”? If a health/social problem was identified, should the practice have considered giving guidance on access to counselling/support rather than discipline? Should the practice bite the bullet and accept...

...| Why was Microsoft Investigated for Antitrust Behavior? Karen Elmore ECON 312 Professor Guerman Kormilov Devry University Microsoft is a very large and diverse computer software company. It was investigated for antitrust behavior after there were reports that Microsoft was abusing their position as the leading supplier of computer operating systems. Lawmakers investigated to see if Microsoft was trying to create a monopoly of the computer software market. They found that Microsoft was trying to cause a monopoly in the computer industry. Here are the facts that support their findings. Microsoft developed Microsoft Office products that catered to the needs of professional in all types of fields, these products will only operate in a Windows operating system, which is a Microsoft system. When the early stages of the internet stared, Microsoft tried to push out and eliminate their competitors when it came to web browsing. It provided Internet Explore free of charge in all of their operating systems. This was at a time where people were being charged for AOL or Netscape Navigator. Microsoft was guilty of “exclusive dealing”. This is a regulation that gives them sole rights to a certain product. This prevented their competition from entering the market with their products. Microsoft used a pricing schedule which was a benefit for Windows users, but if you were on a different operating system products or services would cost more. This was often...

...How to resolve imbalances between market demand and constraints? How to resolve the uneven subsidiary capabilities? These are the main problems MNCs are facing today!!! Let us see how P&G European operations resolved this issue!? Company’s vision: To introduce their products worldwide and to create a winning strategy for the company. Historical practice in P&G European operations: - Subsidiaries were free to adapt technology, products and marketing approach to their local market What happened? - Inhibited product development - Company lost its ability to capture the Europeanwide scale economies - Poor protection of their product lines from the competitors Independent Operation/ more dependent on one person: Pamper’s experiment: P1, P2…Pn are different products of the same brand. Expected Result: To eliminate the diversity in brand strategy by coordination activities across the subsidiary boundaries. Actual Result: Failure Why?? - Ignored local knowledge - Under-utilized subsidiary strengths - Demotivated the country’s managers – they were not given any responsibility for the sales performance of the brand in their areas so basically no commitment. So the company came up with other strategy Interdependent operation / Distributed responsibilities - They were finding a way to exploit the expertise of national units - The responsibilities were distributed amongst the subsidiaries So what they actually did? The...

...Monopoly is nearly always seen as something undesirable. Courts have wrestled with monopoly for ages, sometimes defining it as: "the power to control prices and exclude competition", "restraining trade", or "unfair and anti-competitive behavior." Should monopolistic practices be condemned and outlawed? Let's look at anti-competitive behavior and practices, but let's not confine ourselves to what's traditionally seen as monopoly. Monopoly means that a firm is sole seller of a product without any close substitutes, controls over the prices the firms charge. Government sometime grants a monopoly because doing so is viewed not only to be in the public interest, but also to encourage it with price incentives. However, monopolies fail to meet their resource allocation efficiently, producing less than the socially desirable quantities of output and charging prices above marginal cost. Thus, this inefficiency of monopoly causes the quantity sold to fall short of social needs. Law The existence of a very high market share does not always mean consumers are paying excessive prices since the threat of new entrants to the market can restrain a high-market-share company's price increases. Competition law does not make merely having a monopoly illegal, but rather abusing the power a monopoly may confer, for instance through exclusionary practices (i.e. pricing high just because you are the only one around.) It may also be noted that it is illegal to try to obtain a monopoly, by practices...

...Are seatbelts necessary “We have all heard the excuses before, it’s uncomfortable, I'm only going around the corner, I'd rather be thrown out of a car than be stuck in a seatbelt and my favorite, and I’m a good driver I don't need to wear one.” These are just a few quotes I am sure we have all heard when it comes to buckling up. Guess what accidents happen! Seatbelts are designed to help protect you in case of an accident. Some people argue that seatbelt laws infringe upon a person’s civil liberties and since in some instances seatbelts may cause injury or death, that the government has no right to force a person to do something that may be endangering ones safety. Benjamin Franklin once said, "They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety”. Firstly, seat belt use should not be mandatory because seatbelt campaigns spend millions of taxpayer dollars that could go toward funds for causes such as schools and charities. We pay taxes, right. In addition, our taxes are supposed to go to the government to be spent on causes that help the population, right. Well, would you want your hard-earned money spent on enforcing an unjust law? Dr. Walter Williams states, in an article published September 10, 2003, “Under the Transportation Equity act for the 21st Century, the federal government is spending $500 million to enforce seatbelt laws.” Do you want your taxes to be spent on enforcing a seat belt law? Think of all the...

...ADELYN D. CABUEÑAS ASCT/AS101A PROFETH1 “TAKING CARE OF AN EGG” “Effort is the best way of showing how much you love, care, and value someone even without commitment”. For the past few weeks taking care of this “special thing” has been one of my priorities. Maybe it’s not the best among the rest, but I know that I give my 100% effort in taking care of my EGG. During the day when our Prof. told us that we have to bring an egg for the next meeting, the first thing that popped in my mind is that we are going to cook some egg recipe. I know it sounds funny to think that cooking is not even our subject curriculum. The following day she ask us if we bought the eggs that she told us to, and when we told her yes she then signed each egg. After that, Mrs. Danila announced that we’re going to take care of the egg for the whole midterm thus 50% of our grade depends on how good we handle those egg. Going home with the egg in my bag makes me feel so anxious, I was like a paranoid girl in love whose afraid, to break and lost her most precious guy. Well I guess the reason why I’m afraid to break my egg is that I don’t want to fail, coz’ failing for me is like losing a big chance. That day, when I got home the first thing I did was look for something cute where I can place my egg that I can consider safe and comfy. I ended up buying a cute dark blue box at the National Bookstore, but I find its color a bit boring so I decided to buy a violet colored paper to...
