Problemas específicos * La compañía se enfrentaba a una disyuntiva: cooperar con un régimen político represivo como lo es el gobierno chino, mediante el flujo de información de consumidores que atentan contra los derechos fundamentales básicos de los mismos o dejar de lado la cooperación para garantizar el mínimo daño a los consumidores, siguiendo un esquema ético de hacer negocios en países “offshore”. * Una empresa multinacional de imagen global como Yahoo, debe proponer prácticas competitivas y eficientes en un país externo que promuevan la mejor calidad de vida de los ciudadanos, poniendo en práctica políticas éticas y valores intrínsecos. Proponer un argumento legal como defensa de solo “cumplir” la ley como obligación, deja en constancia la falta de interés en reconocer y proteger los derechos humanos fundamentales. * La compañía ingresa al mercado con la intención de promover actos democráticos, pero al tener una cooperación directa con el gobierno sin mitigar o minimizar esta relación, al por ejemplo, dañar los derechos fundamentales básicos de ciudadanos chinos, está únicamente incentivando a resistirse a una reforma y mantener el autoritarismo. * Las acciones que fueron tomadas por la compañía, al revelar información privada, determinan esa falta de libertad expresiva política y social que ellos mismos promovían al tener presencia en el mercado chino. * Es importante determinar los pros y contras de hacer negocios en un país autoritario como el régimen chino, al garantizar un internet censurado se está ayudando a promover la democracia por una mayor interconexión y comunicación, pero esta forma de hacer negocios en base a la cooperación con el gobierno chino puede generar efectos secundarios como suprimir la libertad de expresión, dañar éticamente y moralmente valores fundamentales reconocidos por la ONU y las políticas mismas de la empresa aplicadas globalmente. * La compañía principalmente se vio afectada por el status quo y el proceso legal chino, de manera que para hacer negocios en China tenía que cooperar con el gobierno, generando externalidades negativas en sus clientes al perder confianza, credibilidad, protección y valores fundamentales morales que sus clientes habían depositado en ellos. * Ofrecer e-mail y servicios de blog fue contraproducente para Yahoo ya que estaban obligados por la ley y procesos legales del régimen represivo chino para divulgar información de cualquier cliente.
