|In this paper I am discussing the differences of a Defense Attorney and a Prosecutor |
In the court system there are two types of attorneys, the defense attorneys and the prosecutors. The defense attorney is there to prove their client is innocent while the prosecutor is there to make sure that the defendant is found guilty of the charges that he is facing. While the defense attorney is trying to prove the innocence of their client the attorney or attorneys must find errors in a case to try and get a mistrial or try and build up evidence that the defendant was nowhere near the crime at the time it was committed so they are going to find alibies on where the defendant was at the time of the crime and they are going to try and get witnesses to vouch for the defendant. In cases there are prosecutors that have found evidence against the defendant and when the trial is in order and the prosecutor is cross examining a witness the defense attorney may call for a recess just because they had not heard of the evidence being presented. This is also done by a prosecutor is they have not been informed of new evidence or witnesses. On the other hand the prosecutors are there to protect the victims in most cases and in some cases they are trying to help families of the victim and make sure that justice is served, especially in the case of murder. Prosecutors have to make sure they have all the evidence in order before they try a person in court and take the case to trial. They don’t want to have a criminal set free because they are missing the smallest piece of evidence. Some cases can end in a mistrial because of not enough evidence. And once this happens especially in a murder case you cannot try the defendant again for the same thing it is called double jeopardy. Without the court system having attorneys to defend and protect we the people could have all rights destroyed. While there are some comparisons to the attorneys such as they are both trying help people whether it is the victim or the criminal there are many differences. Criminals must pay for the crimes that they have committed. Even though we have the setting of everyone is innocent until proven guilty in a court of law.
