• In the late 1900’s, the era known as the Warren Court would become one of the most active justices in regards to policy: o Warren was chosen by President Eisenhower and he ended up regretting at first due to the great changes he was making.
 This was the court that made the ruling on the famous Brown v. Board of Education controversy. o He would continue this legacy be being supportive of the rights that criminals and defendants deserve.
 This also includes the enforcement of the 4th Amendment (Unreasonable search and seizure).
 Many almost thought to even impeach him since certain group thought he was essentially re-writing bills which is Congress’ job (he was not in reality).

 Even though he was heavily conservative, he refused to overturn previous Supreme Court Case decisions and was in support of affirmative action as well as many abortion rules. o Ironically, the tables would end up turning after Nixon and his Watergate Scandal went down.
 The Supreme Court under Burger agreed unanimously that Nixon needs to disclose all of the recorded tapes from his office and most likely accept the truth of impeachment.
 As we learned in the previous chapters, Nixon escaped this by retiring right before the vote went through within the Senate.
• Finally, another era would arrive in the very late 1900’s where Justice Rehnquist would create a powerful and united panel of judges. o A high point this court is known for is its participation in the famous election of 2000 or court case Bush v. Gore.

 There is a clear argument that the judicial branch is taking its powers a bit too far in regards to policy, breaking separation of powers. o Instead of the last powerful, it is the least democratic as some would describe it.
• As any argument, there is always two sides and there is a heavy rebuttal to this view point: o Judicial Activism- A judicial philosophy in which judges make bold policy decisions, even charting new constitutional ground; advocates of this approach emphasize that the courts can correct pressing needs, especially those unmet by the majoritarian political process.
 It is important to note that these terms are not ideologies or party affiliations, this relates more to morals and the philosophy of the branch.
