...Morris W. Ricks Dr. Mindel Speech 101.102 Due Date: June 28, 2011 Persuasive Speech Outline: The USA PATRIOT ACT I. Introduction A. What if your home was raided by the police, and when you asked to see a warrant, an officer handed you a letter signed by the desk sergeant? What if the same officer informed you that he’s taking your cellular phone, because your calls had been monitored? He arrests you, never informs you of the charge, and if released, tells you that you can’t discuss the incident with anyone? You being a well versed citizen of your constitutional rights under the law begin to inform the officer of the first ten amendments, called the Bill of Rights, and your rights have been violated. What if the officer told you that two weeks prior the city legislators got together, and decided that catching criminals has become too difficult of a task? So, they got rid of the first, fourth, fifth, and tenth amendments of the Constitution and now citizens only have six? Well, you would probably advise the officer to zealously avoid the narcotics section of the evidence room. However, what if I told you that this ridiculous scenario I just described is in fact current law at a Federal level, and if all of us as citizens continue to turn a blind eye to the impact this law is having on our way of life, we will watch the very rights I have previously stated slowly, but assuredly dissipate. B. The first article of the U.S Military Code...

...The FBI's VCF (Virtual Case Files) IT project is one of the most highly publicized software failure in U.S history. The main goal of the FBI’s VCF project was to automate the FBI's paper driven work environment, allow agents and intelligence analysts to share vital investigative information, and replace the obsolete Automated Case Support (ACS) system. The FBI outsourced the code writing for the VCF project in the year 2001 to contractor Science Applications International Corporation (SAIC) based out of San Diego,CA. SAIC delivered 700,000 lines of code that was overly bug ridden, and functionally off target from what the FBI expected, that the FBI had to terminate the $170 million project which included $105 million worth of unusable code. Various government audits and independent reports show that the FBI did not have the proper IT management and technical expertise, and should share the blame for the VCF project failure. At the termination of the project in 2005, Glenn A. Fine, the U.S. Department of Justice's inspector general, described the main factors that contributed to the VCF's failure. His list included the following factors: poorly defined and slowly evolving design requirements; overly ambitious schedules; and the lack of a plan to guide hardware purchases, network deployments, and software development for the bureau. The FBI announced that it would buy off-the-shelf software to be installed in phases over the next four years from 2005-2009....

...Mueller-Lehmkuhl GmbH Mueller-Lehmkuhl (ML) was a German producer of apparel fasteners. Apparel fasteners are used in the garment industry. ML had been producing apparel fasteners since the late 19th century. In recent years, they had achieved technological superiority which resulted in high margins for their products. ML valued reliability of their products and fast service to their customers. However, competition and domestic market saturation in the 1980s led ML to a crossroads in which they needed to decide how they would maintain domestic market leadership and while expanding to new markets. Mueller-Lehmkuhl’s Apparel Fastener Products ML utilized an integrated approach in the apparel fastener industry by marketing their fasteners along with the machines to attach the fasteners to garment. Their strategy was to sell manufactured fasteners that were only compatible with ML’s attaching machines. ML produced five types of fasteners: S-Spring, Ring, Prong (Brass), Prong (SS), and Tack. Each product was designed for a specific application. Of the five major product lines, ML had 700 different varieties. In 1985, ML introduced a specialized line of new fashion snap fasteners and tack buttons. The marketing manager believed that this strategy could provide product differentiation that would allow them to increase their market share. This initiative required significant resources from research and development (R&D). At least 33% of the R&D projects...

...different types of turnovers and they are conducted in different manners. The main three are voluntary, discharge, and downsizing. Each explains if an employee is leaving a job for good, if they have been fired or if they are asked to leave in order to benefit them for the better. Voluntary turnover is connected with involuntary turnover. Under voluntary it holds both avoidable and unavoidable turnover. Involuntary holds both discharge, and downsizing in it. The first type of turnover is called voluntary or involuntary. This is either divided into avoidable or unavoidable. Avoidable is usually “initiated by the employee” (Heneman, Judge, Mueller, 2012, p. 685). This symbolizes that the worker “could have been prevented by certain organization actions, such as a pay raise or a new job assignment” (Heneman, Judge, Mueller, 2012, p. 685). Unavoidable turnover refers to an employee quitting. This also is a circumstance that the...

...The fathers of Florence wanted their Cathedral to be finished with the dome they desired. That way they could finally shun the gothic influence they felt (Tom Mueller February 2014). Along came one Filippo Brunelleschi to solve their problems. He was the man with a plan, one which he held close for fear of being ripped off by others. To build a dome 180 feet off the ground was something few could comprehend. The first challenge that was faced was that of lifting such heavy loads to such heights to proceed with construction (Tom Mueller February 2014). Mr. Brunelleschi had what it took to overcome this challenge with his abundant knowledge of clockwork mechanisms and his artistic mind, which allowed him to think outside the...

