(10 points) The administrative agency I have chosen is the Federal Motor Carrier Safety Administration (FMCSA) and the proposed regulation is “Qualification of Drivers; Exemption Applications; Vision”. Although the proposed regulation does not affect the business I work for directly, it does however affect all motorists including myself using state highway everyday to commute. I selected this agency because it deals with the safety of commercial motor vehicles (CMV) and truck drivers. Like myself, there are many people out there who are usually afraid when driving passing these commercial motor vehicles and often worry about its safety. The proposed regulation is the most current one for the administration hence the main reason why I selected it, but it also interest me because am very curious as to the safety of commercial motor...

...Dorothy Scroggins GM520 - Week 2 Assignment Administrative Law Assignment SEP10 1. State the administrative agency which controls the regulation. Explain why this agency and your proposed regulation interests you (briefly). Will this proposed regulation affect you or the business in which you are working? If so, how? I chose the Department of Public Safety, Division 45: Missouri Gaming Commission, Chapter 5: Conduct of Gaming. One of the many benefits Casinos love to share is that money from their profits will go to a public school fund. 2. Describe the proposal/change. The Gaming Commission is proposing an amendment to 11 CSR 45-5.051, Minimum Standards for Blackjack. The amendment will allow a floor supervisor (Pit-Boss) may direct the dealer to shuffle the cards after any round of play is completed and all wagers have been resolved. It won’t affect me directly but depending on how the Pit-Boss uses this internal control method, it could help or harm the Fund that is generated for Public Schools. Shuffling the cards in the middle is a deck is used to stop the current momentum. If the player(s) at the table are hot then this can break a streak that is cutting into the Casino’s profits. In this case it’s a win for the Public School Fund. 3. Write the public comment which you would submit to this proposal. If the proposed regulation deadline has already passed, write the comment you would have submitted. Explain briefly what you wish to accomplish with your...

...Rating Agencies - What does the Watchlist tell us? Christina E. Bannier, Christian W. Hirsch (2010) Executive Summary In the “Economic Function of Credit Rating Agencies” by Christina Bannier and Christian Hirsch (2010), the authors researched whether the economic role of credit rating agencies have been enhanced after the introduction of Watchlists. Therefore, the focus of this paper is to analyze the shift in function of credit rating agencies from a passive player providing creditworthiness certification to a more active credit monitoring entity. First, the paper examines if the Watchlist instrument changes the informational content of credit ratings. Next, the paper tested between two different explanatory lines regarding the function of the rating agencies by analyzing their use of the Watchlist as delivering information to market participants and creating an implicit contract to influence a firm’s risk choices via the threat of a credit downgrade. They find that the general market reaction to downgrades is stronger in the post-Watchlist period, which is consistent with previous research conclusions. These results hence indicate that the informational content of rating downgrades has strongly risen after the introduction of Watchlist. Additionally, the authors find that direct rating downgrades trigger a much stronger market reaction than watch-preceded downgrades. These findings support previous conclusions by Cheng and Neamtiu on whether and how rating agencies respond...

...did Congress create administrative agencies? The administrative agencies were created by Congress because they felt that the anticompetitive conduct of railroads and other corporations could best be controlled by separate administrative agencies with defined statutory mandates. Also during 1929 because of the stock market crash and the beginning of the Great Depression Congress felt the need of additional agencies to assist free-market economy and to act in the public interest, convenience, and necessity. 19-2 What are the two major functions of administrative agencies? The first function is rulemaking, where agencies are authorized to create new regulations by virtue of their enabling statutes; if they are not agencies, they need to follow the three ruled making models which are formal, informal, and hybrid outlined in the APA (Administrative Procedure Act). The Second Major Function is the Adjudication of individual cases brought before administrative law judges by agency staff, this function is done in individual cases as oppose to rulemaking for whole industries, and administrative agency usually pursues a four step process. 19-3 Explain the distinction between executive administrative agencies and Independent administrative agency is an agency which appointed heads and members serve for fix terms and cannot be removed by the president except for reasons defined by Congress. ...Name Here Legal, Political, Ethical Dimensions of Business – Week 2 Assignment Importation of Citrus From Peru; Expansion of Citrus-Growing Area 1. Agency: The administrative agency that controls the Importation of Citrus From Peru is The Animal and Plant Health Inspection Service under the United States Federal Register Agency. Introduction: This case interests me because of the recent findings in the documents of Pest List and Commodity Import Evaluation that would allow the importation of citrus fruits from the entire country of Peru while providing protection against pests instead of only importing citrus from five citrus producing zones in Peru as currently being allowed. This regulation would open the doors for new businesses in different zones in Peru to compete for the best produce, best prices and introduce new types of citrus fruits. Resulting in lower prices for super market customers, which is my main concern and my business’s benefit. 2. Proposal: Based on the conclusion of the Pest List and the Commodity Import Evaluation document, The National Plant Protection Organization (NPPO) of Peru has requested from Animal and Plant Health Inspection Service to modify the regulation to allow citrus fruit importation from the entire country of Peru into the United States. Currently the importation of citrus into the United States from Peru is limited to five approved growing areas to prevent the introduction and dissemination of plants pests in the...

The main concern regarding this matter is that some homes in the community have lead levels above the EPA action level of 15 parts per billion (ppb), or 0.015 milligrams of lead per liter of water (mg/L), pursuant to EPA federal regulations. Although lead concentrations leaving a water treatment plant are generally low, corrosive water can result in lead leaching from lead pipes within a distribution system. In general, lead solder used to connect pipe, or brass fixtures which may contain a small percentage of lead. As you may already know, lead is a contaminant that the EPA takes very seriously. Exposure to lead can have serious health effects, causing delays in normal physical and mental development in infants and young children and slight deficits in the attention span, hearing, and learning abilities of children. Congress passed the Safe Drinking Water Act in 1974 to develop regulations to control for lead in drinking water. The Lead and Copper Rule (LCR), issued in 1991, is focused on controlling corrosion within the distribution system that delivers water to customers. The Rule requires that public water systems monitor a fixed number of customer taps for lead. If more than ten percent (10%) of taps tested exceed 15...
