Anthony's Dilemma Case Summary

...Anthony Macias’ assumption that his participation in the weekend golf game could be a reasonable expectation of his work, and hence should be compensable. The rule governing this claim is a statute, California Labor Code § 3600(a)(8). The rule states: An injury is compensable if the injury arises from the scope of the employee’s employment. For off-duty events, an injury is within the scope of the employment if participation in it is a reasonable expectancy of employment. Reasonable expectancy is split into elements of subjective belief and whether that belief is objectively reasonable. ...employee named Tony and his supervisor Herman. The definition of the FMLA is discussed, covered persons, and employer eligibility. As relating to the video, an explanation of whether or not it matters that a parent’s involvement determines a child’s participation is discussed, whether the size of a business matters, whether or not Herman can imply Tony’s employment status when he returns back to work, and to what extent can an employer make their own decisions and eligibility determination concerning FMLA. In explaining whether or not the relationship between a child and his parent has any bearing on The Family Medical Leave Act of 1993, let me first explain what the law entails. This a law that grants employees entitlement of up to 12 weeks unpaid leave while protecting their job upon their return (http://www.dol.gov/cpmpliance/laws/comp-fmla.htm). The time off allows for employers to take time off for their immediate family such as parents, and children and also their spouse should they suffer from a health condition that warrants their care (http://www.dol.gov/cpmpliance/laws/comp-fmla.htm). The law does not specify whether or not that parent had anything to do with parenting that child but the fact that they are the parents. Like the case in the video, Tony talked about the fact that his father was very ill coming out of a nursing home and was going to need to live with him. He further explained that he didn’t have a relationship with his father because he wasn’t in...

An Education on Educating

...advantages and disadvantages of being educated. When Malcolm X states, “My homemade education gave me a little bit more sensitivity to the deafness, dumbness, and blindness that was afflicting the black race in America” (Malcolm X 232), this idea could be applied to every race on every continent and in all facets of life. Through out all three selections the apparent theme is the importance of total immersion into the realm of self-education. In the cases of both Fredrick Douglas and Malcolm X, without education neither man would have lived out the life he did. It is also safe to presume that with out the facts of slavery, the motivation behind the two men’s education would have been lacking. In Douglas’ instance being a slave in the first place started him on the path of education. He mentioned, “The first step had been taken, my mistress in teaching me the alphabet, had given me the inch, and no precaution could prevent me from taking the ell” (Douglass 223). When Douglas learned to read, it helped him to understand the gravity of the situation he was in and to what extent it would take to get himself out. Like Douglas and Sedaris, education gave Malcolm X the feeling of being “mentally alive” (Malcolm X 232). After using the dictionary to learn to read, he later ingested such novels as Uncle Tom’s Cabin, The Story of Oriental Civilization, and other books about races struggles for existence. Both Douglas and X have made an important connection between educations vs. mental slavery...

Starbucks' Customer Satisfaction

...courteous way, with a smile, to remember regulars and treat them as such. They find a way to incorporate the customer’s name into the order; they even greet regulars by their drink order instead of their name, and people love it. Those few things create the ‘Starbucks difference’ and have produced a long-term cult following unlike anything I have ever seen. While this is a very simple strategy, very few companies come close to doing any of this. Starbucks’ President, Howard Schultz, pointed out in his book, Pour your Heart into It, Starbucks is today’s ‘third place’ for people, a place away from work and home where they can safely connect with others area, a coworkers asks that employee: ‘Have you seen Beth’s new haircut?’ Because the salon doesn’t have an employee named Beth, it is a polite way to make the employee aware that she may want to change the topic of conversation. What does Starbucks really sell? Places like Starbucks and Seattle’s Best Coffee aren’t selling an expensive cup of coffee; they are selling really inexpensive rent. Think...

Thus, the same cost of lumber would be assigned to a sofa or chair regardless of which grade is used. This approach has some drawbacks. Intuitively, the higher grades should cost more. ...Hallmark English Comp 1 3/18/2014 Source Summary Living to Work Sayers, Dorothy, Living to Work. Dorothy Sayers was displaying her views on the working people of the world as she sees it. She believes that out of all these people there are only two groups to be classified in; the people who live to work and the people who work to live. Her purpose in writing this was to convey how she feels about the much divided classes of work. The theme of this essay is the attitude the masses have towards work in the modern era. The work to live group hates the mundane jobs they occupy while the other group, the living to work category, love the occupation they chose for they are able to gain a sense of completion from their crafts. In class we are focusing on the future jobs that we have in mind and the life that will be a head of us. In this story we are able to see two different types of work and taking that into consideration apply that to what we have planned for ourselves. Do we want to take a career for money, love or convince? My first thoughts during and after reading were that this author believed there to be no grey lines. That there are the ones that hate and the ones that love their work. That the society sees a successful job as one that makes one wealthy, not one that that being moral comfort. That the world has become obsessed with the idea of success being something that gains money or fame, not something that will help others directly or works smaller than some...

Employee Conflict Management

...Employee Conflict Management Reductions in force are not a pleasant situation for the employees of a company. I discovered through this simulation that reductions in force are not pleasant for the employer either. Being told a certain number of people have to be laid off presents a problem. People who have good productivity, attendance, and “wow” factors are those that a company wants to keep. However, the company has to consider discrimination when conducting layoffs. What may seem like a good reason for laying someone off may be a reason for an employee to file a lawsuit against the company. During my initial view of the candidates selected for potential layoff, I looked at the skill sets. Although my father works with computers specializing in Linux, networking, and Oracle, I have no knowledge in it myself. I felt like laying-off Carl Haimes or Brian Carter would be a mistake because I do not have skills that can match their skills. Sarah Boyd, Nora Manson, and Jenny Mills each have jobs that I could perform. Even though I may not excel in each job as I would prefer, I felt like it would be easier to cover those positions within the company than those of Carl and Brian. I also considered absenteeism and special achievements as well as overall productivity. Before I made my final selection, however, I considered discrimination. If I were to layoff Sarah, Nora, and Jenny at the same time, I could have a potential lawsuit regarding gender discrimination to consider. I decided...

A Problem Exists

...A Problem Exists William Baughan Prof Valentine ENG 215 11/5/2013 A Problem Exists The liberals in our political system have always tried to get rid of guns that they are a danger to us as a society and the conservatives and libertarians follow the Second Amendment of our Constitution. The Second Amendment gives us the right to keep and bear arms as well as protection from others. I believe citizens should be permitted to carry concealed weapons in their workplaces, such as schools and offices, which would deter criminals, increase security, and create an atmosphere of safety. Homicides by weapon type, 1976-2004. Gun-involved homicides have increased since falling to a low in 1999. Homicides by weapon type, 1976-2004. Gun-involved homicides have increased since falling to a low in 1999. (Berry, 2013)First, gun violence has been a topic of conversation in the political arena for a long time. The most common gun violence as well as violence by itself occurs in poor urban areas usually associated with gang violence. There has been a lot of school shooting such as the Virginia Tech shootings and Columbine high school massacre. It’s almost like clockwork when mass shootings occur there will be a debate on gun laws. Politicians have sought for the correct balance between what regulations to add and what not to add. Second, there has been an increase number of violence in schools that usually involve guns. Every day you turn on the news or read...
