submits that it is not the case of Revenue that the sales to the government are not normal or genuine transactions. It is also not suggested, he says, that the price at which the goods are sold to the government is not the normal price in the course of wholesale trade. In such a situation, the most convenient - convenient form the point of view of the Revenue as well as the assessee - course would be to treat the price at which the goods are sold to the government as the normal price within the meaning of Section 4(1)(a). In fact, the learned Counsel says, that should be the only method. However, if for some reason, the Revenue is not prepared to adopt this course then, he says, the Revenue has to deduct all the aforesaid expenses and not merely the transportation charges as specifically provided by Sub-section (2) of Section 4. Sri Nariman relies upon the holding in Bombay Tyre International that deductions other than those specifically mentioned in Section 4 are permissible in law, depending no doubt upon the character of the deduction claimed. On the other hand, Sri Chandrasekheran, learned Additional Solicitor General, submits that Sub-section (2) of Section 4 does specifically envisage and provide for the situation concerned herein. It provides expressly that where the price of any excisable goods is not known at the place of removal and the value of such goods is determined with reference to the price charged at the time of their delivery from a place other than the place of removal, the transportation charges incurred for transporting the goods from the place of removal to the place of such delivery shall be excluded. submits that it is not the case of Revenue that the sales to the government are not normal or genuine transactions. Is Best Buy the Best?

...Is Best Buy the Best? Is Best Buy the Best? Best Buy is one of the leading retailers in electronics and electronic services. With the growing popularity of online shopping, some retail stores are experiencing less physical business and more e-commerce. Best Buy has adapted to this trend and is still able to maintain many stores throughout the nation. The company simultaneously provides an easily navigated website to reach all of its client preferences. To maintain a structure as this, a company must have superior management and functionality. There are four basic fundamentals that encompass the management of a successful business such as Best Buy. The traditional functions are planning, organizing, leading, and controlling. These functions are affected by several external and internal factors such as globalization, technology, innovation, diversity, and ethics. Five Common Factors In 2010, Best Buy separated itself as a company into three divisions; the Americas, Asia and Europe. Each division was created with an executive vice-president running each area who would report to the Chief Executive Officer (Ernst & Young Global Limited). When the company planned this out, it created a self-paced region instead of the entire company proceeding as a whole. In other words, Asia can progress at a different pace then the Americas in all aspects. This plan enabled all regions and the Chief Executive Officer (CEO) to use their brains and ideas from clients to develop more efficient...

...Best of the Best Best of the Best is a movie about the world of martial arts combined with a fictional story line. Released in 1989, I saw this movie for the first time when I was only 10 years old and it has always been a personal favorite. Aside from some cheesy acting and basic storyline the movie itself has merit, not so much for the violence that is innate to the sport of Tae Kwon Do, but for the ending that is wrought with emotion. This movie does not glorify violence in the sport, but rather portrays it matter of fact. The premise of the movie revolves around a tournament between the South Koreans and Americans. The tournament is to be held in Seoul, South Korea and so the task begins of assembling the American team. James Earl Jones plays the role of Coach Frank Couzo who invites top and former great karate athletes to be a part of the five man team. (Lots of references to karate, but it is actually Tae Kwon Do). The five men are brought together, from different backgrounds and of course with varying personal struggles and personality conflicts ensue. Sonny (David Agresta), is an Italian, street smart, macho man. Virgil (John Dye) is the centering persona of the team. He is a Buddhist and expresses the need for calm and meditation. Travis (Chris Penn), is a bit of a hillbilly and has quite the temper. Alex (Eric Roberts), is a widower and has a son, Walter. Alex was forced to retire years ago after suffering a career ending shoulder injury. Tommy (Phillip...

