A wise woman by the name Pearl S. Buck once said, “If you want to understand today you have to search yesterday.” She’s saying learn from the past because it will help better our future. This is definitely seen at times in history. We “search” through the past to see what we did wrong and then learn from our mistakes,so it doesn’t happen again. Although some may argue that we never really learned from our past, some cases have shown otherwise, like the Magna Carta and the Bill of Rights. This document was established and ratified in 1791, which goes hand and hand with the Constitution, ratified in 1788. It all started when America decided to become it’s own individual country. They started the American Revolution and after a long hard fight against Great Britain, the British surrendered and the Americans finally got their freedom. They were finally their own country,but being their own country meant they needed to create a structure to help build the rules the Americans would now live by. This is where the Constitution came in, which then led to the Bill of Rights. In order for the states in America to agree to the Constitution, the Bill of Rights must have been included because some were afraid the Constitution would lead back to monarchy,where the citizens would no longer have a say in choices made for their country. The Bill of Rights became an important part of the Constitution and it listed the first ten amendments, which till this day apply in America. It states the limits the government have and how no matter what the government say or do citizens will always have their own rights. These ten simple amendments help shape America and inspired us to be the way we are today. Having their own stories means each document must have its differences between one another. One difference the Magna Carta and the Bill of Rights have is as stated in the Tenth Amendment that since the Constitution may not state everything Congress can and cannot do,it is left up to the states or the citizens to decide if is. Back in 1215, when the Magna Carta was established it seems as though you either put it down in the document,or it all goes back to the King and he makes his own decisions. In this case it was never left up to the people of England, so the “government” was never really limited as it was in the United States with the Bill of Rights. Also, to go hand and hand with the Tenth Amendment, the Ninth Amendment stated the rights stated in the document was not the only rights you had. The citizens were entitled to their own other rights in America, while in England the rights written down were the only ones the king signed off to, so they were the only ones that counted. Lastly,although the Magna Carta did give the freedom for a person to represent a case to someone in it’s own class,but it didn’t mean that in every situation they would have a jury that would make a verdict. However, in the Bill of Rights, the Seventh Amendment , it specifically states that everyone has the right to a jury and a peaceful case.
