...According to the Miriam-Webster dictionary, affirmative action is defined as “an active effort to improve the employment or educational opportunities of members of minority groups and women” (Miriam). Many people feel that affirmative action is necessary to either counteract injustices or ensure the advancement of certain minorities. There are four justifications generally pointed out by affirmative action exponents. These are racism, poverty, diversity, and the problem of underrepresentation. Supporters point out that many blacks, Hispanics and Native Americans live in substandard housing, go to substandard schools, and live in crime ridden neighborhoods. They also claim that they are targets of daily racism, hindering their chances for advancement. Proponents point to small numbers of these minorities in certain desirable jobs (i.e. CEOs of corporations and high elected office) as evidence of underrepresentation of minorities and a need for diversity both in the workplace and in higher education. There are a number of different levels of affirmative action, including quotas, preferences, and outreach, in lessening order of severity. Quotas, also called “set asides”, deal with having a definite amount of jobs or college spots reserved for a particular group. For example, if a university admits 1000 students every year and sets aside 150 seats that are open to blacks only, this is considered a quota. ...31 Intersection between Shari' a and Reproductive and/or Sexual Health and Human Rights OLAIDE ABBAS GBADAMOSI* Shari 'a has become an important feature of the legal system of the Muslim world with its attendant implications for reproductive health and human rights. Like other religious doctrines, Islam has been used to legitimize conflicting positions on gender and reproductive choice. In some cases, women were being denied rights by those who claimed to be acting in the name of 'Islamic' laws. some of which are incompatible with internationally recognized human rights. This article identifies selected sexual and reproductive health issues at the intersection ofreproductive rights and Shari 'a e.g. adultery (zina), inheritance, child marriages, polygny, and violence against women and considers how their shared concerns may prompt actions leading to the elimination of religious and cultural barriers imposed by Shari 'a which impede the implementation of international legal frameworks and consensus documents on reproductive rights. Nigeria is selected as a case study on the nature of implementation of Shari 'a law and reproductive rights. The article calls for more progressive interpretations of Islamic law to be codified in legislative reforms and/or seek to interpret Islamic law in harmony with international human rights standards and calls for the implementation of Shari 'a that would promote respect for human rights. Ever since I have started to study Geography, I wanted to write a thesis that would be read by more people than only my supervisors and would prove to be useful in some way. A traineeship during my studies as well as various projects and a general interest to discover the ‘mystery’ called India had brought me to the subcontinent several times since 2002, and it was soon clear to me I would focus on a topic in the Indian context. Even before I visited India for the first time I knew that it was not only about the Taj Mahal, tigers and finding enlightenment in some yoga class, but also about development, poverty and caste. Once in India, the contrast between vibrant economic development and widespread poverty became more than obvious, but the idea of caste remained somehow ambiguous. As foreigners are often only able to speak English, they can only communicate directly with those strata of society who also speak this language – most often these are not the poor or deprived of the Indian society, but those at the ‘upper’ end. Hence, I was assured many times that the caste system “does not exist anymore”, that the Untouchables live in poverty because they are “lazy”, that they “don’t want to do anything else than sweeping and cleaning”, or questions about caste were just simply ignored.
