...1. Walker v. Texas Division, Sons of Confederate Veterans, No. 14-144 LEGAL QUESTION Do the messages and symbols on state-issued specialty license plates qualify as government speech immune from any requirement of viewpoint neutrality and has Texas engaged in viewpoint discrimination by rejecting the license-plate design proposed by the Sons of Confederate Veterans? FACTS Texas provides drivers with the opportunity to purchase and utilize specialty license plates. One possible method for the creation of a specialty license plate is if the Texas Department of Motor Vehicles Board (“Board”), by the Board’s initiative or after an application filed by a nonprofit organization, issues a new specialty license plate. See id. If a nonprofit files an application for a new specialty license plate, the plate will only be issued if the design gains the Board’s approval. The Board has the authority to “refuse to create a new specialty license plate if the design might be offensive to any member of the public.” The Texas Division of the Sons of Confederate Veterans (“SCV”) is a nonprofit organization dedicated to preserving the memory and reputation of confederate Civil War veterans. On August 2009, SCV applied for a specialty license plate featuring a logo of the confederate battle flag. Thereafter, the Texas Department of Transportation (“TxDOT”) submitted the application for a vote to its seven-member panel. The TxDOT, responsible for approving specialty license plates in 2009, voted...

...Professional Presence and Influence Western Governors University Professional Presence and Influence A1. Models of Health and Healing- The candidate provides a logical discussion, with substantial detail, of the differences between 2 models of health and healing as they relate to what it means to be human. Since the mid-19th century, there have been three distinct models of health and healing. The first era began in the mid-1960s and dealt primarily with the physical body. It is known as the mechanical model and focused solely on the anatomy and physiology of the body. It was physical in nature, and gave no consideration to the mind or spiritual side of the human being. In this section we will compare the differences between Era II, the Body/Mind model, which emerged around the 1950s, and Era III, the Body/Mind/Spirit or Bio/Psycho/Social model which emerged in the 1990s. During the mid-20th century, Health care providers began to understand that human consciousness played an important role in overall wellness. They recognized that patients with a positive mental attitude about their condition and care generally healed faster than those who did not. Doctors and nurses started to value and encourage input from the patients in their care. Health care professionals began to notice that emotional well-being, personal belief system and attitude all had a definite impact on health and for the first time became important in treating disease. This new phenomenon was considered...

...an interview with the Executive Vice President/Chief of Operations Officer. The organization had a successful attendance of homeless veterans and their families during their 25th annual Stand Down, which is an event to provide substance abuse treatment, medical treatment, psychiatric assistance, legal assistance (Homeless Court), linkage to social programs in San Diego County and other vital assistance such as housing, dental and food services. The event is held every year in July and lasts for three days and two nights. As stated in my earlier paper, this writer held the position of director of the “Welcome Home” Family Program of Veterans Village of San Diego (VVSD). During my seven years of leadership with this non-profit organization, this writer gained a wealth of knowledge in regard to the lack of services that is afforded to our veterans. Although VVSD’s motto is “leave no one behind,” there is a huge homeless population of veterans from wars dating back to the Vietnam War era to the current wars in the Middle East. I was the only female director on staff, and one of three directors of color. An issue arose where the former President/CEO made sexual innuendoes toward this writer on two separate occasions. The first incident stunned this writer because of the high respect I held for our CEO. He was highly decorated war veteran and served 30 years of active duty with the United States Navy. His last MOA with the Navy was Commander. When I reported the incident...

I am also in the Gear Up Leadership program at Lampasas High School, where I am pushed to set the best example for others, I am challenged to promote a college and career oriented future. I believe being a good role model is one of the best ways to show leadership. This past year I was chosen by staff at my school for demonstrating leadership, citizenship, and character in my school and my community, to attend American Legion Auxiliary Bluebonnet Girls State. It was such an honor to be able to attend Bluebonnet Girls State where only 500 hundred girls...