...guidelines of the National Collegiate Athletics Associations (NCAA), athletes are not supposed to receive any commercial use of their personas and likenesses and are indeed not expected to gain any monetary compensation for their sporting engagements. This has generally been interpreted to mean that they cannot enter into agreements for endorsements in their sporting activities as has been the case with professional engagements. Instead, students are expected to benefit from the payment for tuition fees from their sporting activities. The borne of contention however has been that the universities they play for can enter into agreements of endorsements or other forms of commercial engagements and contracts by utilizing the players identities (Mueller, n.d). This would posit that students surrender their rights of publicity to the universities, raising both legal and ethical concerns. Essentially, this parity in opinions among the different players constituted the motivation for the current study. Based on a detailed review of literature on student-athletes, the paper will present both the pros and cons of monetary compensation for their sporting activities. Conclusions on whether students should be compensated or not will then be presented based on...

...To apply this approach, they utilize the case of aviation security measures, one of the most controversial and highly publicized aspects of heightened security after 9/11. Mueller and Stewart found that the total economic costs of airline security measures was twice the amount of direct public expenditure due to the fact that government would have to obtain resources through the tax system, or perhaps inflation, which would impose indirect costs on the economy in the form of resource misallocation (Stewart and Mueller 157). Additionally, they found that the only two effective antiterrorism measures adopted after 9/11 were strengthening the cockpit doors and passengers learning that they needed to fight back instead of assuming that terrorists were going to take them hostage (Stewart and Mueller 158). But this may not paint the whole picture. Enders and Sandler found in their research that metal detectors at airports were successful in decreasing skyjackings and overall terrorist threats due to lack of credibility (842). Eller and Gerber criticize Mueller and Stewart of oversimplifying the issue and serving solutions which appeal to their own ideological predisposition of less government spending (Eller and Gerber...

...employees with more job creation opportunities. Before the end of this week, the Federal Reserve is expected to announce the new interest rates (Soergel, 2015). As any other economic tendency, it comes with its advantages and shortcomings to the saver and the borrower alike. Thus, it is necessary to analyze the effect such changes will have on various sectors of economy. Impact on the Stock Market The interest rate is the cost paid by the banks when borrowing from the Federal Reserve (Mueller, n.d.). It controls inflation by regulating the amount of money circulating in the economy and thus stabilizing the effects of demand and supply. Thus, the organization determines the amount of money available for goods on the market at any time (Mueller, n.d.). Consequently, an increase in Federal Reserve lending rate has a ripple effect on banks, which spreads to businesses and individuals as well (Mueller, n.d.). Most American retirees depend on interest rates on their savings (which are very low) for survival, and a hike in banking lending rates will be favorable (Soergel, 2015). However, the good news does not favor banks and...

...to God, and among humans in a community. These sacraments help cultivate a strong and healthy relationship with our creator and make it easier for us to reach salvation. Most Christian churches celebrate the sacraments, but there is a wide spectrum of understandings in the number and meaning of the sacraments (Mueller 182). There are seven sacraments and each one of these sacraments are not only mandated by God, but also are granted by God. They allow us to achieve a sense of grace in not only our live but more importantly our afterlife. Grace is a gift of God offered through the Son and in the Spirit sacraments (Mueller 182). However, the grace granted through these sacraments is not to be taken likely. It requires a relationship that emerges from affirms, and returns to the mystery and if the divine-human encounter. The first sacrament is the sacrament of Baptism. It is the symbolic plunging/washing of a person in water that incorporates the person into the mystery of the Lord Jesus Christ and the Church. It signifies the forgiveness of sin because by forgiveness, Christ and his church accept a person through a ritual whereby sin loses its power sacraments (Mueller 183). The exact dates of when it was actually founded aren’t quite known. However we do know it has been practiced since the Book of Matthew in the bible. The focus is on acceptance by forgiveness and not on the sin that causes you to be alienated. Jesus himself was baptized by John before his public ministry...

...------------------------------------------------- Mueller-Lehmkuhl GmbH Mueller-Lehmkuhl (ML) was a German producer of apparel fasteners. Mueller-Lehmkuhl encountered a difficult situation when vying to keep control of its market share with the entrance of a Japanese competitor by the name of Hiroto Industries (HI) into the market. HI eliminated Mueller’s competitive advantage, as they were able to produce fasteners of relatively equal quality at a much lower price. This was due in part to the fact that HI did not carry the additional cost of maintaining and servicing attaching machines like Mueller. HI had been able to effectively transfer these costs directly to the customers, therefore, allowing them to price their products significantly lower. Additionally, HI had been able to produce universal fasteners that current Mueller customers could utilize with Mueller’s attaching machines. Question 3: Assuming the budgeted income shown in Exhibit 1 is the actual income, the total profit from the sale of fasteners and the sale and rental of attaching machines would be $9.5 million. Also, assuming the predicted sales by fastener product line shown in Exhibit 5 are actual figures, combining them with Exhibit 9 we can get the total manufacture cost of fasteners, which is $69,630,604. We also made assumption on the allocation of sales, general, and administration costs on fastener production. According to information provided in the case, we assume that two-thirds of the R&D...
