Summerfield v. Staples Canada Inc. [2016] O.J. No. 2913
Facts: The plaintiff, Michelle Summerfield, worked in sales at Staples Canada Inc. Summerfield was terminated after five years of service, at 39 years old, without cause. She applied to 25 jobs, but remained unemployed. An action for wrongful dismissal was brought against Staples Canada Inc. Summerfield had received five weeks’ termination pay under the Employment Standards Act, 2000, S.O. 2000, c. 41, and five weeks of benefits for a total of $7,779.06. Summerfield ascertained that she should have received nine month’s compensation in lieu of notice, minus the $7,779.06 she already received. The court awarded Summerfield six months’ compensation.
