...Matter of Opinion I do not agree with the article and I would like to explain why. First let’s take a look at the statement “entitled to an opinion”, what does it mean to be entitled? Entitlement is simply staking claim, so when someone says they are “entitled to their opinion” what they are saying is they are claiming the opinion as theirs. We can assume this to be true because they have stated an opinion and now they are stating that the opinion is theirs, while this should be the end of the story it is far from over. Part of the problem with this article is the fact that the author is stating his opinion that “people are not entitled to their opinions” as fact, however he contradicts himself. Fact either is or is not true, so either people are entitled to their opinions or they are not, he can’t have it both ways, but this is exactly what he is trying to do when he specifically states in the article that there are some opinions that just can’t be argued, such as those involving personal preference (Stokes, 2012, para 7). It makes sense then that if an opinion cannot be argued against for reason of logic then the person of the opinion must be entitled to it. My argument does not stop there however, let’s just assume people who have opinions on their personal preference are not entitled to them and move on to what I believe the author was really trying to convey, people should not have an opinion unless it is based in fact and they can back it up. What about Juries? Are...

...Review & Summary: The article that I am reviewing is “ The Public’s Conditional Response to Supreme Court Decisions” (Johnson & Martin 1998). This article specifically speaks to answer, whether the Court affects public attitudes when it makes decisions or initial rulings on a salient issue or subsequent decisions on the same issue. Johnson allows us to investigate the effect of the Supreme Court on public opinion, which offers the conditional response hypothesis based on the theory of Supreme Court legitimacy, and a micro-level social-psychological theory of attitude formation through his writing. To test this prediction Johnson analyzes public opinion data before and after the Supreme Court ruled in a highly visible abortion case (Roe v. Wade 1973), along with three key capital punishment rulings. (Furman v. Georgia 1972, Gregg v. Georgia 1976 & McCleskey v. Kemp 1987) When the Supreme Court made decisions, the public simply accepted them as legitimate. The reasoning behind this is simply because the Supreme Court is seen as the ultimate arbiter of the law. The model used by both Johnson and Martin (1998) is based upon two different theories. The first, since the public generally views the Court as a highly credible institution, individuals are more likely to clearly elaborate their attitudes toward an issue after a ruling. When the court makes its first major decision on a particular, the structure of public opinion changes in a manner consistent with...

...About the EPA Fracking Report” written by Michael Brune on the website EcoWatch discusses the problems the U.S. Environmental Protection Agency’s report on Hydraulic Fracturing Drinking Water Assessment addresses. The article discusses how fracking has contaminated the drinking water and this contamination has not been documented by the EPA. The author gives five things he believes you should know about the fracking report; 1. Oil and gas companies don’t want you to know about fracking; 2. There are a lot of risks to drinking water that has been fracked because chemicals can get in your water; 3. Fracking is usually done near where people live; 4. Fracking is usually done near water that supplies citizens with water;...

...Creating articles and getting published in magazines or newspapers are the reason journalists become journalists. The right to freedom of press and speech allows journalists to write and communicate stories to others without fear of prosecution regardless of the contents of the stories. “The right, guaranteed by the First Amendment to the U.S. Constitution, to gather, publish, and distribute information and ideas without government restriction; this right encompasses freedom from PRIOR RESTRAINTS on publication and freedom from Censorship.” (dictionary, 2013) The first amendment states that congress shall pass no laws undermining the freedom of speech within the constitution. This means that congress is unable to censor the stories that are written by journalists. I distinguish fact from opinion by researching and asking questions. Often times individuals will tell you my opinion is or in my opinion. However there are cases that arise where the individual does not say whether it is opinion or fact and this is typically when I begin researching other sources for the same information. There are however information that can be stated that will get us into trouble such as libel which is when an individual publishes information about another individual or group that contains lies to harm that individual or cause the individual anguish through ridicule or hatred. Slander is also another term that can get journalist into trouble if they are not careful how they word their articles. Slander...

...Article Tittle: PRO: Death penalty best way to deal with violent criminals In the article entitled PRO: Death penalty best way to deal with violent criminals the writer discusses why the death penalty should be mandatory in certain criminal cases. Personally, I Believe the article was based more on the author’s personal opinion regarding the death penalty. In the article, the writer referenced a bible verse that provides “justification” for death penalty bring place. My argument would be, how this applies to those who are NOT religious. Or maybe they are religious but just done follow the policies of the Bible? The Author also touched on the financials of housing a convicted felon in prison. The author stated its best to sentence these criminals to the death penalty to avoid the $20,000 + per year that it takes to house this population of prisoner. Based on my research, in many states he average convicted felon remained on death row for twenty years, before they were actually executed. So to that I say, where are costs being cut in this situation? One point within the article that I partially agreed with is, people who commit these type of crimes are not good people. The writer also stated that for the benefit of the victim(s), the inmates should be immediately executed, so that their pure existence would not haunt the surviving victims and families of those victims who did not survive. I cannot verify the validity of the data; because again, the article seems...