...Africa-Americans Ever since African Americans were slaves, the population of the African Americans during 1860’s in the northern America was about 1% after American Revolution. They experienced discrimination since the beginning based on the color of their skin. This race was perceived to be inferior compared to the whites. Because of discrimination, they were not given some civil rights such as voting. The illogical premise to support this claim was given by the state that the law forbade in certain areas. During this period, the New York Convention stated that only those African Americans with property had the right to vote (Dagbovie, 2007). In essence, during this time they were struggling to get employment and most of them were not financial stable. African Americans have undergone a lot in history and in the present American some of them hold political positions (The president of the United States), manage large firms, and have equal rights like other citizen. In fact I has never been this way, they were unjustly treated and undergone through difficulties that the today’s generation may not understand. The black generation has undergone various challenges in their history that the current generation can never believe to be true and valid. This paper explores the historical background of the conditions this community undergone and how they overcame the racial discrimination, segregation and isolation to acquire equality. ...Positive law as the ethic of our time. Business Horizons | September 01, 1990 | Fisher, Bruce D. | Copyright Positive Law as the Ethic of Our Time The number of businesspersons, political leaders, TV ministers, sports personalities, educators, and other role models for American society who in recent years have been fined, imprisoned, left private or public office in disgrace, or been denied Olympic medals starlets many. Others not only are alarmed by the rash of apparently unethical conduct by society's leaders, but also wonder if there is some character flaw in the present generation of achievers that dooms their ultimate success - and threatens the commitment of the average member of society to the ethics of work and integrity. It is not unusual to read of self-studies by leading business firms that question the propriety of basic organizational values and ask hard questions about the institution. Certainly it makes institutions such as businesses and governments appear ridiculous to line personnel, who are micro-managed to death by institutional guidelines covering the minutes aspects of their work yet see leaders who appear to violate laws governing major phases of their business. This article advances the notion that the "law on the books" - positive law - has become the basic ethic of our business and social culture today. That is, people have come to accept the notion that if they have followed the law on the books in a democratic society, that is probably all...

...Suggestions Walmart needs to adjust to the Chinese market, while leveraging its source of competitive advantage. This requires a delicate balance. At the US, the brand Walmart is associated with low price rather than quality. In China, where everyone is going for low prices and providing low quality to do so, Walmart’s own brand could be an assurance for low prices but with quality by making the Walmart name about more than just retailing. The suggested strategy in the 2008 Walmart supplier meetings shows that it’s heading in that direction (Business Week). This also follows Gome’s strategy of renaming its suppliers to their own brand (Business Week), but goes beyond it as the foreign brand in China is already associated with higher reliability and quality assurance. This actually holds true in China were retailers do a better job of enforcing supplier quality than the local regulations. With that, Walmart is still able to use its expertise and knowledge in supplier negotiation and distribution system to keep costs down. Although Walmart is a Joint-Venture, the sources do not mention any attempt to leverage the local partner to meet the local market, which seems the opposite to some other joint ventures discussed like Danone and Wahaha. Working together with the local partner to understand where and how the local regulations can be used or adjusted for Walmart’s success and gaining a stronger hold of the potential customer’s heart might help Walmart’s growth and dominance in...

I always said yes to trying new foods, taking mental and physical risks, and learning new skills when possible. I was born and raised in Queens, New York where I hustled on the daily; interacted with people of all kinds and developed a New Yorker mentality of “time is money” and acquired a taste for Italian, Korean, and Indian food. Then, I moved to the Great Neck bubble where I felt as if my development was being stagnated because of the lack of diversity and opportunities. But that didn’t stop me—I traveled to new...

...on sexual orientation information. The case involving the Boy Scouts of America and the United Way detailed in Managing Human Resources (pp 150) provides an excellent example of the ethical and realistic issues that can arise surrounding this now common lifestyle. James Dale prided himself on instilling self-reliance and leadership in children’s’ lives as an assistant scoutmaster for the Boy Scouts of America (BSA). After 12 years, this veteran volunteer was expelled from the BSA after they learned that he was gay because of his sexual orientation. Though the boy scouts teach young men to stand up for what is right, they did not have any anti-discrimination laws intact to protect homosexual volunteers. Dale, instead, turned to rely on the courts for help. During the court case, the state court initially ruled that Dale should be able to return as a scoutmaster, indicating that one’s sexual orientation does not drive the ability to help the scouts, but the BSA did not accept this answer. Instead, the BSA turned to the Supreme Court to get permission to release Dale of his scoutmaster duties. The United Way had been involved with the BSA for numerous years and provided support funding for various Boy Scout activities and programs. Overall, the United Way has protected its own employees and those it worked with by instilling a policy protecting employees against sexual discrimination. Although the United Way leaves the ultimate decision for antidiscrimination laws up...
