According to the above petition filed on 5/13/17, by Portsmouth Police Detective N. L. Deluca, the following occurred in the city of Portsmouth. “On 5/13/17, police responded to Hodges Manor Elementary School located at 1201 Cherokee Road, Portsmouth, VA, in reference to juveniles playing on the roof of the school. Upon arrival it was found that entry was gained to the school through a roof hatch that had been opened. The officer on scene also located items on the roof which included clothing, a wallet and a cell phone. Upon entering the same roof hatch Officer R. White located two suspects exiting the school gym. Officer White was in full uniform with badge displayed. One of the suspects (Scott Pierson) was taken into custody. The other suspect who was later identified as Joshua Brown took off running. Once the scene was secured Det. DeLuca was notified and responded to the scene. Upon arrival it was found that the wallet recovered from the roof of the school belonged to Evan Lowey and an address was discovered for Evan. Det. DeLuca and Officer T. Crutcher went to 508 Nottingham Road. A lady who identified as Evan’s mother named Ginger answered the door and verified the wallet along with some other items recovered were in fact Evan’s. He has never failed to appear in court. His legal history includes one intake contact. Evan has had an intake contact for a felony offense, but none of the intake contacts were for felony offenses against another person. He has no history of escape. He has had no juvenile detention confinements, or no other court ordered placements.
