...Paternalism, as defined by Richard Thaler and Cass Sunstein, is an act that attempts to influence the choices of others in such a way that those others will be better off, and that these others would agree that they are better off. A less coercive form of paternalism is known as libertarian paternalism. Libertarian paternalism is when policies are designed to influence people to make certain choices without limiting their liberty or options. The means by which people are to be influenced to make these decisions are known as nudges. Nudges are factors in a choice that will change individuals’ behaviors in a way that the person nudging has anticipated. Thaler and Sunstein are advocates of nudges and see libertarian paternalism as a nice medium between outright coercion and complete free choice. They make the claim that libertarian paternalism can help anticipate and correct certain instances in which a person does not make decisions in their best interests. Daniel Hausman and Brynn Welch of the University of Wisconsin, Madison, contend that the definition of paternalism put forth by Thaler and Sunstein is wrong and that nudges are, in fact, paternalistic. Their study aimed to provide further evidence on the effect of the agency theory in incentivizing the agent by providing financial rewards particularly in professional organizational settings. There is much debate in the field about the real benefits of financial incentives on human behavior management in the workplace. The subject remains controversial and many studies have provided equivocal results. Their study exposes that physicians in the test group responded differently to the financial incentives offered based particularly on their belief in the importance of the goals or on their feeling of having their autonomy undermined (Young, et al., 2012). However the results are not conclusive and hinge largely on the underlying motivation and attitudes of the professional test subjects themselves and how they perceived the incentive scheme. This research is a loose experiment in a narrow field of professional organisation, however the results of this study do provide some insight into the motivation behind and acceptance of pay for performance schemes by those in a professional field with a certain level of autonomy. A huge false-billing lawsuit has been launched against Miami-based Vitas Healthcare, one of the nation’s largest hospice providers, accusing the organization of collecting tens of millions of dollars through unjustified and inflated bills (Lamendola). The suit came after four years of investigation in which the government found that eleven smaller hospices had been over-billing. Those hospices had to pay $88 million in settlements. And in January the government joined a lawsuit accusing Hospice of the Comforter near Orlando in phony billings at an estimated $11 million. The federal Inspector General’s office overseeing Medicare has placed hospice overcharges among one of its investigative projects for the year. They have also proposed tightening billing codes that hospices have used to increase Medicare payments six-fold since 1998 (Lamendola). Paul Ledford, executive director of the Florida Hospice & Palliative Care Association says that although hospice has escaped scrutiny over the years, they are getting more attention now.
