This is regarding an embezzlement case that was brought to my attention. Options for the company: “The investigation of a white-collar crime like embezzlement is difficult due to a lack of physical evidence. Accusations of embezzlement do not take place after a violent act and proof of wrongdoing requires extensive research. You need to take the right approach in order to legally investigate and prove embezzlement.” (eHow Contributor, 2012) There could be a number of options for the company to take for the embezzlement case. I would recommend them to hold back and get as much information as possible before the confront anyone. This way they have a stronger case, if they question anyone right away then the embezzler has a chance to get rid of any kind of any evidence that would destory him at a trial. Paying attention to all the telephone, company emails, and all the internal records will help with determine if he has been embezzling from the company. By looking at the call log can determine who would be helping him. By having someone call the hotline and giving very important information helps stop this kind of crimes. Having the right people working the hotline and asking the right types of questions makes the investigation go smoothly.
Steps for the Interview: There are a few steps that need to be done before anyone can start interviewing. You will want to gather as much evidence as possible to have a stronger case. Embezzlement is something that is hard to prove with little to no proof. Having an anonymous tip is not enough proof to go on. Not saying anything to anyone will be more helpful. “Hire a forensic accountant or other specialist in finding financial discrepancies to determine if any fraud has occurred. Forensic computer experts are often able to recover deleted or concealed data and can track the online activities of a computer user.” (eHow Contributor, 2012) Seeing if they maybe were using the companies email or a company cell phone: to help do any fraud dealing with the company. Requesting any information from the cell phone records or old email: to help find anything that may provide the company with any help catching them in the crime. Also, checking any cameras that the company might have that would show any kinds of crime that might be going on when the employee is working or not supposed to be on the job. Seeing who he may be close to that could be helping him with the embezzlement or hiding the information. This could also help with seeing if the CEO and CFO are in on it or not, this will also show them that just because they might trust someone don’t mean they are good people. If you have notice that one of the company’s employees are living above their means by coming into work fancy new cars, or buying new houses. They might be taking frequent vacations and throwing money around. They start to throw major parties for everyone or giving out very expressive gifts. Spending more money than they are getting paid then something might be going on.
Interview of Witnesses: By talking to the people that works with him often or that are very close to him inside and outside of work that are during the time that are being question. This will give more information of who might be working with him or covering all this up so that he doesn’t get caught. Ask them if they ever seen anyone he worked with. Where might he go out to eat to see if the company ever pays for lunches or dinners? Trying to find out how he can afford the lifestyle he is living. I would also talk to the security guards to find out when he comes and goes during the period of time that is in question. Finding out when he did his work the most. Trying to find out if he is really embezzling from the company will not be easy. See if they are working long hours during the week or even coming in on the weekend to work long shifts. See when the times have changed. This will give more information to when they would have started stealing. They might not just stealing money but also time as well getting paid for being at work but not really working the whole time, just coming and going when they want. Then I would look at the bank. “Place bank records from the defendant next to the accounting records of the employer as you investigate embezzlement. You should point out large deposits and calculate the amount of money missing from corporate budgets to assess the likelihood of embezzlement.” (eHow Contributor, 2012) I would also look at the phone records and the emails that where sent be this during the period of time.
Plan Controller Interview questions: Getting a lawyer to do all the interview might be the best thing to do. This could be nothing or this could be something major. By having a lawyer doing the interview this could protect you from any defamation claims and protect you from any liability of the embezzlement. You want to protect yourself and the company from any further harm. Making sure that you ask the right questions making sure that you get all the information you need. By writing all this down or have them write their statement and sign the document at the end. To make it even more legal have all the documents notarize. Asking the same questions or the same procedure this way you don’t get confused or if this does go to court there will be no miss understanding to why you asked those questions to that person. Last, I would question the person that is being accused of the crime. Having everything that was found in front of me to show that we do have a case and will hold him accountable for what was done. Making sure that everything they have done is on paperwork and video if there are any. Showing them that you know what was going on and that you have all the evidence you need to go to the cops will make them worried.
