Supreme Court case
The case Nixon, Attorney General of Missouri, et al. V. Shrink Missouri Government PAC et al. was argued on the 5th of October, 1999, and then decision on the case was made on 24th January, 2000, by the Supreme Court ("Nixon v. Shrink Missouri Government PAC." n.d). The respondents, Shrink Missouri PAC as a political action committee and Zev David Fredman who was a candidate for Missouri state auditor eyeing the 1998 Republican Party nominations alleged in a suit they filed that a statute in Missouri limiting contributions in the range of $275 to $1075 to candidates running for state office was in violation of their First …show more content…
The court did not concur with PAC’s and Fredman’s contention that since approval of Buckley’s $1000, the status of inflation meant that by the state limiting donations to $1075 for state office, it was making an unconstitutional resolution. The decision of The Federal Court was reversed by The Court of Appeals that found Missouri’s desire to avoid the corruption or its perception resulting from candidates’ receipt of huge campaign donations inadequate to suit Buckley’s scrutiny standard of appraisal (Nixon 143). The standard of scrutiny requires that any donation limit concerning substantial intrusion with associational liberties was in the survival position only when the Government considered regulation of donations as a way corresponding to really important interest. The court required of Missouri to showcase its compelling interest, in addition to the donation limits were solely for the purpose of serving that interest. Therefore, the Missouri state government took the case to the Supreme Court. It was incumbent upon the Supreme Court to answer the questions as to whether Buckley v. It was the opinion of the court that both the prevention and perception of corruption were not adequate to justify the donation limits being considered. Consequently, the case dwelt on issues of speech as well as associational privileges of scrutiny with regards to donation limits and felt that the limits hung a great deal on associational rights and not speech rights (Mollar 204). Therefore, it meant a donation limiting that has the ability to survive the claim of association challenge is in a position to also survive the speech challenge. Furthermore, the court did not find any support for arguments that the Missouri restrictions were not the same in comparison to the one persistent in Buckley. As such, the claims were insufficient and could not raise any new issues regarding the sufficiency of the Missouri statute that has been tailored to serve its
