Ms. Fernbacker was born on April 1, 1975 . She has been married for the last ten years and has one child, Coral Elizabeth Fernbacker. She is 6 years old. Ms. Fernbacker has been unemployed since 2006 when she was a clerk at Stop and Shop. She claims that they have been homeless since before the accident and that they lived at 1815 University Avenue in the Bronx. Just before they lived there they were living in a basement apartment in Maspeth for two years and they had to leave because of a fire hazard that the Fire department discovered. After the fire they lived in a hotel for a couple of days and then they moved to another hotel for 3 months. They also complained about the latch where the fire escape is located wasn’t functioning. After this visit by the caseworker another visit was made by New City workers( they had I.D) a few days later and Mr. and Mrs. Fernbacker made some complaints. The witness doesn’t remember if any inspection of the tub or the latch was made. However, the witness doesn’t remember if they signed any paperwork. The City workers said they would see what they could do and they signed some paperwork (CRF operation department for 12/20/12) . The witness doesn’t remember if anyone else came to the apartment before her husband’s accident. The witness saw the super before the accident but never spoke with him. The witness never spoke to anyone who was a property manager. A couple of days before the caseworker came the witness stated that she fell in the tub but she didn’t hurt herself. However, she did slip and almost fell all the way down. She claimed that it felt like she was standing on a hill and the tub was unsafe. She told the caseworker that she hurt her arm on the