...Discussion 1 Can goals like avoiding unethical or illegal behavior be in conflict with the goal of the firm? How does this complicate the agency problem? In order to proper assess this issue, the agency problem must be clearly identified. According to our text, the agency problem is a conflict of interest between stockholders and management. These problems arise because management’s job is to impress stockholders in investing more into the company. This could mean interpreting policy and procedures a bit more loosely to beef up numbers. This was something I experienced first-hand while working at a nationwide insurance company. The sales department is one of the most crucial parts of the company because they are the producers. I worked in this department more than five years. This experience allowed me to see how managers interpreted the rules and regulations in their own unique way. The rules were either firm or allowed to bend depending on the how close we were to our goals. Many instances of bending the policy and procedures could be construed as unethical or illegal behavior not condoned by the company. The stress of meeting daily, weekly, monthly numbers presses managers and employees to push the envelope by making inappropriate decisions. So in the end, it is a means to an end. The fact of the matter is the agency problem occurs more than we think. Whenever numbers have to be met, which is in almost all firms, unethical or illegal behavior will be loosely defined...

...Video production 9/18/12 The two thousand and five version of King Kong is by far much better than the 1933 version due to certain technology advancements. “Good things never last” said Naomi watts as “Ann” to character “Mr. Denham”, and that seems to be the fate for the once beloved “king Kong” of 1933. Technology seems to be the reason the new version transcends the classic and out shined version. Green screens of the nineteen thirties where great compared to other motion picture technology of its time. Back then you could set up a Claymation diorama or an acting set then just generate an interesting picture behind it and the crowd would go wild. But old ways have proven inadequate in comparison to new age technology. Green screens in two thousand and five could cultivate an entire feature length film with the addition of some other computer animations and sound affects. Such advancements pertain to the reason why I think the two thousand and five versions is better than any previous version. Motion pictures of the nineteen thirties where missing a vital piece of technology that helps the viewer better understand and illustrate the scene. That technology is color, and earlier motion pictures lacked the technology, leaving the viewer to use his imagination. Although “Technicolor” films had started as early as nineteen twenty two, many producers did not acknowledge the technology until later on. Color isn’t a necessity to make a movie “great” but it sure does help the...

...Fret Unit 1 Assn 1 Breaking down the broken-window policing is the concept,"If a window is broken and left unrepaired, people walking by will conclude that no one cares and no one is in charge.", This is like growing up in my neighborhood, in which they placed a police chapter. Teenagers were recruited to be like little deputies, basically to interact with the police. This basically convinced the community that we are all in it together to solve the problem of crime. In New York City it all started with Mr. Bratton who thought that crime could be tame. He indentified where crime was taking place and held local commanders responsible for their areas. It took tactical planning and accountability system. What set the stage for this process to work was Mayor David Dinkins, who won a tax increase to hire 7,000 additional police officers. The stop, question and frisk are an extension of the broken window theory that stated back in the 1980’s. Community scope should focus on the problem that affects the community, and talk to local officials, business leaders to built a brighter future for there community. Lack of community resources presents a challenge for communities. Deficient financial resources to deal with problems, forces community teams to rely on volunteers to carry out community base activities. Relationship between government and urban communities presents problem for community teams. The connection between government and community are damage by the community perception...

...Gaygysyz Bekiyev Section 2 Nature of Thought Thinking is something we all do each day from the moment we wake to the minute we fall asleep. It is a process with many steps that happens in our minds all at once just so we can communicate what the thoughts are. For example, writing this paper. Several things are going through my mind, like the APA format, and am I doing it correctly? Can I remember what I read? Can I put it into words and turn it into a good paper? Will I have everything in my paper expected of me? While thinking of all of these questions, I am feeling anxious, nervous, doubtful, and feeling overwhelmed, going back and forth to the readings; emotions, stress and anger one of the things that influence our thinking process. Emotions can change our way of thinking instantly. Because I am feeling all of these different feelings, it is affecting my recollection, my behavior, my verbal tone, and my writing tone. In other word I was confident in myself that I can produce notable work during this course because the topic interests me. I am recognizing some of the mental blocks that affect my thinking, while I am writing about the processes. The emotions I feel have made me doubt what I have learned in these chapters and have even clouded any kind of organization I may have in my brain for writing this paper. Now I understand why people use the term “it clouded my thinking”. Another thing that can affect our thinking is a person’s stress level. ...