...enhance the degree of confidence of intended users in the financial statements which can be achieved by the expression of an opinion by the independent auditor on whether the financial statements are prepared, in all material respects in accordance with the applicable financial reporting framework. Putra, in his article entitled Understanding Audit Reports and Auditor’s Opinion, foremost conferred about the significance of the auditor’s report. Basically, designing an accounting information system that will capture all of its business transactions and compile the financial statements is the management’s responsibility. However, third parties, such as a current or potential investor or creditor, may be concerned about whether management has put the financial statements together without bias. This is where the work of an independent auditor comes to place. In his article he stated that an independent auditor’s report is designed to alleviate that concern and give the public assurance that the financial statements can be relied on. He also thinks that assurance is a key word: In fact, it is common in the accounting profession to refer to auditing as an assurance service or attest service because the auditors are providing assurance or attesting (vouching for) to the fairness of the presentation of the information on the financial statements. In his article he also discussed each of the important part of the audit report. He also pointed out that the audit report makes it clear that...

...Technical Institute Richard Kmetz Toulim Model The claim in this article is that there isn’t the need any more to teach kids farm Chores. The Qualifier for this article is that the need to teach children about farming chores has long since passed based upon the number of farms that are actually in existence today. The Grounds given by the author is that with the world as connected and diverse as it is the need to teach kids how to milk cows or complete farm chores has long since passed. The Warrant for this article is based upon generalizations. The only obvious Rebuttal in the article is the author’s statement that “Better that kids of today be taught about ring tones, A.T.M’s, cubicles, Best Buys and cup holders.” The Backing of this argument is provided by the author’s descriptions of shucking corn, gathering eggs, and milking a cow. Milking the cow is described as “archaic”. There is also a reference to a “creepy, oafish” guy named Joe who pretends to play a banjo while the others around him celebrate obsolete achievements. I didn’t find the article particularly convincing primarily because it was so one sided. The argument, to me, was weak because it did not provide facts. There were plenty of the author’s opinions, but those seemed not to be factually based. There just want any real evidence. It was all personal opinion of the author who seemed pre-disposed to her thoughts. I think the article would have been improved with information that truly backed up her...

...For my second journal article memorandum, I chose “Caught in the Draft: The Effects of Vietnam Draft Lottery Status on Political Attitudes” by Robert Erikson and Laura Stoker, which featured in The American Political Science Review in May of 2011. I chose this article for two reasons with the first being my passion for military history. However, the second and more important reason I chose this article was because of its uniqueness. I felt that this article offered a different look at one of the most controversial aspects of the Vietnam War, the draft. This article discusses the impacts of the randomization of the draft through a lottery system and how it affected the political opinions of the men affected by it. This is something that I have...

...influencing profitability in any industry in the article The Five Competitive Forces that Shape Strategy and gives his opinion on what to do once they are identified. These five factors can be evaluated with respect to the Personal Computer (PC) industry based off of a 2012 case study of Apple Inc. Rivalry among existing competitors, the first and most obvious of the five competitive forces, is a strong force in the PC industry with great impact on profitability. Rivalry is high because the competition in the computer industry is very intense among very few serious competitors. The top four PC vendors (Hewlett-Packard, Dell, Lenovo, and Acer) accounted for 53.6% of worldwide shipments in 2011. Leadership in the industry has shifted numerous times, leading to slight differentiation and price competition by each company in an attempt to get ahead. Threat of new entrants is a weak competitive force for the PC industry. The presence of the four existing dominant players and significant barriers to entry deter new competitors from seriously entering the market. A new company would need to heavily invest in research and development and quickly generate brand recognition, and therefore would be unlikely to cause a large threat. Bargaining power of buyers Michael Porter explains in detail the largest factors influencing profitability in any industry in the article The Five Competitive Forces that Shape Strategy and gives his opinion on what to do once they are identified. ...

...like to be carnivores, vegetarians, vegans, or a combination. Author Ben Kim, a chiropractor and acupuncturist in Barrie, Ontario, Canada, states his thoughts on these choices in his article “A Strict Vegetarian Diet Is Unhealthy for Most People.” His article was written in 2010 to discourage people from adopting 100% vegan diets because in his opinion these diets are dangerous to the long term health of humans. Kim addresses his article to people who have adopted or are thinking of adopting 100% vegan lifestyles. He is trying to convince these groups that it is unhealthy long-term to limit yourself to a 100% plant-based diet. The main ideas Kim states in order to dissuade his audience from adopting vegan diets are that 100% vegan diets lead long term to the development of nutritional deficiencies and significant health problems, that the morality of vegan lifestyles are questionable, and that the organizations that promote vegan lifestyles have ulterior motives. While Kim makes a weak argument against 100% vegan diets, his assertion that diets with a majority of plant based foods are healthy for you, but eating only plant based foods is not, is valid. Kim states that “people can survive for many years on a strict vegan diet, but almost always with one or more significant health problems.” His article does not present a strong argument in support of this statement though. He offers no...

He is a graduate from Universiti Sains Malaysia and he is a forensic scientist by education. Currently, Nicholas Chan is a socio-political research analyst at Penang Institute. He believes that there is truth in everything and it all depends on whether a person willing to see it or not. SUMMARY The author started the article by informing the reader about the current education status of the Malaysian students. The main points which were discussed in this article were about the examination and educational level in Malaysia. The author is disappointed with the education level in Malaysia. The author compared the education level with other countries too. Besides, the author mentioned about the removal of Penilaian Menengah Rendah (PMR) which was announced recently, and replaced with school based assessment (PBS). The removal of PMR was caused by the difficulty in making sense of having students with excellent results, but still underperforming to international standards. The author made assumptions on the education level that the standard of Malaysia education is low. Lastly, the author gave suggestions on ways to overcome the inequality problem in education. The author concluded the article with hope. ANALYSIS Facts VS Opinion Author is using many facts data to support his opinion. As an example...
