PREFACE Rationale We agreed to produce the instructor’s manual for the sixth edition of A First Look at Communication Theory because it’s a first-rate book and because we enjoy talking and writing about pedagogy. And while other comedians show us persons tormented by bad luck and enemies and so on, Bob and Ray’s characters threaten to wreck themselves and their surroundings with their own stupidity. There is a refreshing and beautiful innocence in Bob’s and Ray’s humor. Man is not evil, they seem to say. He is simply too hilariously stupid to survive. And this I believe. Jerome Klinkowitz, in the introduction to his essay collection entitled Vonnegut in America, has used this quote—as he certainly should—to support his claim that Vonnegut’s humor has its roots in the comedic response to the Great Depression. But of course there is much more to it than that. The reader is left with a nagging question: Were humanity’s case really as Vonnegut describes it, and were this truly his belief, wouldn’t it seem that the only appropriate response would be for Vonnegut to sit and laugh quietly at the antics of the doomed race? Asked why there are so few black coaches in basketball, Jimmy ‘the Greek’ Snyder remarked that black athletes already hold an advantage as basketball players because they have longer thighs than white athletes, their ancestors having been deliberately bred that way during slavery. ‘This goes all the way to the Civil War,’ Jimmy the Greek explained, ‘when during the slave trading . . . the owner, the slave owner would breed his big black to his big woman so he could have a big black kid, you see.’ Astonishing though it may seem, Snyder intended his remark as a compliment to black athletes. If black men became coaches, he said, there would be nothing left for white men to do in basketball at all. Embarrassed by such rank and open expression of racism in the most ignorant form, the network fired Jimmy the Greek from his job. Any fool, the network must have decided, should know that such things may be spoken in the privacy of the 95 locker-room in an all-white club, but not into a microphone and before a camera. ...Introduction From 1894 to 1899, Captain Albert Dreyfus, an Alsatian Jewish artillery officer, languished in prison on Devil's Island after the French Army General Staff wrongfully convicted him of treason and espionage. The campaign for his release, organized by his family and supporters, along with revelations of an army cover-up, saw the so-called “Dreyfus Affair” become the major focal point of French public discourse at the turn of the century. Partisan camps of “Dreyfusards” and “anti-Dreyfusards” waged a war of words against each other as they debated Dreyfus' innocence and, implicitly, what it meant to be French in the Third Republic. Marked by an effusion of antisemitic vitriol, this debate has been characterized by Frederick Brown as a polarizing battle between two rival visions of France.[1] This battle at times extended to the streets, as it did in response to the publication of Émile Zola's 1898 “J'accuse.” Zola's open letter indicted the Army General Staff for antisemitism and cover-up, and prompted reactionary riots across France, the most violent of which occurred in French colonial Algiers. He was the son of Philip II, the King of Macedon who conquered Greece in 338 B.C. but was assassinated soon thereafter. Alexander thus became king at the age of seventeen (in 336 B.C. ), and at the age of twenty he set off to conquer the known world. In a series of lightning campaigns he conquered the Persian Empire that had until then been invincible, and in a certain sense he avenged Greece for the earlier Persian Wars. He marched through Asia Minor, Syria, Egypt, Mesopotamia, and Persia, conquering all before him. In monumental battles he defeated the Persians at Granicus (334 B.C.), Issus (333 B.c.), and Gaugamela (331 B.c.). He drove his soldiers on, crossing the mountains and deserts of central Asia, until he reached the borders of India (326 B.C.). There he finally turned back, retreating to Babylon, where he established his court. At Babylon he fell sick and suddenly died, at only thirty-two years of age (323 B.c.). Alexander hardly had time to organize his new empire, and this makes it all but impossible to know how he would have been as a ruler, instead of a conqueror. After his death, Alexander's empire fell apart and was ruled by his successors, Macedonian generals who became kings of independent areas. MADISON* ABSTRACT More than 150 years into development of the doctrineof "fairuse" in American copyright law, there is no end to legislative,judicial, and academic efforts to rationalizethe doctrine. Its codification in the 1976 CopyrightAct appearsto have contributedto its fragmentation, rather than to its coherence. As did much of copyright law, fair use originated as a judicially unacknowledged effort via the law to validate certain favored practicesand patterns.In the main, it has continued to be applied as such, though too often courts mask their implicit validation of these patterns in the now-conventional "caseby-case" application of the statutoryfair use "factors"to the defendant's use of the copyrighted work in question. A more explicit acknowledgment of the role of these patterns in fair use analysis would be consistent with fair use, copyright policy, and tradition.
